Resolution No. 5986 . 1 2 3 4 5 Resolution No. 5986 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING VARIANCE TO FLORIST HANDY, INC. FROM SECTION 26.4.2-8, DEVELOPMENT STANDARDS, OF THE COMPREHENSIVE ZONING ORDINANCE, FOR PROPERTY LOCATED AT 4561 48TH STREET IN THE CITY OF VERNON 6 WHEREAS, Florist Handy, Inc. has applied for a 7 certificate of occupancy for a silk screening business in a 8 building "hlch requires a variance from Section 26.4.2-8, 9 Develop...ent Standards, of the Comprehensive Zoning Ordinance, 10 for the property located at 4561 48th Street; and 11 WHEREAS, the physical condition of the property is 12 unique in that the existing building measuring approximately 13 12,000 square feet "as constructed Kith t"O truck docks 14 measuring 40.6 feet from the street right-of-"ay and 13.7 feet 15 wide; and 16 WHEREAS, Zoning Ordinance Section 26.4.2-7 requires 17 t"O loading spaces for a building Kith 8,001 to 25,000 square 18 feet in floor area, Section 26.4.2-8 specifies that each loading 19 space shall be a minimum of 10 feet "ide and 65 feet long and 20 Section 26.4.6-4c provides that a non-conforming building must 21 comply Kith these standards Kith any changes in occupancy unless 22 a variance is granted; and 23 WHEREAS, the application of the development standards 24 for truck loading space sizing requirements "ill create an 25 unreasonable hardship by requiring two 65 feet long by 10 feet 26 wide spaces be provided; and 27 WHEREAS, Florist Handy, Inc. has indicated that 28 it has no plans to expand or alter the building configuration 1 1 and that the two 40.6 long by 13.7 wide loading spaces are 2 sufficient for the intended use; and 3 WHEREAS, 4561 48th Street is located in the M zone and 4 the operation is consistent with the objectives of the General 5 Plan and Zoning Ordinance; and 6 WHEREAS. the city Council, of the City of Vernon held 7 a hearing on said application for a variance on September 23, 8 1991. 9 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF 10 THE CITY OF VERNON AS FOLLOWS; 11 SECTION 1: The City Council of the City of Vernon 12 hereby finds and determines that the recitals contained herein- 13 above are true and correct. 14 SECTION 2: A variance from the requirements for two 15 loading spaces 10-feet wide by 65-feet long is hereby granted to 16 Florist Handy, Inc. at 4561 48th Street on condition that the 17 two loading bays 13.7 feet wide by 40.6 feet long be maintained. 18 SECTION 3: The variance shall be granted subject to 19 the following condition: the usage of the loading spaces 20 shall be limited to vehicles with a maximum length of 40.0 feet. 21 SECTION 4: Noncompliance with this condition shall 22 constitute sufficient grounds for the City Council of the City 23 of Vernon to void this variance and require the application of 24 the authorized truck loading space requirement. 25 26 27 28 III III III 2 " -< 1 SECTION 5: The City Clerk of the City of Vernon shall 2 certify to the passage of this Resolution and thereupon and 3 thereafter the same shall be in full force and effect. 4 5 6 7 :Ad--/~ BROCE V.
