Resolution No. 6081 1 2 3 4 5 RESOLUTION NO. 6081 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A CONDITIONAL USE PERMIT TO TRANS WESTERN SYSTEMS, INC. FOR THE OPERATION OF A TRUCK AND FREIGHT TERMINAL AT 3240 BANDINI BOULEVARD 6 WHEREAS, Trans Western Systems, Inc. has applied 7 for a conditional use permit to operate a truck and freight 8 terminal at 3240 Bandini Boulevard; and 9 WHEREAS, the City Council of the City of Vernon 10 held a hearing on said application for a conditional use 11 permit on April 7, 1992; and 12 WHEREAS, the proposed site is a conforming use in 13 the Heavy Industry (M2) Zone which has been continuously 14 used as a truck and freight terminal, but which requires a 15 conditional use permit under the Zoning Ordinance in order 16 to continue the use; and 17 WHEREAS, the proposed site is adequate in size, 18 shape and topography for the proposed operation, has 19 adequate drainage, and a masonry wall or landscaping has 20 been installed where parking areas adjoin a public street 21 pursuant to the Vernon City Code; and 22 WHEREAS, the proposed site is surrounded by 23 industrial uses compatible with the proposed use and no 24 adverse effect from traffic, parking, noise, odors, dust, 25 smoke, light or glare, or risk of fire, infection or 26 explosion is anticipated from the proposed operation; and 27 WHEREAS, the site has access to Bandini Boulevard 28 and in general traffic will travel from the site east or 1 1 west to the freeway access, or to the railroad yards on 2 Washington Boulevard. The streets to be utilized are within 3 the City of Vernon and appear to be sufficient to handle the 4 traffic generated from the proposed operations; and 5 WHEREAS, the site is required to have adequate 6 offstreet parking and loading facilities in accordance with 7 the Vernon City Code; and 8 WHEREAS, the conditions imposed on the conditional 9 use permit will adequately protect the public health, safety 10 and general welfare and the operation is consistent with all 11 applicable rules and laws of the City of Vernon; and 12 WHEREAS, the proposed use as to location, 13 operation, and design is consistent with the General PIan 14 and the Zoning Ordinance of the City of Vernon; and 15 WHEREAS, the project was found to be categorically 16 exempt from the California Environmental Quality Act per 17 section 15301 of the California Environmental Quality Act 18 Guidelines and a Notice of Exemption shall be filed with the 19 County Clerk per Section 15062 of the California 20 Environmental Quality Act Guidelines. 21 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL 22 OF THE CITY OF VERNON AS FOLLOWS: 23 SECTION 1: The City Council of the City of Vernon 24 hereby finds and determines that the recitals contained 25 hereinabove are true and correct. 26 S~CTION 2: In order to adequately protect the 27 public health, safety and general welfare the fol1owing 28 conditions are imposed: 2 1 a. The facility shall be operated in accordance 2 with, and made to conform with all current codes, rules, 3 regulations and subject to permit fees as adopted by the 4 City of Vernon. The facility shall be operated in a manner 5 that will prevent unsanitary conditions, odors or other 6 nuisances. Prior to occupancy a business license and 7 occupancy permit shall be obtained. All trucking 8 operations, including truck and trailer parking, shall be 9 limited to the lot located at 3240 Bandini Boulevard. 10 b. Any hazardous substances used, handled or 11 stored shal1 have prior approval from the Vernon Fire and 12 Health Departments. A Health Permit shall be obtained if 13 there are reportable quantities of hazardous materials on 14 the site. 15 c. The number of employee parking spaces required 16 per Vernon City Code shall be provided and maintained. 17 d. All parking and loading facilities shall be 18 paved with a hard durable surface material and shall be 19 adequately drained, and kept free of dust, mud, trash or 20 weeds. 21 e. Servicing of vehicles including washing, steam 22 cleaning and repairing shall be performed in facilities in 23 compliance with appropriate codes. 24 f. In accordance with National Pollutant 25 Discharge Elimination System permit regulations, Trans 26 Western Systems, Inc. shall submit a Notice of Intent to the 27 state Water Resources Control Board and shall prepare a 28 prevention plan and monitoring program within the Board's 3 1 time limitations. 2 g. No equipment or freight shall be stored on the 3 site, other than in trailers or on the docks. Adequate 4 plans and materials must be available for handling leaks or 5 spills from vehicles during storage or transportation. 6 h. All cracked sidewalk shall be repaired. 7 Unused driveways shall be removed and replaced with curb, 8 gutter and sidewalk. Guard posts shall be constructed at 9 the ends of driveways. The main driveway entrance shal1 be 10 widened as directed by the Director of Community Services. 11 i. Where parking areas adjoin a public street or 12 streets, a masonry wall not less than 30 inches in height, 13 or landscaped area a minimum of 4 feet in width, measured 14 from the property lines shall be established along such 15 frontage, except at driveways, walkways or where other 16 openings are necessary. 17 SECTION 3: Subject to the conditions set forth 18 above, the conditional use permit is granted to Trans 19 Western systems, Inc. for the operation of a truck and 20 freight terminal at 3240 Bandini Boulevard. 21 22 23 24 25 26 III 27 III 28 III 4 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 4: The City Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in ful1 force and effect.
