Resolution No. 6096 ". 1 2 3 4 5 RESOLUTION NO. 6096 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A CONDITIONAL USE PERMIT TO CAL-CLEVE LTD. DBA DOT LINE TRANSPORTATION FOR THE OPERATION OF A TRUCK AND FREIGHT TERMINAL AT 2626 26TH STREET 6 WHEREAS, Cal-Cleve Ltd. dba Dot Line 7 Transportation has applied for a conditional use permit to 8 operate a truck and freight terminal at 2626 26th Street; 9 and 10 WHEREAS, the City Council of the City of Vernon 11 held a hearing on said application for a conditional use 12 permit on May 19, 1992; and 13 WHEREAS, the proposed site is a non-conforming use 14 in the General Industry (M) Zone which has been continuously 15 used as a truck and freight terminal, and requires a 16 conditional use permit under the zoning Ordinance in order 17 to continue the use; and 18 WHEREAS, the proposed site is adequate in size, 19 shape and topography for the proposed operation, has 20 adequate drainage, and a masonry wall or landscaping has 21 been installed where parking areas adjoin a public street 22 pursuant to the Vernon City Code; and 23 WHEREAS, the proposed site is surrounded by 24 industrial uses compatible with the proposed use and no 25 adverse effect from traffic, parking, noise, odors, dust, 26 smoke, light or glare, or risk of fire, infection or 27 explosion is anticipated from the proposed operation; and 28 WHEREAS, the site has access to 26th Street and in 1 1 general traffic will travel from the site east or west to 2 either Soto street or Santa Fe Avenue, thence north to 3 freeway access. The streets to be utilized are within the 4 City of Vernon and appear to be sufficient to handle the 5 traffic generated from the proposed operations; and 6 WHEREAS, the site is required to have adequate 7 offstreet parking and loading facilities in accordance with 8 the Vernon City Code; and 9 WHEREAS, the conditions imposed on the conditional 10 use permit will adequately protect the public health, safety 11 and general welfare and the operation is consistent with all 12 applicable rules and laws of the City of Vernon; and 13 WHEREAS, the proposed use as to 10cation, 14 operation, and design is consistent with the General Plan 15 and the Zoning Ordinance of the City of Vernon; and 16 WHEREAS, the project was found to be categorically 17 exempt from the California Environmental Quality Act per 18 Section 15301 of the California Environmental Quality Act 19 Guidelines and a Notice of Exemption shall be filed with the 20 County Clerk per Section 15062 of the California 21 Environmental Quality Act Guidelines. 22 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL 23 OF THE CITY OF VERNON AS FOLLOWS: 24 SECTION 1: The City Council of the city of Vernon 25 hereby finds and determines that the recitals contained 26 hereinabove are true and correct. 27 SECTION 2: In order to adequately protect the 28 public health, safety and general welfare the following 2 1 conditions are imposed: 2 a. The facility shal1 be operated in accordance 3 with, and made to conform with all current codes, rules, 4 regulations and subject to permit fees as adopted by the 5 City of Vernon. The facility shall be operated in a manner 6 that will prevent unsanitary conditions, odors or other 7 nuisances. Prior to occupancy a business license and 8 occupancy permit shall be obtained. All trucking 9 operations, including truck and trailer parking, shall be 10 limited to the lot located at 2626 26th street. 11 b. Any hazardous substances used, handled or 12 stored shall have prior approval from the Vernon Fire and 13 Health Departments. A Health Permit shall be obtained if 14 there are reportable quantities of hazardous materials on 15 the site. 16 c. The number of employee parking spaces required 17 per Vernon City Code shall be provided and maintained. 18 d. All parking and loading facilities shall be 19 paved with a hard durable surface material and shall be 20 adequately drained, and kept free of dust, mud, trash or 21 weeds. 22 e. Servicing of vehicles including washing, steam 23 cleaning and repairing shall be performed in facilities in 24 compliance with appropriate codes. 25 f. If required, a National Pollutant Discharge 26 Elimination System permit shall be obtained from the 27 California state Board of Water Resources. 28 g. No equipment or freight shall be stored on the 3 1 site, other than in trailers or on the docks. Adequate 2 plans and materials must be available for handling leaks or 3 spills from vehicles during storage or transportation. 4 h. AIl cracked sidewalk shall be repaired. Guard 5 posts shall be constructed at the ends of driveways. 6 i. Where parking areas adjoin a public street or 7 streets, a masonry wall not less than 30 inches in height, 8 or landscaped area shall be maintained, except at driveways, 9 walkways or where other openings are necessary. 10 j. The westerly five feet of the subject property 11 shal1 be deeded to the City of Vernon for the widening of 12 26th street. 13 k. The underground storage monitoring system 14 shal1 be checked by a qualified service person. Underground 15 tank and monitoring systems must meet the requirements of 16 Ordinance No. 944. 17 1. AIl required federal, state, 10cal and 18 regulatory agency permits shall be obtained prior to 19 operation. 20 m. The facility's buildings shall be structurally 21 maintained to exclude rodents and the property shall be 22 maintained rodent free. 23 SECTION 3: Subject to the conditions set forth 24 above, the conditional use permit is granted to Dot Line 25 Transportation for the operation of a truck and freight 26 terminal at 2626 26th street. 27 III 28 III 4 1 SECTION 4: The City Clerk of the City of Vernon 2 shall certify to the passage of this resolution and 3 thereupon and thereafter the same shall be in full force and 4 effect. 5 APPROVED AND ADOPTED this 19th day of May, 1992. 6 7 ~~~Bfkl~~~ro : A;L/~ 10 BRUCE V.
