Resolution No. 6089 1 2 3 4 5 RESOLUTION NO. 6089 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A CONDITIONAL USE PERMIT TO PRIMO CORPORATION, INC. FOR THE OPERATION OF A RECYCLED MATERIALS PROCESSING FACILITY AT 3301 FRUITLAND AVENUE 6 WHEREAS, Primo Corporation, Inc. has applied for a 7 conditional use permit to operate a recycled materials 8 processing facility at 3301 Fruitland Avenue. The company 9 proposes to recycle plastic scraps at this facility; and 10 WHEREAS, the City Council of the City of Vernon 11 held a hearing on said application for a conditional use 12 permit on April 27, 1992; and 13 WHEREAS, the proposed use is in conformance with 14 the General Industry (M) Zone, and requires a conditional 15 use permit under the Zoning Ordinance; and 16 WHEREAS, the proposed site is adequate in size, 17 shape and topography for the proposed operation, has 18 adequate drainage, and a masonry wall or landscaping will be 19 installed where parking areas adjoin a public street 20 pursuant to the Vernon City Code; and 21 WHEREAS, the proposed site is surrounded by 22 industrial uses compatible with the proposed use and no 23 adverse e!fect from traffic, parking, noise, odors, dust, 24 smoke~{~ght or glare, or ris){<of fire, infection or 25 explosion is anticipated from the proposed operation; and 26 WHEREAS, the site has access to Fruitland Avenue 27 and in general traffic will travel from the site to freeway 28 access. Fruitland Avenue is located in the City of Vernon 1 ~ 1 and is of adequate width and pavement type to handle the 2 traffic generated from the proposed operations; and 3 WHEREAS, the site is required to have adequate 4 offstreet parking and loading facilities in accordance with 5 the Vernon City Code; and 6 WHEREAS, the Community Services Department has 7 performed an Initial study to determine the potential 8 adverse impacts to the environment that the proposed project 9 may cause and has determined that the proposed project will 10 not have a significant effect on the environment. The 11 Director of Community Services has recommended that a 12 Negative Declaration be adopted in compliance with the 13 California Environmental Quality Act; and 14 WHEREAS, the conditions imposed on the conditional 15 use permit will adequately protect the public health, safety 16 and general welfare and the operation is consistent with all 17 applicable rules and laws of the City of Vernon; and 18 WHEREAS, the City of Vernon has adopted a source 19 reduction and recycling element pursuant to Public Resources 20 Code Section 41000 which provides for the diversion of solid 21 waste from landfills for the purposes of recycling; and 22 WHEREAS, the proposed use as to location, 23 operation, and design is consistent with the General Plan 24 and the Zoning Ordinance of the City of Vernon. 25 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL 26 OF THE CITY OF VERNON AS FOLLOWS: 27 SECTION 1: The City Council of the City of Vernon 28 hereby finds and determines that the recitals contained 2 1 hereinabove are true and correct. 2 SECTION 2: In order to adequately protect the 3 pUblic health, safety and general welfare the following 4 conditions are imposed: 5 a. The facility shall be operated in accordance 6 with the appropriate codes, rules, regulations and subject 7 to permit fees as adopted by the City of Vernon. The 8 facility shall be operated in a manner that will prevent 9 unsanitary conditions, odors or other nuisances. Prior to 10 occupancy a business license and occupancy permit shall be 11 obtained. 12 b. Any hazardous substances used, handled or 13 stored shall have prior approval from the Vernon Fire and 14 Health Departments. A Health Permit shall be obtained if 15 there are reportable quantities of hazardous materials on 16 the site. 17 c. The number of parking and loading spaces 18 required per Vernon City Code shall be provided and 19 maintained. 20 d. All parking and loading facilities shall be 21 paved with a hard durable surface material and shall be 22 adequately drained. 23 e. Where parking areas adjoin a public street or 24 streets, a masonry wall not less than 30 inches in height, 25 or landscaped area a minimum of 4 feet in width, measured 26 from the property line, shall be established along such 27 frontage, except at driveways, walkways or where other 28 openings are necessary. 3 1 f. Servicing of vehicles including washing, steam 2 cleaning and repairing shall be performed in facilities in 3 compliance with appropriate codes. 4 g. In accordance with National Pollutant 5 Discharge Elimination System permit regulations, Primo 6 Corporation, Inc. shall submit a Notice of Intent to the 7 state Water Resources Control Board and shall prepare a 8 prevention plan and monitoring program within the Board's 9 time limitations 10 h. All processing and recycling operations shall 11 take place within the existing buildings. No equipment or 12 materials shall be stored outside with the exception of 13 pallets or materials stored within tankers or trailers. 14 Adequate written plans and materials must be available for 15 cleaning up leaks or spills of plastic materials or other 16 substances associated with Primo corporation, Inc.'s 17 operation. 18 i. The three truck dock doors on the westerly 19 face of the subject facility whose loading spaces extend 20 into Alcoa Avenue shall be permanently sealed. 21 j. Broken or cracked sidewalk, curb, gutter or 22 driveway in Fruitland Avenue and Alcoa Avenue adjacent to 23 the site shall be repaired as directed by the Director of 24 Community Services. 25 k. The entire site shall have a neat and clean 26 appearance and shall be kept free of dust, mud, weeds and 27 trash. The site and surrounding areas shall be kept free of 28 all plastic materials associated with Primo's operation 4 1 including but not limited to raw materials, recycled 2 materials, finished product, pellets and waste material. 3 I. The facility shall meet the requirements of any 4 regulations adopted pursuant to Public Resources Code, 5 Section 43209 and the requirements of any other applicable 6 sections of the California Integrated Waste Management Act 7 of 1989 (Public Resources Code, section 40000, et. seq.). 8 m. Primo Corporation, Inc. shall obtain all 9 required federal, state, local and regulatory agency permits 10 prior to operation. 11 n. Primo Corporation shall maintain records, that 12 include the amount of waste recycled and the name and 13 location of the company that produced it, of all plastics 14 recycled at this facility so that it may be determined what 15 plastics are collected within the city of Vernon. 16 SECTION 3: The City council hereby approves and 17 adopts the Negative Declaration for the project and hereby 18 finds that the project will not individually or cumulatively 19 have an adverse effect on the environment including the 20 wildlife resources. 21 SECTION 4: SUbject to the conditions set forth 22 above, the conditional use permit is granted to Primo 23 Corporation, Inc. for the operation of a recycled materials 24 processing facility at 3301 Fruitland Avenue. 25 26 III 27 III 28 III 5 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 5: The City Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect.
