Resolution No. 6166 1 2 3 4 5 RJSOLUTION NO. 6166 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A CONDITIONAL USE PERMIT TO ANTELOPE VALLEY BUS, INC. FOR THE OPERATION OF A TRUCK TERMINAL AT 2450 VERNON AVENUE WHEREAS, Antelope Valley Bus, Inc. has applied for 6 a conditional use permit to operate a truck terminal at 2450 7 Vernon Avenue; and 8 WHEREAS, the City Council of the City of Vernon 9 held a hearing on said application for a conditional use 10 permit on October 6, 1992; and 11 WHEREAS, the proposed site is in the General 12 Industry (M) Zone and is currently used as a truck terminal 13 and no expansion of the use is planned. The proposed use is 14 nonconforming and requires a conditional use permit under 15 the Zoning Ordinance in order to continue the use; and 16 WHEREAS, the proposed site is adequate in size, 17 shape and topography for the proposed operation, has 18 adequate drainage, and a masonry wall or landscaping will be 19 installed where parking areas adjoin a public street 20 pursuant to the Vernon City Code; and 21 WHEREAS, the proposed site is surrounded by 22 industrial, commercial and office uses compatible with the 23 proposed use and no adverse effect from traffic, parking, 24 noise, odors, dust, smoke, light or glare, or risk of fire, 25 infection or explosion is anticipated from the proposed 26 operation; and 27 WHEREAS, the site has access to Vernon Avenue and 28 in general traffic will travel from the site easterly on 1 1 Vernon Avenue to Soto street, then north on Soto street to 2 freeway access. Vernon Avenue and Soto street are within 3 the City of Vernon and have sufficient width, pavement type 4 and capacity to handle the traffic generated from the 5 proposed operations; and 6 WHEREAS, the site is required to have adequate 7 offstreet parking and loading facilities in accordance with 8 the Vernon City Code; and 9 WHEREAS, the conditions imposed on the conditional 10 use permit will adequately protect the public health, safety 11 and general welfare and the operation is consistent with all 12 applicable rules and laws of the City of Vernon; and 13 WHEREAS, the proposed use as to location, 14 operation, and design is consistent with the General Plan 15 and the nonconforming use provisions of the Zoning Ordinance 16 of the city of Vernon; and 17 WHEREAS, the project was found to be categorically 18 exempt from the California Environmental Quality Act per 19 Section 15301 of the California Environmental Quality Act 20 Guidelines and a Notice of Exemption shall be filed with the 21 County Clerk per section 15062 of the California 22 Environmental Quality Act Guidelines. 23 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL 24 OF THE CITY OF VERNON AS FOLLOWS: 25 SECTION 1: The City Council of the City of Vernon 26 hereby finds and determines that the recitals contained 27 hereinabove are true and correct. 28 SECTION 2: In order to adequately protect the 2 1 public health, safety and general welfare the following 2 conditions are imposed: 3 a. The facility shall be operated in accordance 4 with, and made to conform with all current codes, rules, 5 regulations and subject to permit fees as adopted by the 6 City of Vernon. The facility shall be operated in a manner 7 that will prevent unsanitary conditions, odors or other 8 nuisances. Prior to occupancy a business license and 9 occupancy permit shall be obtained. 10 b. Any hazardous substances used, handled or 11 stored shall have prior approval from the Vernon Fire and 12 Health Departments. A Health Permit shall be obtained if 13 there are reportable quantities of hazardous materials on 14 the site. 15 c. All parking and loading facilities shall be 16 paved with a hard durable surface material and shall be 17 adequately drained, and kept free of dust, mud, trash or 18 weeds. 19 d. Servicing of vehicles including washing, steam 20 cleaning and repairing shall be prohibited unless they are 21 performed in compliance with appropriate codes. 22 e. obtain all required permits from the Los 23 Angeles County Sanitation District, and all federal, state 24 and regulatory agencies prior to operation. If required, a 25 National Pollutant Discharge Elimination System permit shall 26 be obtained from the California State Board of Water 27 Resources. As outlined in the NPDES Permit a prevention and 28 monitoring program shall be prepared within the Board's time 3 1 limitations. 2 f. The property owner shall deed to the city a 10 3 foot strip of land along the subject property for the 4 widening of Vernon Avenue. 5 g. Five additional feet of sidewalk shall be 6 constructed to increase the roadway width of Vernon Avenue 7 to 30 feet as measured from the street centerline. Repair 8 all existing cracked sidewalk, curb & gutter adjacent to the 9 site in Vernon Avenue to meet City standards. Guard posts 10 shall be constructed at the ends of all driveways. 11 h. Where the sites parking areas adjoin a public 12 street, a masonry wall not less than 30 inches in height, or 13 a sprinklered, landscaped area a minimum of 4 feet in width, 14 measured from the new property lines, shall be established 15 along such frontage, except at driveways, walkways or where 16 other openings are necessary. If the landscape option is 17 selected the lawns and shrubs shall have a neat appearance 18 and be well maintained and free of weeds. 19 i. The applicant has the responsibility to see 20 that all buses or other vehicles stored on the lot are 21 operational. All broken down buses shall be repaired 22 immediately or removed from the yard. No portions of buses, 23 parts or miscellaneous equipment shall be stored outside. 24 j. Underground storage tank monitoring system 25 shall be checked by a qualified service person. Underground 26 tank and monitoring systems must meet the requirements of 27 City Ordinance No. 944. 28 k. Prepare and grant easements to the city of 4 1 Vernon for existing electrical lines and a guy wire which 2 cross over the subject site. 3 SECTION 3: Subject to the conditions set forth 4 above, the conditional use permit is granted to Antelope 5 Valley Bus, Inc. for the operation of a truck terminal at 6 2450 Vernon Avenue. 7 SECTION 4: The City Clerk of the City of Vernon 8 shall certify to the passage of this resolution and 9 thereupon and thereafter the same shall be in full force and 10 effect. 11 APPROVED AND ADOPTED this 6th day of October, 12 1992. 13 14 -')(; . ~ ./" ..... -J-V'4':V1/ L.('. / Wt-<(:L/ THOMAS A.
