Resolution No. 6155 ~ Resolution No. 6155 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A VARIANCE TO ALECO FURNITURE MFG. INC. FROM SECTION 26.4.2-8, DEVELOPMENT STANDARDS, OF THE COMPREHENSIVE ZONING ORDINANCE, FOR PROPERTY LOCATED AT 4770 50th STREET IN THE CITY OF VERNON WHEREAS, Aleco Furniture Manufacturing Inc. has applied for certificate of occupancy for a building which requires a variance from Section 26.4.2-8, Development Standards, of the Comprehensive Zoning Ordinance, for the property located at 4770 50th Street; and WHEREAS, the applicant will be manufacturing furniture within the building which has a gross floor area of approximately 66,500 square feet and Zoning Ordinance Section 26.4.2-7 requires one truck loading space for each 20,000 square feet of gross floor area or portion thereof for a total of four (4) spaces; and WHEREAS, Zoning Ordinance Section 26.4.2-8 (c) specifies that each loading space shall be a minimum of 10 feet wide and 65 feet long and Section 26.4.6-4 (a) provides that nonconforming offstreet parking and loading must comply with standards with any changes in occupancy unless a variance is granted; and WHEREAS, the physical condition of the property is unique in that the existing building was constructed with eight truck docks, each measuring 9 feet wide and 31.0 feet from the street right-of-way; and WHEREAS, the existing building has more than four (4) conforming truck loading and parking spaces, but Aleco Furniture Manufacturing Inc. would like to use the non-conforming spaces ~ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 ~ ~ 24 ~ 26 27 28 for convenience; and WHEREAS, the application of the development standards for the truck loading space size requirements will create an unreasonable hardship by requiring 65 feet long by 10 feet wide spaces for loading docks which are in excess of the current standards; and WHEREAS, Aleco Furniture Manufacturing Inc. has indicated that it has no plans to expand or alter the building configuration and that the eight loading docks will be used for convenience only and are sufficient for the intended uses; and WHEREAS, 4770 50th Street is located in the M zone and the operation is consistent with the General Plan and Zoning Ordinance; and WHEREAS, the City Council of the City of Vernon held a hearing on said application for a variance on September 1, 1992. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS; SECTION 1: The City Council of the city of Vernon hereby finds and determines that the recitals contained herein- above are true and correct. SECTION 2: A variance from the requirements for loading spaces 10 feet wide by 65 feet long is hereby granted to Aleco Furniture Manufacturing Inc. for eight nonconforming loading docks at 4770 50th Street. SECTION 3: The variance shall be granted subject to the following conditions: (a) the usage of the loading spaces shall be limited to vehicles with a maximum length of 30 feet; 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 (b) at least eight of the conforming truck loading ~nd parking spaces shall be maintained. SEqTION 4: Noncompliance with these conditions shall constitute sufficient grounds for the City Council of the City of Vernon to void this variance and require the application of the authorized truck loading space requirements. SECTION !?: The City Clerk of the City of Vernon shall certify to the passage of this Resolution and thereupon and thereafter the same shall be in full force and effect.
