A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON AMENDING RESOLUTION NO.
6014 TO DELETE BUSINESS LICENSE TRANSFER
FEES, TO DEFINE WAREHOUSES, AND TO REDUCE
BUSINESS LICENSE FEES FOR OFFSITE
WAREHOUSES

WHEREAS, City Council Resolution No. 6014 adopted on

November 19, 1991, established business license fees for
8
businesses in the City of Vernon pursuant to the provisions of
9
the Vernon City Code; and
WHEREAS, in accordance with Vernon City Code section
15.9, a $50.00 transfer fee was imposed in order to cover the
cost of changing business license records whenever a business
relocates in the City of Vernon; and
WHEREAS, the city of Vernon is seeking to attract
businesses to the City and to encourage businesses which
relocate to remain within the City and the transfer fee may
discourage such relocations; and
WHEREAS, the city Clerk for the City of Vernon has
traditionally treated distribution and wholesale businesses as
warehousing facilities and not as manufacturing businesses and
has imposed fees in accordance therewith, and a ratification of
that policy is needed; and
WHEREAS, by Ordinance No. 1003 of the City of Vernon
adopted on November 19, 1991, Vernon city Code section 15.13 was
amended to provide that offsite warehouses were deemed to be a
separate place of business or branch establishment, and were
required to have a separate business license; and

WHEREAS, City Council Resolution No. 6014 imposed the
same fees on offsite warehouses operated in conjunction with a
businesss or industry as on warehouses which are operated
independently; and
WHEREAS, the businesses and industries which operate
offsite warehouses are paying additional business license fees
in the city of Vernon, and it is reasonable to impose reduced
fees on the offsite warehouses operated in conjunction
therewith.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained
hereinabove are true and correct.
SECTION 2: The City Council of the City of Vernon
hereby amends Section 15 of Resolution No. 6014 to read as
follows:
SECTION 15: Transfer Fees (V.C.C. Sec. 15.9).
When a business relocates within the city of Vernon,
there shall be no transfer fee.
SECTION 3: The City Council of the city of Vernon
hereby amends section 9 of Resolution No. 6014 to read as
follows:
SECTION 9: Business License Fees For Warehousing
(V.C.C. Sec. 15.34)
(a) The minimum warehousing license fee shall be
$150.00 per year and the maximum warehousing fee shall

be $1,600.00 per year.
Warehousing shall include

distributing and wholesale businesses which are not
3
conducted in conjunction with a manufacturing business;

(b)
For every person engaged in or carrying on the
5
business of warehousing in the City of Vernon, the fee
6
per unit shall be as follows:

in addition to

(c) Each additional offsite warehousing facility which

a business may have in the City of Vernon shall have a

business license and the fee per unit shall be as

follows:

(d)
If the warehousing facility is 4,367 square feet

or less, then the minimum rate applies;

(e)
Every person engaged in or carrying on the

business of warehousing in conjunction with a
24
manufacturing business and where said business has 100
25
employees or more at the same location, the business
26
license fee will be based on the number of employees,

and the warehousing acti vi ty at the same location is

exempt from the square footage fee.

SECTION 4: The City Clerk of the City of Vernon shall
4 certify to the passage of this resolution and thereupon and
5 thereafter the same shall be in full force and effect.

Honorable Members:
Upon review of Resolution No. 6014 pertaining to Business License fees,
it is necessary to make changes for clarification purposes. These
changes would specifically be to Sections 9 and 15 of said resolution.
Section 9 would include Distributors and Wholesalers which were
inadvertently omitted, and Section 15 pertains to Transfer Fees. It
is hereby recommended that Resolution No. 6014 be amended and the
following resolution be adopted.
