RESOLUTION NO. 5990
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON GRANTING A CONDITIONAL USE PERMIT TO
BROADBENT MERCANTILE, INC. FOR THE OPERATION OF
A TRUCK AND FREIGHT TERMINAL AT 4280 BANDINI
BOULEVARD
WHEREAS, Broadbent Mercantile, Inc. has applied for
7 a condi t ional use permi t to operate a truck and freight
8 terminal at 4280 Bandini Boulevard; and
9 WHEREAS. the City Council of the City of Vernon held
10 a hearing on said application for a conditional use permit on
11 September 23, 1991; and
12 WHEREAS. the proposed site is a conforming use in
13 the Heavy Industry (M2) Zone which has been continuously used
14 as a truck and freight terminal, but which requires a
15 conditional use permit under the Zoning Ordinance in order to
16 continue the use; and
17 WHEREAS, the proposed site is adequate in size,
18 shape and topography for the proposed operation, has adequate
19 drainage, and a masonry wall or landscaping will be installed
20 where parking areas adjoin a public street pursuant to the
21 Vernon City Code; and
22 WHEREAS. the proposed site is surrounded by
23 industrial uses compatible wi th the proposed use and no
24 adverse effect from traffic, parking, noise, odors, dust,
25 smoke, light or glare, or risk of fire, infection or explosion
26 is anticipated from the proposed operation; and
27 WHEREAS, the site has access to Bandini Boulevard,
28 and in general traff ic wi 11 travel from the si te east on

1 Bandini Boulevard to the Long Beach Freeway. Bandini
2 Boulevard is located in the City of Vernon and is of adequate
3 width and pavement type to handle the traffic generated from
4 the proposed operations; and
5 WHEREAS, the site is required to have adequate off-
6 street parking and loading facilities in accordance with the
7 Vernon City Code; and
8 WHEREAS, the conditions imposed on the conditional
9 use permit will adequately protect the public health, safety
10 and general welfare and the operation is consistent with all
11 applicable rules and laws of the City of Vernon; and
12 WHEREAS, the proposed use as to location, operation,
13 and design is consistent with the General Plan and the Zoning
14 Ordinance of the City of Vernon.
15 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
16 OF THE CITY OF VERNON AS FOLLOWS:
17 SECTION 1: The City Council of the City of Vernon
18 hereby finds and determines that the recitals contained
19 hereinabove are true and correct.
20 SECTION 2: The conditional use permit is granted
21 to Broadbent Mercantile, Inc. for the operation of a truck and
22 freight terminal at 4280 Bandini Boulevard.
23 SECTION 3: In order to adequate I y protect the
24 public health, safety and general welfare the following
25 conditions are imposed:
26 a. The facility shall be operated in accordance
27 with the appropriate codes, rules, regulations and subject to
28 permit fees as adopted by the City of Vernon. The facility

1 shall be operated in a manner that will prevent unsanitary
2 conditions, odors, or other nuisances. Prior to occupancy a
3 business license and occupancy permit shall be obtained. All
4 trucking operat ions, incl uding truck and trai ler parking,
5 shall be limited to the lot located at 4280 Bandini Boulevard.
6 b. Any hazardous substances used, handled or
7 stored shall have prior approval from the Vernon Fire and
8 Heal th Departments. A heal th permi t shall be obtained if
9 there are reportable quantities of hazardous materials on the
10 site.
11 c. The number of employee parking spaces required
12 per Vernon City Code shall be provided and maintained.
13 d. All parking and loading facilities shall be
14 paved wi th a hard durable surface mater ial and shall be
15 adequately drained, and kept free of dust, mud trash or weeds.
16 e. Where parking areas adjoin a public street or
17 streets, a masonry wall not less than 30 inches in height or
18 landscaped area a minimum of 4 feet in width, measured from
19 the property line, shall be established along such frontage.
20 except at driveways, walkways or where other openings are
21 necessary.
22 f. Servicing of vehicles including washing, steam
23 cleaning and repairing shall be performed in facilities in
24 compliance with appropriate codes.
25 g. The underground storage tank monitoring system
26 shall be checked by a qualified service person. The
27 monitoring system must meet requirements of Vernon City
28 Ordinance No. 944.

In accordance wi th Nat ional Poll utant Discharge
2 Elimination System Permit Regulations, Broadbent Mercantile
3 Inc. shall submi t a Not ice of Intent to the State Water
4 Resources Control Board and a prevention plan and monitoring
5 program shall be prepared within the Board's time limitations.

All equipment stored on the si te other than
7 vehicles must be kept within the existing structures.
8 Adequate plans and materials must be available for handling
9 leaks

SECTION 4:
The City Clerk of the City of Vernon
12 shall certify to the passage of this resolution and thereupon
13 and thereafter the same shall be in full force and effect.
