A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING VARIANCE TO
CONCORD ENTERPRISES, INC. FROM SECTION 26.4.2-8,
DEVELOPMENT STANDARDS, OF THE COMPREHENSIVE
ZONING ORDINANCE, FOR PROPERTY LOCATED AT
2957 46TH STREET IN THE CITY OF VERNON
WHEREAS, Concord Enterprises, Inc., has applied for
a certificate of occupancy for a building Nhich requires a
variance from Section 26.4.2-8, Development Standards, of the
Comprehensive Zoning Ordinance, for the property located at 2957
46th Street; and
WHEREAS, the physical condition of the property is
unique in that the existing building Nas constructed Nith
fifteen truck docks, six of Nhich have been recessed 65 feet
from the street right-of-Nay Nith the remaining nine measuring
approximately 28.0 feet from the street right-of-Nay; and
WHEREAS, the premises are required to have five truck
loading spaces and the existing recessed truck docks are
sufficient to conform Nith the truck loading.requirements of the
Comprehensive Zoning Ordinance, but Concord Enterprises, Inc.
Nould like to use six of the nonconforming spaces for
convenience; and
WHEREAS, Section 26.4.2-8(c) specifies that each
loading space shall be a minimum of 10-feet Nide and 65 feet
long; and
WHEREAS, the application of the development standards
for truck loading space sizing requirements Nill create an
unreasonable hardship by requiring 65 feet long by 10 feet
Nide spaces for loading docks Nhich are in excess of the current

1 either be permanently sealed or recessed 105 feet from the
2 street right-of-way.
3 SECTION 4: Noncompliance with this condition shall
4 constitute sufficient grounds for the City Council of the City
5 of Vernon to void this variance and require the application of
6 the authorized truck loading space requirement.

SECTION 5:
The City Clerk of the City of Vernon shall
certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.
