RESOLUTION NO. 6050
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON GRANTING A CONDITIONAL USE PERMIT TO
ATCHISON, TOPEKA AND SANTA FE RAILWAY COMPANY
FOR THE OPERATION OF A TRUCK TERMINAL AT 3961
WASHINGTON BOULEVARD
6 WHEREAS,. AtChison, Topeka and Santa Fe Railway
7 Company (hereinafter "applicant") has applied for a
8 conditional use permit to operate a truck terminal at 3961
9 Washington Boulevard; and
10 WHEREAS, the City Council of the City of Vernon
11 held a hearing on said application for a conditional use
12 permit on March 3, 1992; and
13 WHEREAS, the proposed site is a conforming use in
14 the Heavy Industry (M2) Zone which requires a conditional
15 use permit under the Zoning Ordinance; and
16 WHEREAS, the proposed site is adequate in size,
17 shape and topography for the proposed operation, and a
18 masonry wall or landscaping will be installed where parking
19 areas adjoin a public street pursuant to the Vernon City
20 Code; and
21 WHEREAS, the proposed site is surrounded by
22 industrial uses compatible with the proposed use and no
23 adverse effect from traffic, parking, noise, odors, dust,
24 smoke, light or glare, or risk of fire, infection, explosion
25 or effects on wildlife resources are anticipated from the
26 proposed operation; and
27 WHEREAS, the site has access to Washington
28 Boulevard, and in general applicant's trucks traffic will

1 travel from the site, east on Washington Boulevard thence
2 south on Indiana street, thence east on Sheila street to the
3 entrance to applicant's intermodal facility. The majority
4 of the streets that will be traveled along this route are
5 located in the City of Commerce and appear to have adequate
6 width and pavement type to handle the traffic generated from
7 the proposed operations; and
8 WHEREAS, the site is required to have adequate
9 offstreet parking and loading facilities in accordance with
10 the Vernon City Code; and
11 WHEREAS, the Community Services Department has
12 performed an Initial Study to determine the potential
13 adverse impacts to the environment that the proposed project
14 may cause and has determined that the proposed project will
15 not have a significant effect on the environment in this
16 case because of mitigating measures. Said mitigating
17 measures are expressed as conditions on the proposed
18 conditional use permit. The Director of community Services
19 has recommended that a Negative Declaration be adopted in
20 compliance with the California Environmental Quality Act;
21 and
22 WHEREAS, the conditions imposed on the conditional
23 use permit will adequately protect the public health, safety
24 and general welfare and the operation is consistent with all
25 applicable rules and laws of the City of Vernon; and
26 WHEREAS, the proposed use as to location,
27 operation, and design is consistent with the General Plan
28 and the Zoning Ordinance of the City of Vernon.

1 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
2 OF THE CITY OF VERNON AS FOLLOWS:
3 SECTION 1: The City Council of the City of Vernon
4 hereby finds and determines that the recitals contained
5 hereinabove are true and correct.
6 SECTION 2: The City Council hereby approves and
7 adopts the Negative Declaration for the project and hereby
8 finds that the project will not individually or cumulatively
9 have an adverse effect on the environment including the
10 wildlife resources.
11 SECTION 3: In order to adequately protect the
12 pUblic health, safety and general welfare, the following
13 conditions are imposed:
14 a. The facility shall be operated in accordance
15 with, and made to conform with all current codes, rules,
16 regulations and subject to permit fees as adopted by the
17 City of Vernon. prior to occupancy a business license and
18 occupancy permit shall be obtained.
19 b. Atchison, Topeka and Santa Fe Railway Company
20 shall not handle or store hazardous materials at 3961
21 Washington Boulevard without the approval of the Vernon Fire
22 and Health Departments.
23 c. The facility shall be limited to the parking
24 and movement of empty trailers. No tractors or fully or
25 partially loaded trailers shall be stored at the site. Any
26 use necessitating employees or personnel to remain at the
27 facility without provisions for permanent sanitation
28 facilities including potable water and sewer facilities is

1 prohibited.
2 d. All parking area shall be paved with a hard
3 durable surface material and shall be adequately drained,
4 and kept free of dust, mud, trash or weeds.
5 e. Where parking areas adjoin a public street or
6 streets, a masonry wall not less than 30 inches in height,
7 or landscaped area a minimum of 4 feet in width, measured
8 from the property line, shall be established along such
9 frontage, except at driveways, walkways or where other
10 openings are necessary. If a masonry wall is constructed it
11 shall be protected by either steel or concrete barriers.
12 f. No servicing of vehicles including washing,
13 steam cleaning or repairing shall be performed at .this site.
14 g. In accordance with National Pollutant
15 Discharge Elimination System permit regulations, Atchison,
16 Topeka and Santa Fe Railway Company shall submit a Notice of
17 Intent to the state Water Resources Control Board and shall
18 prepare a prevention plan and monitoring program within the
19 Board's time limitations.
20 h. Atchison, Topeka and Santa Fe Railway Company
21 shall complete all frontage improvements as directed by the
22 Director of Community Services including, but not limited to
23 widening Washington Boulevard by three feet, installing
24 standard sidewalk in the widened area, replacing all broken
25 and displaced sidewalk and replacing unused driveways with
26 standard curb, gutter and sidewalk. Atchison, Topeka and
27 Santa Fe Railway Company shall provide the City with a Grant
28 Deed for the strip of land adjacent to the subject property

for a three foot widening of the street right-of-way.
SECTION 4: Subject to the conditions set forth
above, the conditional use permit is granted to Atchison,
Topeka and Santa Fe Railway Company for the operation of a
truck terminal at 3961 Washington Boulevard.
SECTION 5: The City Clerk of the City of Vernon
shall certify to the passage of this resolution and
thereupon and thereafter the same shall be in full force and
effect.
