Resolution No. 6044 1 RESOLUTION NO. 6044 2 3 4 5 6 conditional US$ permit to operate a truck and freight 7 8 9 10 11 12 13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A CONDITIONAL USE PERMIT TO VANA ENTERPRISES, INC. FOR THE OPERATION OF A TRUCK AND FREIGHT TERMINAL AT 4415 BANDINI BOULEVARD WHEREAS, Vana Enterprises, Inc. has applied for a terminal at 4415 Bandini Boulevard; and WHEREAS, the City Council of the City of Vernon held a hearing on said application for a conditional use permit on February 4, 1992; and WHEREAS, the proposed site is a conforming use in the Heavy Industry (M2) Zone which has been continuously used as a truck and freight terminal, but which ~equires a 14 conditional use permit under the zoning Ordinance in order 15 to continue the use; and 16 WHEREAS, the proposed site is adequate in size, 17 shape and topography for the proposed operation, has 18 adequate drainage, and a masonry wall or landscaping will be 19 installed where parking areas adjoin a public street 20 pursuant to the Vernon City Code; and 21 WHEREAS, the proposed site is surrounded by 22 industrial uses compatible with the proposed use and no 23 adverse effect from traffic, parking, noise, odors, dust, 24 smoke, light or glare, or risk of fire, infection or 25 explosion is anticipated from the proposed operation; and 26 WHEREAS, the site has access to Bandini Boulevard 27 and in general traffic will travel from the site east to the 28 Long Beach Freeway. Bandini Boulevard is located in the 1 1 City of Vernon and is of adequate width and pavement type to 2 handle the traffic generated from the proposed operations; 3 and 4 WHEREAS, the site is required to have adequate 5 offstreet parking and loading facilities in accordance with 6 the Vernon City Code; and 7 WHEREAS, the conditions imposed on the conditional 8 use permit will adequately protect the public health, safety 9 and general welfare and the operation is consistent with all 10 applicable rules and laws of the City of Vernon; and 11 WHEREAS, the proposed use as to location, 12 operation, and design is consistent with the General Plan 13 and the Zoning Ordinance of the City of Vernon. 14 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL 15 OF THE CITY OF VERNON AS FOLLOWS: 16 SECTION 1: The City Council of the City of Vernon 17 hereby finds and determines that the recitals contained 18 hereinabove are true and correct. 19 SECTION 2: The conditional use permit is granted 20 to Vana Enterprises, Inc. for the operation of a truck and 21 freight terminal at 4415 Bandini Boulevard. 22 SECTION 3: In order to adequately protect the 23 public health, safety and general welfare the following 24 conditions are imposed: 25 a. .The facility shall be operated in accordance 26 with the appropriate codes, rules, regulations and subject 27 to permit fees as adopted by the City of Vernon. The 28 facility shall be operated in a manner that will prevent 2 1 unsanitary conditions, odors or other nuisances. Prior to 2 occupancy a business license and occupancy permit shall be 3 obtained. All trucking operations, including truck and 4 trailer parking, shall be limited to the lot located at 4415 5 Bandini Boulevard. 6 b. Any hazardous substances used, handled or 7 stored shall have prior approval from the Vernon Fire and 8 Health Departments. A Health Permit shall be obtained if 9 there are reportable quantities of hazardous materials on 10 the site. 11 c. The number of employee parking spaces required 12 per Vernon City Code shall be provided and maintained. 13 d. All parking and loading facilities shall be 14 paved with a hard durable surface material and shall be 15 adequately drained, and kept free of dust, mud, trash or 16 weeds. 17 e. Where parking areas adjoin a public street or 18 streets, a masonry wall not less than 30 inches in height, 19 or landscaped area a minimum of 4 feet in width, measured 20 from the property line, shall be established along such 21 frontage, except at driveways, walkways or where other 22 openings are necessary. 23 f. Servicing of vehicles including washing, steam 24 cleaning and repairing shall be performed in facilities in 25 compliance with appropriate codes. 26 g. In accordance with National pollutant 27 Discharge Elimination System permit regulations, Vana 28 Enterprises, Inc. shall submit a Notice of Intent to the 3 1 state Water Resources Control Board and shall prepare a 2 prevention plan and monitoring program within the Board's 3 time limitations 4 h. No equipment or freight shall be stored on the 5 site, other than in trailers or on the docks. Adequate 6 plans and materials must be available for handling leaks or 7 spills from vehicles during storage or transportation. 8 i. Underground storage tank monitoring systems 9 shall be checked by a qualified service person. Monitoring 10 system must meet the requirements of City Ordinance No. 944. 11 j. Broken or cracked sidewalk, curb, gutter or 12 driveway in Bandini Boulevard adjacent to the site shall be 13 repaired as directed by the Director of Community Services. 14 SECTION 4: The City Clerk of the City of Vernon 15 shall certify to the passage of this resolution and 16 thereupon and thereafter the same shall be in full force and 17 effect. 18 APPROVED AND ADOPTED this 4th day of February, 19 1992. 20 ~. ~ A~ t/~"#'~ 23 BRUCE V.
