Resolution No. 6163 .. -' 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 6163 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A VARIANCE TO WORLD TOYS DISCOUNT CO. INC. FROM SECTION 26.4.2-8, DEVELOPMENT STANDARDS, OF THE COMPREHENSIVE ZONING ORDINANCE, FOR PROPERTY LOCATED AT 2468 26th STREET IN THE CITY OF VERNON WHEREAS, World Toys Discount Co. Inc. has applied for certificate of occupancy for a building which requires a variance from section 26.4.2-8, Development Standards, of the Comprehensive Zoning Ordinance, for the property located at 2468 26th Street; and WHEREAS, the physical condition of the property is unique in that the existing building measuring approximately 20,000 square feet was constructed with six truck docks measuring 23.6 feet from the street right of-way and ranging from 11.8 to 13.4 feet wide; and WHEREAS, World Toys Discount Co. Inc. will operate th building as a warehouse and Zoning Ordinance section 24.4.2-7 requires one truck loading space for each 10,000 square feet of gross floor area for a total of two (2) spaces; and WHEREAS, Zoning Ordinance section 26.4.2-8 specifies that each loading space shall be a minimum of 10 feet wide and 65 feet long and section 26.4.6-4 (c) provides that a nonconforming building must comply with these standards with any changes in occupancy unless a variance is granted; and WHEREAS, the existing width of 26th Street is 50 feet, the Master Plan of city Streets proposes that this street be widened to 60 feet, 5 feet on each side of the street, and therefore the maximum length vehicle that can be parked at the 1 . 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 ~ ~ 24 ~ 26 27 28 dock without extending into the proposed right-of-way is 18.6 feet; and WHEREAS, the application of the development standards for the loading space requirements will create an unreasonable hardship by requiring the six nonconforming spaces to be 10 feet wide and 65 feet long; and WHEREAS, World Toys Discount Co. Inc. has indicated that it has no plans to expand or alter the building configuration and that six 18.6 feet long truck loading spaces are sufficient for the intended use; and WHEREAS, 2648 26th Street is located in the M zone and the operation is consistent with the objectives of the General Plan and Zoning Ordinance; and WHEREAS, the City Council of the City of Vernon held a hearing on said application for a variance on October 6, 1992. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS; SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained herein- above are true and correct. SECTION 2: A variance from section 26.4.2-8, Development Standards of the Comprehensive Zoning Ordinance, requiring all truck loading spaces to be 10 feet wide by 65 feet long is hereby granted to World Toys Discount Co. Inc. at 2468 26th Street. SECTION 3: The variance shall be granted subject to the following condition: the usage of the loading spaces shall be limited to vehicles with a maximum length of 18.6 feet. 2 .. ~ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 4: Noncompliance with this condition shall constitute sufficient grounds for the City Council of the City of Vernon to void this variance and require the application of the authorized truck loading space requirement. S:eCTION 5: The City Clerk of the City o.f Vernon shall certify to the passage of this Re$olution and thereupon and thereafter the same shall be in full force and effect.
