RESOLUTION NO. 5993
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON ACCEPTING THE WORK OF EXCEL PAVING
COMPANY IN ACCORDANCE WITH CONTRACT NO. 503
OF THE CITY OF VERNON
WHEREAS, Excel Paving Company was awarded Contract
No. 503 for work on Jewel Avenue Reconstruction, pursuant to
Resolution No. 5856 of the City of Vernonj and
WHEREAS, Victor H. Vaits, Director of Community
Services has reported to the City Council of the City of
Vernon on September 17, 1991, that said work has been
completed and recommends that the work be accepted and
payment be made to the Contractor in accordance with the
agreement.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained
hereinabove are true and correct.
SECTION 2: The work of Excel Paving Company,
pursuant to Contract No. 503 is hereby approved by the City
of Vernon.
SECTION 3: The total contract amount is Three
Hundred Fifty-three Thousand Nine Hundred Seventy-two
Dollars Thirty-four Cents ($353,972.34). There is now due
to the Contractor a final partial payment totaling Three
Thousand Eight Hundred Eighty-five Dollars Thirty-six Cents
($3,885.36), which is payable at this time, and the

remaining ten percent (10%) of the total contract amount, or
the sum of Thirty-five Thousand Three Hundred Ninety-seven
Dollars Twenty-three Cents ($35,397.23) is payable thirty-
five days after the adoption of this resolution.
SECTION 4: The City Council of the City of Vernon
hereby directs payment of said sums as set forth to Excel
Paving Company and instructs the City Clerk to file a notice
of completion with the County Recorder.
SECTION 5: The City Clerk of the city of Vernon
shall certify to the passage of this resolution and
thereupon and thereafter the same shall be full force and
effect.
APPROVED AND ADOPTED this 23rd day of september,
1991.
