RESOLUTION NO. 6055
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON DESIGNATING THE CITY OF
VERNON HEALTH DEPARTMENT AS THE LOCAL
ENFORCEMENT AGENCY FOR SOLID WASTE
FACILITIES, PURSUANT TO PUBLIC RESOURCES
CODE SECTIONS 43200 AND 43203
WHEREAS, the State of California Legislature has
enacted the California Integrated Waste Management Act of 1989,
which changed the focus of solid waste management and created
recycling goals for cities; and
WHEREAS, the Public Resources Code Section 41000 and
41500 mandate that each city prepare, adopt and implement both a
Source Reduction and Recycling Element and a Household Hazardous
Waste Element, which together identify how the city will divert
at least 25% of the present amount of solid waste from landfills
or incinerators by 1995, and 50% by the year 2000; and
WHEREAS, on January 7, 1992, the City of Vernon adopted
Resolution No. 6033, which approved and adopted the final draft
of the City of Vernon Source Reduction and Recycling Element and
Household Hazardous Waste Element; and
WHEREAS, the establishment of a materials recovery
facility (MRF) is one of the programs in the Source Reduction
and Recycling Element which would enable Vernon to maintain its
diversion rate and to continue to meet state-mandated goals of
reducing the waste stream; and
WHEREAS, the City of Vernon not only is ideally located
for a materials recovery facility, but also has appropriate
zoning and infrastructure to support such a facility, with most
industrial sites having rail access; and

WHEREAS, the City of Vernon, as a part of the recycling
component of the Source Reduction and Recycling Element,
actively supports private development of a materials recovery
facility within its jurisdiction; and
WHEREAS, Public Resources Code section 43203 empowers a
city Council to designate an enforcement agency to carry out
local enforcement activities involved in permitting, inspection
and enforcement of regulations controlling materials recovery
facilities.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The city Council of the city of Vernon
hereby finds and determines that the recitals contained
hereinabove are true and correct.
SECTION 2: The City council of the city of Vernon
hereby designates the city of Vernon Health Department as the
enforcement agency to carry out the provisions contained in
Public Resources Code sections 43000 to 44817.
SECTION 4: The city Clerk of the City of Vernon shall
certify to the passage of this resolution and thereupon and
thereafter the same shall be in full force and effect.

I, BRUCE V. MALKENHORST, City Clerk of the City of
Vernon, do hereby certify that the foregoing Resolution, being
Resolution No. 6055, was duly adopted by the City Council of the
City of Vernon at a regular meeting of the City Council duly
held on Tuesday, March 3, 1992, and thereafter was duly signed
by the Mayor of the City of Vernon.
