A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON GRANTING A CONDITIONAL USE PERMIT
TO UNITED PARCEL SERVICE FOR THE OPERATION OF
A TRUCK TERMINAL AT 3768 26TH STREET
WHEREAS, United Parcel Service has applied for a
26th Street; and
WHEREAS, the City Council of the city of Vernon
held a hearing on ~aid application for a conditional use
permit on December 3, 1991; and
11 WHEREAS, the proposed site is a conforming us;e in
12 the Heavy Industry (M2) Zone which has; been continuously
13 used as a truck terminal, but which requires a conditional
14 use permit under the Zoning Ordinance in order to continue
15 the use; and
16 WHEREAS, the proposed s;ite is adequate in size,
17 shape and topography for the propos;ed operation, has
18 adequate drainage, and a masonry wall or landscapin~ will be
19 installed where parking areas adjoin a public street
20 pursuant to the Vernon City Code; and
21 WHEREAS, the proposed site is; surrounded by
22 industrial uses compatible with the proposed use and no
23 adverse effect from traffic, parking, noise, odors, dust,
24 smoke, light or glare, or risk of fire, infection or
25 explosion is anticipated from the proposed operation; and
26 WHEREAS, the site has access to 26th Street a.nd
27 Bandini Boulevard, and in general traffic will travel from
28 the site west on 26th Street to their main facility.. on

1 Downey Road. 26th street and Bandini Boulevard are located
2 in the city of Vernon and are of adequate width and pavement
3 type to handle the traffic generated from the proposed
4 operations; and
5 WHEREAS, the site is required to have adequate
6 offstreet parking and loading facilities in accordance with
7 the Vernon City Code; and
8 WHEREAS, the conditions imposed on the conditional
9 use permit will adequately protect the public health, safety
10 and general welfare and the operation is consistent with all
11 applicable rules and laws of the city of Vernon; and
12 WHEREAS, the proposed use as to location,
13 operation, and design is consistent with the General Plan
14 and the Zoning Ordinance of the City of Vernon.
15 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
16 OF THE CITY OF VERNON AS FOLLOWS:
17 SECTION 1: The City Council of the City of Vernon
18 hereby finds and determines that the recitals contained
19 hereinabove are true and correct.
20 SECTION 2: The conditional use permit is granted
21 to United Parcel Service, Inc. for the operation of a truck
22 terminal at 3768 26th Street.
23 SECTION 3: In order to adequately protect the
24 public health, safety and general welfare the following
25 conditions are imposed:
26 a. The facility shall be operated in accordance
27 with the appropriate codes, rules, regulations and subject
28 to permit fees as adopted by the City of Vernon. The

1 facility shall be operated in a manner that will prevent
2 unsanitary conditions, odors or other nuisances. Prior to
3 occupancy a business license and occupancy permit shall be
4 obtained. All trucking operations, including truck and
5 trailer parking, shall be limited to the lot located at 3768
6 26th street and united Parcel Services main terminal located
7 at 3333 Downey Road.
8 b. Any hazardous substances used, handled or
9 stored shall have prior approval from the Vernon Fire and
10 Health Departments. A Health Permit shall be obtained if
11 there are reportable quantities of hazardous materials on
12 the site.
13 c. The number of employee parking spaces req~ired
14 per Vernon City Code shall be provided and maintained.
15 d. All parking and loading facilities shall be
16 paved with a hard durable surface material and shall be
17 adequately drained, and kept free of dust, mud, trash or
18 weeds.

e. Where parking areasadjoin.a public street or
streets, a masonry wall not less than 30 inches in height,
or landscaped area a minimum of 4 feet in width, measured
from the property line, shall be established along such
frontage, except at driveways, walkways or where other
openings are necessary. If a masonry wall is constructed it
shall be protected by either steel or concrete barriers.
f. Servicing of vehicles including washing, steam
cleaning and repairing shall be performed in facilities in
compliance with appropriate codes.

1 g. In accordance with National pollutant
2 Discharge Elimination System permit regulations, united
3 Parcel Service shall submit a Notice of Intent to the State
4 Water Resources Control Board and shall prepare a prevention
5 plan and monitoring program within the Board I s time
6 limitations
7 h. No equipment or freight shall be stored on the
8 site, other than in trailers. Adequate plans and materials
9 must be available for handling leaks or spills from vehicles
10 during storage or transportation.
11 i. United Parcel Service shall provide toilet,
12 handwashing and drinking water facilities for their
13 employees at the site.
14 j. The owner of the property shall construct
15 approximately 710 feet of 12" class 52 cement lined ductile
16 iron water main in Bandini Boulevard from approximately
17 1,850 feet east of the centerline of Downey Road to the
18 southerly extension of the most easterly property line of
19 the subject site. The owner shall construct standard city
20 of Vernon Fire Hydrants in the north sidewalk of Bandini
21 Boulevard at approximately 250 foot intervals. The owner of
22 the property shall deposit a performance bond in the amount
23 of Sixty-seven Thousand Five Hundred Dollars ($67,500.00)
24 for said construction with the City of Vernon. Construction
25 shall be completed within six (6) months of the approval
26 date of the conditional use permit.
27 k. United Parcel Service shall change out the
28 Matthews Fire Hydrant located on 26th Street adjacent to

1 their site with the new City of Vernon Standard. The Fire
2 Department connection on 26th Street shall be made to face
3 the public street. united Parcel Service shall also
4 complete all frontage improvements as directed by the
5 Director of Community Services, including but not limited to
6 repairing cracked and displaced sidewalk and removing unused
7 driveways.
8 1. United Parcel Service shall use only the 26th
9 Street driveway for ingress and egress access to the subject
10 property. All driveways on Bandini Boulevard, except for
11 one, shall be sealed up. The one remaining driveway on
12 Bandini Boulevard shall be used for emergency access only.
13 SECTION 4: The City Clerk of the City of Vernon
14 shall certify to the passage of this resolution and
15 thereupon and thereafter the same shall be in full force and
