Resolution No. 5891 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 R~SOL~ION NO. 5891 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A CONDITIONAL USE PERMIT TO DALE AARONSON FOR THE CONSTRUCTION AND OPERATION OF A RETAIL COMMERCIAL USE WHICH WILL GENERATE MORE THAN 20 VEHICLE TRIPS PER DAY PER 1,000 GROSS SQUARE FEET OF FLOOR AREA WHEREAS, Dale Aaronson has applied for a condi- tional use permit to operate a retail/commercial use (convenience store) with a proposed floor area of ap- proximately 2,200 square feet at 3843 Soto Street (northwest corner of Soto Street and Vernon Avenue), on a parcel contain- ing approximately 38,430 square feet in the General Industrial (M) Zone. WHEREAS; the proposed use will generate more than 20 vehicle trips per day per 1,000 gross square feet of floor area and requires a conditional use permit under Section 26.3.5-3. of the zoning code; and, WHEREAS; the proposed site is of adequate size and shape for the proposed operation; and WHEREAS, the proposed use is surrounded by in- dustrial uses and is compatible therewith and no adverse noise, odor, dust; smoke, light or glare, or risk of fire, infection, explosion or effects on wildlife resources are an- ticipated from the proposed operation; and WHEREAS, the site has adequate access to Soto Street and Vernon Avenue; and it is anticipated that traffic will travel to the site from all directions. Vernon Avenue and Soto Street have adequate capacity to handle the traffic gen- 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 erated from the proposed operation; and WHEREAS, there are no conditions imposed by State or Federal laws; and WHEREAS, the conditions imposed on the conditional use permit will adequately protect the public health, safety and general welfare, and the operation is consistent with all applicable rules and laws of the City of Vernon; and WHEREAS, the proposed use is consistent with the General Plan and the Comprehensive Zoning Ordinance of the City of Vernon; and WHEREAS, the City Council of the City of Vernon held a hearing on said application for a conditional use permit on March 5, 1991. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: That the City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: That the conditional use permit is hereby granted to Dale Aaronson for the operation of a retail/commercial use (convenience store) located at 3843 Soto Street. SECTION 3: In order to adequately protect the pUblic health, safety and general welfare the following conditions are imposed: a. The facility shall be operated in accordance with the appropriate codes, rules, regulations and subject to 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 permit fees as adopted by the City of Vernon and shall be operated in a manner to prevent unsanitary conditions, odors, or other nuisances. b. Prior to occupancy, Dale Aaronson shall obtain a sales tax permit from the state Board of Equalization bearing the City of Vernon Tax number 19039, and a city of Vernon business license. c. Any expansion or change in use shall be approved by the Director of Community services. d. Where parking areas adjoin a public street or streets, a masonry wall not less than 30 inches in height or landscaped area a minimum of 4 feet in width, measured from the property line, shall be established along such frontage, except at driveways, walkways or where other openings are necessary. e. Any hazardous materials used or handled shall meet the requirements of the Vernon Fire and Health Depart- ments prior to use or storage at the site. f. The facility shall be operated in a manner which will not impede traffic on Soto street or Vernon Avenue. g. ~he number of parking and loading spaces re- quired per the City of Vernon Comprehensive Zoning Qrdinance shall be provided. The minimum number of spaces shall accom- modate the vehicles for each employee, visitor and any other person normally transacting business at said building. All parking and maneuvering areas shall be paved. h. The owner shall deposit funds in the amount 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 determined by the Director of community Services, in order to construct a continuous raised concrete median and associated re-striping in Soto Street. The raised median will restrict turning movements onto the site. The length of median and striping shall be equal to the length of frontage along Soto street for the sUbject site. Said funds shall be deposited prior to any construction on the site. i. The owner shall construct all frontage improve- ments adjacent to their site along Soto Street and Vernon Avenue as directed by the Director of Community Services. Plans for the required frontage improvements will be prepared by the City. The improvements shall include the work as- sociated with the widening of Soto Street by eight feet and Vernon Avenue by three feet. Construction shall include new sidewalk, curb and gutter, driveway, curb ramp and asphalt pavement, the relocation of catch basins, power poles, water facilities, traffic signs and traffic signals. All work shall be performed to City standards and shall be completed prior to occupancy. Water and power work will be performed by city crews or contractors but will be funded by the owner. j. Prior to the issuance of building permits the owner shall deed to the City of Vernon, the easterly eight feet of their parcel along Soto Street, the southerly three feet of their parcel along Vernon Avenue, and sufficient property to construct a fifty foot curb return at the south- west corner of Soto street and Vernon Avenue. The prope~ty line radius for this corner shall be forty feet. The owner 4 L 1 2 shall deed to the City of Vernon Light & Power Department, 3 required easements for power lines. 4 k. Adequate trash receptacles shall be provided on 5 the site to keep litter to a minimum. All Dale Aaronson lit- 6 ter blown or dropped on adjacent properties shall be retrieved 7 and disposed of daily by a Dale Aaronson employee. 8 1. The parking, driveway access and landscaping 9 shall be developed in accordance with the site plan which was 10 submitt.ed with this application and approved by the Director 11 of Community Services. No changes shall be made in the site 12 development except with the prior approval of the Director of 13 Community Services. 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 m. The owner shall complete pest control treatment, as approved by the Health Department, to all existing struc- tures prior to demolition. SECTIOl'l 4: The City Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect.
