Resolution No. 6014 1 RESOLUTION NO. 6014 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON SUPERSEDING RESOLUTION NO. 5683 AND 3 ESTABLISHING THE RATES FOR BUSINESS LICENSE TAXES AND RELATED FEES AND DEPOSITS PURSUANT TO 4 CHAPTER 15 OF THE VERNON CITY CODE. 5 WHEREAS, the City Council of the City of Vernon adopted 6 Ordinance No. 931 on November 2, 1982, which provided that 7 business license fees shall be set by resolution; and 8 WHEREAS, the City Council of the City of Vernon adopted 9 Ordinance No. 1003 on November 13, 1991, which provided for 10 additional business license fees to be set by resolution; and 11 WHEREAS, said ordinances have been incorporated in 12 Chapter 15 of the Code of the city of Vernon; and 13 WHEREAS, the City Council has established business 14 license fees pursuant to Resolution No. 4956, adopted on 15 December 2, 1982, as amended by Resolution No. 5072, (December 16 20, 1983); Resolution No. 538.1 (April 28, 198.7), and Resolution 17 No. 5683 (October 17, 198.9); and 18 WHEREAS, the cost of living and general prices have 19 increased due to inflation; and 20 WHEREAS, the fees established herein reflect the 21 previous fees adjusted for the rate of inflation occurring 22 during the intervening time period and the new fees established 23 by Ordinance No. 1003. 24 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF 25 THE CITY OF VERNON AS FOLLOWS: 26 SECTION 1: That the City Council of the City of Vernon 27 hereby finds and determines that the recitals contained 28 hereinabove are true and correct. : . 1 SECTION 2: Business License Fees (V.C.C. Sec. 15.18). 2 3 Every person doing business or engaged in any business, profession, trade or occupation, or performing any act, or otherwise dealing in or with goods, wares or merchandise, and 4 5 not elsewhere specifically licensed by other provisions of 6 7 Chapter 15 of the Vernon City Code, shall pay a license fee for each calendar year or portion thereof for the privilege of doing business in the City of Ve~non as follows: 8 9 ANNUAL FEE ,c ,to.. Sec. 15.28). 17 Every person conducting a central station protecti ve 18 signaling system shall pay the following fees: 19 (a) The applicant shall pay a minimum license fee of 20 $315.00 per year at the time of application for or renewal of 21 the license; 22 (b) The licensee shall pay to the city of Vernon two 23 percent (2%) of the gross receipts of business arising from 24 licensee's operations conducted in the City of Vernon, less the 25 minimum previously paid. 26 SECTION 4: Persons without a Fixed Place of Business 27 (V.C.C. Sec. 15.29). 28 -3- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 (a) Every person, firm or corporation engaged in or carrying on the business of an auctioneer for the sale at auction of any real or personal property shall pay a fee of $100.00 each day unless exempted by state law; (b) Every person, firm, or corporation engaging in the business of commercial still photography shall pay a fee of $50.00 each day; (c) Every person, firm, or corporation providing taxicab service in the city other than from a taxicab stand, as such terms are defined in Chapter 23 of the Code, shall pay a fee of $150.00 each year; (d) Every person, firm, or corporation providing vehicle towing services in the city shall pay a fee of $150.00 each year. SECTION 5: License Fees for Peddlers (V.C.C. Sec. 15.30). (a) Every peddler shall pay a minimum fee of $l8.5.00 per year, or portion thereof; (b) Every peddler who calls attention to his wares, or advertises the same by use of music, entertainment, speech, fancy or grotesque dress, or otherwise, upon any public street, alley or other public place, doorway of any room or building, unenclosed or vacant lot or parcel of land within the City of Vernon, shall pay $525.00 per year, or any portion thereof; (c) Every catering vehicle engaged in the preparation and sale of hot food and drink items from said vehicle shall pay a fee of $190.00 per year; -4- 1 (d) Every catering vehicle engaged in the preparation 2 and sale of cold food and drink items only from said vehicle, 3 shall pay a fee of $150.00 per year; 4 (e) Catering vehicles not otherwise licensed, 5 operating in the City of Vernon to serve an auction or other 6 special event, shall pay a fee of $40.00 per day for each day or 7 portion thereof for said operation. 8 , F." SECTION 6: Motion Picture Production (V.C.C. SECTION 7: Selling Fruits and Vegetables (V.C.C. Sec. 15 Every person selling fruits and vegetables from a 16 vehicle shall pay a fee of $160.00 per year, or portion thereof. 17 SECTION 8: Dealers in Junk, Metal, Rags, Paper, Etc. 18 (V.C.C. Sec. 15.33) 19 (a) Every person carrying on the business commonly 20 known as junk or scrap metal dealer shall pay a fee of $1,200.00 21 per year; 22 (b) A secondhand rag or paper dealer shall pay a fee 23 of $790.00 per year; 24 (c) A secondhand pipe dealer shall pay the sum of 25 $1,200.00 per year. 26 SECTION 9: Business License Fee For Warehousing 27 (V. C. C. Sec. 15.34) 28 -5- " 1 (a) The minimum warehousing license fee shall be 2 $l5,O.,O,O per year and the maximum warehousing fee shall be 3 $1,6,0,0.,0,0 per year; 4 (b) For every person engaged. in or carrying on the 5 business of warehousing in the city of Vernon, the fee per unit 6 shall be as follows: 7 ANNUAL FEE 8 First 2,0,0 sq. ft. $ 25.,0,0 9 10 AIL ofoot'aqe .ov,er 2'oO~ sq..__ft. ,o(~ ,03 persl:!#, ft.c, in addition to the $25.,0,0 11 12 (c) Each additional offsite warehousing facility which 13 a business may have in the City of Vernon shall have a business 14 license and shall pay the square footage business license fee; 15 (d) If the warehousing facility is 4,367 square feet 16 or less, then the minimum rate applies; 17 (e) Every person engaged in or carrying on the 18 business of warehousing in conjunction with a manufacturing 19 business and where said business has 1,0,0 employees or more at 20 the same location, the business license fee will be based on the 21 number of employees, and the warehousing activity at the same 22 location is exempt from the square footage fee. 23 SECTION 1,0: Shows, Circuses, Rodeos and Other 24 Amusements (V.C.C. Sec. 15.35). 25 Every person engaged in the business of conducting a 26 show, circus, rodeo, or other type of amusement shall pay the 27 following fees: 28 -6- .. .' (a) $150.00 per day for such show, circus, rodeo, or other type of amusement; and (b) $100.00 per day for each sideshow for which an admission fee is charged, and which is operated as a side attraction to a show, circus, rodeo, or other type of amusement licensed under subparagraph (a) above. SECTION 11: Permit for Moving structures (V.C.C. Sec. 15.44). 15 The applicant for a used car or automobile dealership 16 shall file with the City Clerk along with the application, a 17 bond for $5,000.00 executed on behalf of the city of Vernon by a 18 duly authorized surety corporation subject to approval by the 19 City Attorney. 20 SECTION 13: Junk, Secondhand Metal, Rags, Paper, or 21 Secondhand Steel, Pipe and Fittings Dealers' Bond (V.C.C. Sec. 22 15.45). 23 24 25 26 27 28 The applicant for a junk, secondhand metal, rags, paper, or secondhand steel, pipe and fittings dealership shall file with the City Clerk along with the application, a bond for $5,000.00 executed on behalf of the city of Vernon by a duly authorized surety corporation subject to approval by the City -7- " -8- 1 .' We have always appreciated the understanding you and your officials have for business. Were sure you will agree with the following matter. On January 13 we decided to move to another Vernon Address instead of a Los Angeles Address. We didn't renew our Business licence until we were sure we were staying in Vernon, which I'm sure you'll agree was practical. We now are paying for the ! 992 licence and are being told that we have to pay a transfer charge of $50.001 Irm sure the intent of the law was to charge the fee if a business moves during the term of a business license and We understand this. Were sure The City of Vernon wouldn't want to penalize a company that decided to stay in the City rather than leave. It is not possible that you would charge a new business less than an old resident if they both were applying at the same time. Were sure you'll not charge us for this fee. Thankyou.
