RESOLUTION NO. 5999
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON GRANTING A CONDITIONAL USE PERMIT TO
ODYSSEY TRANSPORTATION, INC. FOR THE OPERATION
OFA TRUCK TERMINAL AT 4280 BANDINI BOULEVARD
WHEREAS, Odyssey Transportation, Inc. has applied
for a conditional use permit to operate a truck terminal at
4280 Bandini Boulevard; and
WHEREAS, the City Council of the City of Vernon
held a hearing on said application for a conditional use
permit on October 22, 1991; and
WHEREAS, the proposed site is a conforming use in
the Heavy Industry (M2) Zone which has been continuously
used as a truck and freight terminal, but which requires a
conditional use permit under the Zoning Ordinance in order
to continue the use; and
WHEREAS, the proposed site is adequate in size,
shape and topography for the proposed operation, and a
masonry wall or landscaping will be installed where parking
areas adjoin a pUblic street pursuant to the Vernon City
Code; and
WHEREAS, the proposed site is surrounded by
industrial uses compatible with the proposed use and no
adverse effect from traffic, parking, noise, odors, dust,
smoke, light or glare, or risk of fire, infection, explosion
or effects on wildlife resources are anticipated from the
proposed operation; and
WHEREAS, the site has access to Bandini Boulevard,
and in general traffic will travel from the site, east on

1 Bandini Boulevard to the Long Beach Freeway. Bandini
2 Boulevard is located in the City of Vernon and is of
3 adequate width and pavement type to handle the traffic
4 generated from the proposed operations; and
5 WHEREAS, the site is required to have adequate
6 offstreet parking and loading facilities in accordance with
7 the Vernon City Code; and
8 WHEREAS, the conditions imposed on the conditional
9 use permit will adequately protect the public health, safety
10 and general welfare and the operation is consistent with all
11 applicable rules and laws of the City of Vernon; and
12 WHEREAS, the proposed use as to location,
13 operation, and design is consistent with the General Plan
14 and the Zoning Ordinance of the City of Vernon.
15 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
16 OF THE CITY OF VERNON AS FOLLOWS:
17 SECTtON 1: The City Council of the City of Vernon
18 hereby finds and determines that the recitals contained
19 hereinabove are true and correct.
20 SECTION 2: The conditional use permit is granted
21 to Odyssey Transportation, Inc. for the operation of a truck
22 terminal at 4280 Bandini Boulevard.
23 SECTION 3: In order to adequately protect the
24 pUblic health, safety and general welfare the following
25 conditions are imposed:
26 a. The facility shall be operated in accordance
27 with and made to conform with all current codes, rules,
28 regulations and subject to permit fees as adopted by the

1 city of Vernon. Prior to occupancy a business license and
2 occupancy permit shall be obtained. All trucking
3 operations, including truck and trailer parking, shall be
4 limited to the lot located at 4280 Bandini Boulevard.
5 b. Any hazardous substances used, handled or
6 stored shall have prior approval from the Vernon Fire and
7 Heal th Departments.
8 c. The number of employee parking spaces required
9 per Vernon City Code shall be provided and maintained.
10 d. All parking and loading facilities shall be
11 paved with a hard durable surface material and shall be
12 adequately drained, and kept free of dust, mud, trash or
13 weeds.
14 e. Where parking areas adjoin a public street or
15 streets, a masonry wall not less than 30 inches in height or
16 landscaped area a minimum of 4 feet in width, measured from
17 the property line, shall be established along such frontage,
18 except at driveways, walkways or where. other openings are
19 necessary.
20 f. Servicing of vehicles including washing, steam
21 cleaning and repairing shall be performed in facilities in
22 compliance with appropriate codes.
23 g. The underground storage tank monitoring system
24 shall be checked by a qualified service person. The
25 monitoring system must meet requirements of Vernon City
26 Ordinance No. 944.
27 h. No hazardous wastes shall be brought onto the
28 site.

1 i. Odyssey Transportation, Inc. shall file a
2 Notice of Intent with the state Water Quality Control Board
3 within the board's time limits and prepare proper prevention
4 and monitoring plans for all possible storm water
5 contamination.
6 j. No hazardous waste generated on the site shall
7 be kept on site for more than 90 days.
8 k. Only Odyssey Transportation, Inc.'s tankers
9 shall be cleaned, washed or repaired on this site unless
10 otherwise permitted by the City.
11 I. Any full trucks arriving at the site
12 containing hazardous materials shall be stored in a bermed
13 area.
14 m. Odyssey Transportation, Inc. shall have a
15 hazardous materials inventory plan, contingency plan and
16 training plan approved by the Vernon Health Department prior
17 to occupying the site.
18 n. Broken or cracked sidewalk, curb, gutter or
19 driveway in Bandini Boulevard adjacent to the site shall be
20 repaired as directed by the Director of Community Services.
21 All curb drains serving this site shall be reconstructed at
22 the property lines as instructed by the City. A handicap
23 curb ramp shall be constructed at the crosswalk at the
24 southeast corner of Bandini Boulevard and Bonnie Beach
25 Place. Guard posts shall be constructed at the ends of all
26 dr i veways.
27 o. Odyssey Transportation, Inc. shall obtain all
28 required State and Regulatory Agency permits prior to

occupancy.
p. The owner of the property shall take soil
samples at all underground tank locations, fuel pump
dispensers, interceptors and any other locations deemedc
necessary by the Vernon Health Department. The soil shall
be tested for any possible contaminants. All contaminated
soil on the site shall be remediated as required by the
Vernon Health Department.
SECTION 4: The city Clerk of the City of Vernon
shall certify to the passage of this resolution and
thereupon and thereafter the same shall be in full force and
effect.
