A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON ESTABLISHING HAZARDOUS
MATERIALS ESTABLISHMENT PERMIT AND
APPLICATION FEES IN ACCORDANCE WITH
SECTIONS 13.54 AND 13.55 OF THE VERNON
CITY CODE AND REPEALING ANY CONFLICTING
PROVISIONS OF RESOLUTION NO. 5729

8 WHEREAS, the City Council of the City of Vernon adopted
9 Ordinance No. 961 on June 24, 1986 and added Sections 13.54 and
10 13.55 to the Code of the City of Vernon, establishing that the
11 Hazardous Materials Establishment permit and application fees
12 shall be set by res01ution; and
13
WHEREAS, the City Council of the City of Vernon
14 established permit and application fees for Hazardous Materials
15 Establishments by Resolution No. 5729 on March 20, 1990; and
16 WHEREAS, said fees established by resolution are hereby
17 determined to be inadequate to cover the cost of processing the
18 permits.
19 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
20 THE CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon
22 hereby finds and determines that the recitals contained
23 hereinabove are true and correct.

SECTION 2: The City Council of the City of Vernon does
25 hereby establish the following fees pursuant to sections 13.54
26 and 13.55 of the Code of the City of Vernon:

Handling of less than 100 kilograms
(220 lbs) of hazardous materials per
month; or less than 1 kilogram
(2.2 lbs) of extremely hazardous waste
per month.

Handling of 100 kilograms (220 lbs) to
1,000 kilograms (2,200 lbs) of
hazardous materials per month; or 1
kilogram (2.2 lbs) to 10 kilograms (22
lbs) of extremely hazardous waste per
month.

Class C:

Handl ing over 1,000 ki lograms
(2,220 lbs) of hazardous materials per
month; or over 10 kilograms (22 lbs)
of extremely hazardous waste per month

TO AMEND PERMIT:
15 For the purpose of determining the above fees, 1 gallon
16 (3.79 liters) of liquid shall be equivalent to 7 pounds (3.18
17 kilograms).

SECTION 3:
Establishments which have hazardous
19 substances stored in underground storage tanks, for which a
20 valid operating permit has been issued by the local agency,
21 shall be exempt from including the volume of the underground
22 storage capacity when determining the permit fee classification
23 for Hazardous Materials Establishment.

SECTION 4: In addition to the foregoing, the permitee
25 shall pay all other necessary fees or deposits which may be
26 required by other ordinances or resolutions of the city of
27 Vernon or applicable State law in effect.

The fees provided for herein shall be

2 effective April 1, 1991, and Resolution No. 5729 and all other
3 resolutions in conflict herewith are hereby repealed.

SECTION 6: The City Clerk of the City of Vernon shall
5 certify to the passage of this resolution and thereupon and
6 thereafter the same shall be in full force and effect.
7 APPROVED AND ADOPTED this 19th day of March, 1991.
