Resolution No. 5995 .. 1 2 3 4 5 adoption of Ordinance No. 6 7 8 9 10 11 12 13 RESOLUTION NO. 5995 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING THE NEGATIVE DECLARATION FOR ORDINANCE NO. 1000, WHICH AMENDS THE COMPREHENSIVE ZONING ORDINANCE WHEREAS, a pUblic hearing has been held for the 1000, "An Ordinance of the City Council of the City of Vernon Amending, Correcting, and Changing Various Sections of the Comprehensive Zoning Ordinance of the City of Vernon"; and WHEREAS, Section 2, section 3, and part of section 4 of said Ordinance No. 1000 will amend the Vernon City Code in order to allow applications for a "recycled materials processing facility" subject to a conditional use permit in the General Industry (M) Zone, which amendments will enable the City of 14 Vernon to meet the State-mandated "source reduction and 15 recycling element" approved by the California Public Resources 16 Code Section 41375 and which amendments will have no substantial 17 adverse impact on the environment, but instead will benefit the 18 environment by enhancing the use of recycled materials; and 19 WHEREAS, part of Section 4, and Section 7 of said 20 Ordinance No. 1000 will amend the Comprehensive Zoning Ordinance 21 to correct typographical errors and will have no adverse impact 22 on the environment; and 23 WHEREAS, Section 5, Section 6, Section 8, and Section 9 24 of said Ordinance No. 1000 contain amendments which clarify the 25 original intent of the City Council in adopting the 26 Comprehensive Zoning Ordinance and have no adverse impact on the 27 environment; and 28 ~ 1 WHEREAS, a copy of the negati ve declaration for said 2 Ordinance No. 1000 has been submitted to the City council 3 concurrently with this resolution and no public comments have 4 been received during the public review process. 5 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF 6 THE CITY OF VERNON AS FOLLOWS: 7 SECTION 1: The City council of the City of Vernon 8 hereby finds and determines that the recitals contained 9 hereinabove are true and correct. 10 SECTION 2: The City Council of the city of Vernon 11 hereby finds that there is no substantial evidence that the 12 amendments to the Comprehensive Zoning Ordinance contained in 13 Ordinance No. 1000 will have a significant effect on the 14 environment. 15 SECTION 3: The City Council of the city of Vernon 16 hereby approves the negative declaration for Ordinance No. 1000 17 and directs the City Clerk to file a notice of determination in 18 regard to the environmental impact of said Ordinance. 19 SECTION 4: The City Clerk of the city of Vernon shall 20 certify to the passage of this resolution and thereupon and 21 thereafter the same shall be in full force and effect. 22 APPROVED AND ADOPTED this 1st day of October, 1991. 23 24 25 26 27 28 A6 BRUCE V. ~~' -2- (... . CALIFORNIA ENVIRONMENTAL QUALITY ACT PROPOSED NEGATIVE DECLARATION LEAD AGENCY: City of Vernon PROJECT TITLE: Zoning Ordinance Amendment PROJECT LOCATION: city of Vernon, CA 90058 PROJECT DESCRIPTION: The City of Vernon proposes certain amendments to the ci ty of Vernon Comprehensive Zoning Ordinance. These amendments are proposed to clarify the regulations governing recycling facilities and to correct typographical errors resulting from the comprehensive zoning ordinance amendment accomplisheQ in 1989 (Ordinance No. 982). Specifically, these amendments involve the following changes: Revising the definition of "junk or salvage yard" (Sec. 26.2.9) to eliminate references to conversion or other processing of materials. Adding a definition of "recycled materials processing facility" (Sec. 26.2.14) . Correcting the cross reference in Sec. 26.3.5-2(b) to read Sec. 26.4.5-8. Adding "recycled materials processing facility" as a conditionally permitted use in the General Industry (M) zone (Sec. 26.3.5-3) . Adding the word "size" to Sec. 26.4.6-4 to correct a typographical error. .: ,.,,. ..J PROPOSED NEGATIVE DECLARATION FINDING: Page 2 Adding language to Sec. 26.5.2-7 to clarify that a time extension request for a conditional use permit must be applied for prior to expiration of the authorization. Correcting a typographical error and clarifying the standard conditions for a conditional use permit for a hazardous waste treatment facility and junk or salvage yard. (Sec. 26.5.2-9) . Inserting provisions for continuance of existing uses which under current conditions would require a conditional use permit. These provisions were inadvertently deleted during the 1989 comprehensive zoning ordinance am~ndment (Sec. 26.5.2-11). Repealing Chapter 24 of the Vernon City Code relating to "trailer camps" since the zoning ordinance does not permit such uses. This project involves only the adoption of the zoning ordinance amendments cited above. No specific development projects are being contemplated or considered. Based on the analysis contained in the Initial Study, the city finds that the proposed project will not result in any potentially significant, adverse environmental effects.
