RESOLUTION NO. 6095
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A CONDITIONAL USE
PERMIT TO FOOD EXPRESS, INC. FOR THE
OPERATION OF A TRUCK AND FREIGHT TERMINAL AT
4280 BANDINI BOULEVARD
WHEREAS, Food Express, Inc. has applied for a
6 conditional use permit to operate a truck and freight
7 terminal at 4280 Bandini Boulevard; and
8
WHEREAS, the City Council of the City of Vernon
9 held a hearing on said application for a conditional use
10 permit on May 19, 1992; and
11 WHEREAS, the proposed site is a conforming use in
12 the Heavy Industry (M2) Zone which was previously used as a
13 truck and freight terminal, and which requires a conditional
14 use permit under the Zoning Ordinance in order to continue
15 the use; and
16 WHEREAS, the proposed site is adequate in size,
17 shape and topography for the proposed operation, has
18 adequate drainage, and a masonry wall or landscaping has
19 been installed where parking areas adjoin a public street
20 pursuant to the Vernon City Code; and
21 WHEREAS, the proposed site is surrounded by
22 industrial uses compatible with the proposed use and no
23 adverse effect from traffic, parking, noise, odors, dust,
24 smoke, light or glare, or risk of fire, infection or
25 explosion is anticipated from the proposed operation; and
26
WHEREAS, the site has access to Bandini Boulevard
27 and in general traffic will travel from the site east to
28 freeway access. This portion of Bandini Boulevard is within

1 the City of Vernon and appears to be of sufficient width,
2 pavement type and capacity to handle the traffic generated
3 from the proposed operations; and
4 WHEREAS, the site is required to have adequate
5 offstreet parking and loading facilities in accordance with
6 the Vernon City Code; and
7 WHEREAS, the conditions imposed on the conditional
8 use permit will adequately protect the public health, safety
9 and general welfare and the operation is consistent with all
10 applicable rules and laws of the City of Vernon; and
11 WHEREAS, the proposed use as to location,
12 operation, and design is consistent with the General Plan
13 and the Zoning Ordinance of the City of Vernon; and
14 WHEREAS, the project was found to be categorically
15 exempt from the California Environmental Quality Act per
16 Section 15301 of the California Environmental Quality Act
17 Guidelines and a Notice of Exemption shal1 be filed with the
18 County Clerk per Section 15062 of the California
19 Environmental Quality Act Guidelines.
20 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
21 OF THE CITY OF VERNON AS FOLLOWS:
22 SECTION 1: The City Council of the City of Vernon
23 hereby finds and determines that the recitals contained
24 hereinabove are true and correct.
25 SECTION 2: In order to adequately protect the
26 pUblic health, safety and general welfare the following
27 conditions are imposed:
28 a. The facility shall be operated in accordance

1 with, and made to conform with all current codes, rules,
2 regulations and subject to permit fees as adopted by the
3 City of Vernon. The facility shall be operated in a manner
4 that will prevent unsanitary conditions, odors or other
5 nuisances. Prior to occupancy a business license and
6 occupancy permit shall be obtained. Trucking operations,
7 including truck and trailer parking, shall be limited to the
8 10t located at 4280 Bandini Boulevard.
9 b. Any hazardous substances used, handled or
10 stored shall have prior approval from the Vernon Fire and
11 Health Departments. A Health Permit shal1 be obtained if
12 there are reportable quantities of hazardous materials on
13 the site.
14 c. The number of employee parking spaces required
15 per Vernon City Code shall be provided and maintained.
16 d. All parking and loading facilities shall be
17 paved with a hard durable surface material and shall be
18 adequately drained, and kept free of dust, mud, trash or
19 weeds.
20 e. Servicing of vehicles including washing, steam
21 cleaning and repairing shal1 be performed in facilities in
22 compliance with appropriate codes.
23 f. Food Express, Inc. shall obtain all required
24 permits from the Los Angeles County Sanitation District,
25 and all federal, state and regulatory agencies. If
26 required, a National Pollutant Discharge Elimination System
27 permit shal1 be obtained from the California State Board of
28 Water Resources.

1 g. No equipment or freight shall be stored on the
2 site, other than in trailers or on the docks. Adequate
3 plans and materials must be available for handling leaks or
4 spills from vehicles during storage or transportation.
5 h. AIl cracked sidewalk in Bandini Boulevard
6 adjacent to the site shal1 be repaired. Guard posts shall be
7 constructed at the ends of all driveways. Food Express,
8 Inc. shall pay to the City Four Thousand Eight Hundred
9 Dollars ($4,800.00) for the cost of constructing traffic
10 signal improvements at the intersection of Bonnie Beach
11 Place and Bandini Boulevard. Said improvements will include
12 signal heads to control traffic exiting the subject site and
13 traffic loop detectors. The property owner shall provide
14 the City with an easement for the placement of traffic
15 detection loops on their property and shall enter into a
16 maintenance agreement with the city to pay 25% of the
17 operation and maintenance costs associated with the
18 operation of the traffic signals at this intersection.
19 i. Where parking areas adjoin a public street or
20 streets, a masonry waIl not less than 30 inches in height,
21 or landscaped area a minimum of 4 feet in width, measured
22 from the property lines shall be established along such
23 frontage, except at driveways, walkways or where other
24 openings are necessary.
25 j. Food Express, Inc. shall obtain Health Permits
26 for the food establishment and the wholesale food vehicles.
27 k. The on-site clarifier must be cleaned and
28 inspected for leakage or deterioration.

1 1. Detailed plans shall be submitted to the
2 Community Services Department of the City of Vernon prior to
3 the installation of any food processing, storage and
4 transfer equipment and any related construction.
5 m. An easement for overhead utility lines
6 located at the northwest corner of the property and
7 extending southerly approximately 400 feet shall be prepared
8 and granted to the City of Vernon.
9 n. The underground fuel tanks on site shall
10 either be removed or tested for integrity. The monitoring
11 system shall be activated and certified by a qualified
12 service company. The operator shall obtain an Underground
13 storage Tank Health Permit, and maintain compliance with
14 City of Vernon Ordinance No. 944.
15 o. The facility's buildings shall be structurally
16 maintained to exclude rodents and the property shall be
17 maintained rodent free.
18 SECTION 3: Subject to the conditions set forth
19 above, the conditional use permit is granted to Food
20 Express, Inc. for the operation of a truck and freight
21 terminal at 4280 Bandini Boulevard.

SECTION 4: The City Clerk of the City of Vernon
2 shall certify to the passage of this resolution and
3 thereupon and thereafter the same shall be in full force and
4 effect.
