DBA: APPAREL SERVICE INT'L FROM SECTION 26.4.2-8, DEVELOPMENT STANDARDS, OF THE COMPREHENSIVE ZONING ORDINANCE, FOR PROPERTY LOCATED AT 5015 HAMPTON STREET IN THE CITY OF VERNON WHEREAS, Abagi Inc. dba: Apparel Service Int'l has applied for certificate of occupancy for a building which requires a variance from Section 26.4.2-8, Development Standards, of the comprehensive Zoning Ordinance, for the property located at 5015 Hampton street; and WHEREAS, the physical condition of the property is unique in that the existing building measuring approximately 11,400 square feet was constructed with one truck dock measuring 46.3 feet from the street right-of-way and 10.7 feet wide; and WHEREAS, Zoning Ordinance Section 26.4.2-8 specifies that each loading space shall be a minimum of 10 feet wide and 65 feet 10ng and Section 26.4.6-4 (c) provides that a nonconforming building must comply with these standards with any changes in occupancy unless a variance is granted; and WHEREAS, the application of the development standards for truck loading space sizing requirements will create an unreasonable hardship by requiring two 10 feet wide and 65 feet long spaces be provided; and WHEREAS, Apparel Service Int'l has indicated that it has no plans to expand or alter the building configuration and that the one 46.3 feet long by 10.7 feet wide truck loading space is sufficient for the intended use; and 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, 5015 Hampton street is located in the M zone and the operation is consistent with the objectives of the General PIan and Zoning Ordinance; and WHEREAS, the City Council of the City of Vernon held a hearing on said application for a variance on June 16, 1992. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNOIL OF THE CITY OF VERNON AS FOLLOWS; SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained herein- above are true and correct. SECTION 2: A variance from the requirements for one truck loading space 10 feet wide by 65 feet long is hereby granted to Apparel Service Int'l at 5015 Hampton Street on condition that the existing 10ading bay 10.7 feet wide and 46.3 feet long be maintained. S~CTION 3: The variance shall be granted sUbject to the following condition: the usage of the loading space shall be limited to vehicles with a maximum lengthof45.0 feet. SE01ION 4: Noncompliance with this condition shall constitute sufficient grounds for the Oity Oouncil of the City of Vernon to void this variance and require the application of the authorized truck loading space requirement. SECTION 5: The City Clerk of the City of Vernon shall certify to the passage of this Resolution and thereupon and thereafter the same shall be in full force and effect.
