RESOLUTION NO. 6133

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND AUTHORIZING THE EXECUTION OF
A WATER RIGHT LICENSE AND AGREEMENT FOR THE PERIOD
JULY 1, 1992 THROUGH JUNE 30, 1993 BY AND BETWEEN
THE CITY OF VERNON AND KAL-KAN FOODS, INC.

WHEREAS, victor H. Vaits, Director of Community Services,
6 previously negotiated with Ka1-Kan Foods, Inc. (Kal-Kan) to lease 140
7 acre-feet of Kal-Kan' s Allowed Pumping Allocation to the City of
8 Vernon for fiscal year 1992-93; and
9
WHEREAS, the City of Vernon and Kal-Kan have reached
10 agreement that the agreed price for the 1992-93 period is Eleven
11 Thousand Two-hundred Seventy Dollars and No Cents ($11,270.00), and
12 said money will be used as a credit towards Kal-Kan's regular water
13 bills; and
14
WHEREAS, the City of Vernon sent an authorization dated July
15 1, 1992 to Kal-Kan which provided that the sum of Eleven Thousand
16 Two-hundred Seventy Dollars and No Cents (for 1992-93) was to be
17 applied to the Kal-Kan Water Account No. 12-19740-01-0; and
18
WHEREAS, Mr. Dane K. Andersen, Commercial Manager for
19 Kal-Kan, signed said statement on July 7, 1992, agreeing thereto.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
21 CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon hereby
23 finds and determines that the recitals contained hereinabove are true
24 and correct.
25
SECTION 2: The City Council of the City of Vernon hereby
26 approves the Water Right License and Agreement, a copy of which has
27 been presented to the City Council concurrently with this resolution,
28 and the City Council hereby orders said Agreement to be received and

1 filed by the City Clerk.

SECTION 3: The City Council of the City of Vernon hereby
3 authorizes the Mayor and the City Clerk to execute said Agreement
4 for, and on behalf of, the City of Vernon.
5
SECTION 4:
The City Clerk of the City of Vernon shall
6 certify to the passage of this resolution, and thereupon and
7 thereafter the same shall be in full force and effect.
