Resolution No. 6140 '. 1 2 3 4 5 6 7 8 9 10 held a hearing on said application for a conditional use 11 12 13 RESOLUTION NO. 6140 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A CONDITIONAL USE PERMIT TO ATE MANAGEMENT & SERVICE CO., INC. FOR THE OPERATION OF A TRUCK TERMINAL AT 2921-2957 LEONIS BOULEVARD WHEREAS, ATE Management & Service Co., Inc., a subsidiary of Ryder Truck Company, has applied for a conditional use permit to operate a truck terminal at 2921- 2957 Leonis Boulevard; and WHEREAS, the City Council of the City of Vernon permit on August 4, 1992; and WHEREAS, the proposed site is in the General Industry (M) Zone and is currently used as a truck terminal. 14 The proposed use is nonconforming and requires a conditional 15 use permit under the Zoning Ordinance in order to continue 16 the use; and 17 WHEREAS, the proposed site is adequate in size, 18 shape and topography for the proposed operation, has 19 adequate drainage, and a masonry wall or landscaping will be 20 installed where parking areas adjoin a public street 21 pursuant to the Vernon City Code; and 22 WHEREAS, the proposed site is surrounded by 23 industrial, commercial and office uses compatible with the 24 proposed use and no adverse effect from traffic, parking, 25 noise, odors, dust, smoke, light or glare, or risk of fire, 26 infection or explosion is anticipated from the proposed 27 operation; and 28 WHEREAS, the site has access to Leonis Boulevard 1 '. 1 and in general traffic will travel from the site 2 northwesterly to downtown Los Angeles. Leonis Boulevard is 3 within the City of Vernon and has sufficient width, 4 pavement type and capacity to handle the traffic generated 5 from the proposed operations; and 6 WHEREAS, the site is required to have adequate 7 offstreet parking and loading facilities in accordance with 8 the Vernon City Code; and 9 WHEREAS, the conditions imposed on the conditional 10 use permit will adequately protect the public health, safety 11 and general welfare and the operation is consistent with all 12 applicable rules and laws of the City of Vernon; and 13 WHEREAS, the proposed use as to location, 14 operation, and design is consistent with the General Plan 15 and the Zoning Ordinance of the City of Vernon; and 16 WHEREAS, the project was found to be categorically 17 exempt from the California Environmental Quality Act per 18 Section 15301 of the California Environmental Quality Act 19 Guidelines and a Notice of Exemption shall be filed with the 20 County Clerk per Section 15062 of the California 21 Environmental Quality Act Guidelines. 22 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL 23 OF THE CITY OF VERNON AS FOLLOWS: 24 SECTION 1: The City Council of the City of Vernon 25 hereby finds and determines that the recitals contained 26 hereinabove are true and correct. 27 SECTION 2: In order to adequately protect the 28 public health, safety and general welfare the following 2 '. 1 conditions are imposed: 2 a. The facility shall be operated in accordance 3 with, and made to conform with all current codes, rules, 4 regulations and subject to permit fees as adopted by the 5 City of Vernon. The facility shall be operated in a manner 6 that will prevent unsanitary conditions, odors or other 7 nuisances. Prior to occupancy a business license and 8 occupancy permit shall be obtained. All operations, 9 including bus, truck, trailer and employee parking for the 10 entire facility, shall be limited to the lots located at 11 2921-2957 Leonis Boulevard. 12 b. Any hazardous substances used, handled or 13 stored shall have prior approval from the Vernon Fire and 14 Health Departments. A Health Permit shall be obtained if 15 there are reportable quantities of hazardous materials on 16 the site. 17 c. The number of employee parking spaces required 18 per Vernon City Code shall be provided and maintained. 19 d. All parking and loading facilities shall be 20 paved with a hard durable surface material and shall be 21 adequately drained, and kept free of dust, mud, trash or 22 weeds. 23 24 25 26 27 28 e. Servicing of vehicles including washing, steam cleaning and repairing shall be performed in facilities in compliance with appropriate codes. f. All required permits shall be obtained from the Los Angeles County Sanitation District, and all federal, state and regulatory agencies prior to operation. If 3 1 required, a National Pollutant Discharge Elimination System 2 permit shall be obtained from the California state Board of 3 Water Resources. 4 g. All cracked sidewalk in Leonis Boulevard 5 adjacent to the 2921-2957 Leonis Boulevard property shall be 6 repaired to City standards. Guard posts shall be constructed 7 at the ends of all driveways. 8 h. Where parking areas for the 2921-2957 Leonis 9 Boulevard property adjoin a public street, a masonry wall 10 not less than 30 inches in height, or landscaped area a 11 minimum of 4 feet in width, measured from the property lines 12 shall be established along such frontage, except at 13 driveways, walkways or where other openings are necessary. 14 i. Detailed plans shall be submitted to the 15 Community Services Department of the City of Vernon and 16 permits obtained prior to any demolition or construction. 17 SECTION 3: Subject to the conditions set 18 forth above, the conditional use permit is granted to ATE 19 Management Service Co., Inc. for the operation of a truck 20 terminal at 2921-2957 Leonis Boulevard. 21 ~ 23 24 25 26 III 27 III 28 III 4 . 1 2 3 thereupon and thereafter the same shall be in full force and 4 5 6 7 8 SECTION 4: The City Clerk of the City of Vernon shall certify to the passage of this resolution and effect.
