Resolution No. 6171 1 RESOLUTION NO. 6171 2 5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON SUPERSED!NG RESOLUTION NOS. 6014, 6047, and 6153 AND ESTABLISHING THE RATES FOR BUSINESS LICENSE TAXES AND RELATED FEES AND DEPOSITS PURSUANT TO CHAPTER 15 OF THE VERNON CITY CODE 3 4 6 7 WHEREAS, pursuant to Vernon City Code section 15.8, the 8 City Council of the City of Vernon is authorized to set business 9 license taxes, related fees and deposits by resolution; and 10 WHEREAS, the City Council has established business license 11 fees pursuant to Resolution No. 6014, adopted on November 9, 1991, 12 as amended by Resolution No. 6047 on February 4, 1992, and by 13 Resolution No. 6153 on September 1, 1992; and 14 WHEREAS, the cost of living and general prices have 15 increased due to inflation, and the fees established herein reflect 16 the previous fees adjusted for the rate of inflation occurring 17 during the intervening time period; and 18 WHEREAS, the City Administrator-Finance Director has 19 recommended that the business license taxes, related fees, and 20 deposits be revised as set forth herein. 21 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 22 CITY OF VERNON AS FOLLOWS: 23 SECTION 1: The City Council of the City of Vernon hereby 24 finds and determines that the recitals contained hereinabove are 25 true and correct. 26 SECTION 2: Transfer Fees (V.C.C. Sec. 15.9). 27 When a business relocates within the City of Vernon, there 28 shall be no transfer fee. , . 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1. .. , ~ SECTION 3: Business License Fees (V.C.C. Sec. 15.18). Every person doing business or engaged in any business, profession, trade or occupation, or performing any act, or otherwise dealing in or with goods, wares or merchandise, and not elsewhere specifically licensed by other provisions of Chapter 15 of the Vernon City Code, shall pay a license fee for each calendar year or portion thereof for the privilege of doing business in the City of Vernon as follows: ANNUAL FEE FOR EVERY PERSON EMPLOYING: 0 or 1 employee (warehousing with no employees in the City of Vernon shall pay the minimum of $105.00 per year) 2 to 10 employees 11 to 25 employees 26 to 50 employees 51 to 75 employees 76 to 100 employees 101 to 150 employees 151 to 200 employees 201 to 250 employees 251 to 300 employees 301 to 400 employees 401 to 500 employees 501 to 600 employees 601 to 700 employees 701 to 800 employees III III -2- $ 105.00 160.00 200.00 305.00 400.00 505.00 605.00 705.00 800.00 900.00 1,000.00 1,105.00 1,205.00 1,400.00 1,600.00 , . 1 ANNUAL FEE 2 3 4 5 6 7 8 9 10 11 12 13 14 15 SECTION 4: Penalties and Delinquent charges (V.C.C. Sec. 16 15.20). 17 Delinquent business licenses, including new businesses 18 which have failed to obtain a license, shall be charged a delinquent 19 fee of ten percent (10%) for the first month and ten percent (10%) 20 per month thereafter up to a maximum of fifty percent (50%) of their 21 annual business license fee for each year of delinquency in addition 22 to the annual business license fee for each such year. 23 SECTION 5: Central station Industrial Protective Service 24 (V.C.C. Sec. 15.28). 25 Every person conducting a central station protective 26 signaling system shall pay the following fees: 27 (a) The applicant shall pay a minimum license fee of 28 $315.00 per year at the time of application for or renewal of the -3- FOR EVERY PERSON EMPLOYING: 801 to 900 employees $1,810.00 901 to 1,000 employees 2,005.00 1,001 to 1,100 employees 2,205.00 1,101 to 1,200 employees 2,405.00 1,201 to 1,300 employees 2,610.00 1,301 to 1,400 employees 2,810.00 1,401 to 1,500 employees 3,005.00 1,501 to 1,600 employees 3,210.00 1,601 to 1,700 employees 3,410.00 1,701 to 1,800 employees 3,610.00 1,801 to 1,900 employees 3,810.00 1,901 and more employees 4,010.00 , . 1 license; 2 (b) The licensee shall pay to the City of Vernon two 3 percent (2%) of the gross receipts of business arising from 4 licensee's operations conducted in the City of Vernon, less the 5 minimum previously paid. 6 SECTION 6: Persons without a Fixed Place of Business 7 (V.C.C. Sec. 15.29). 8 (a) Every person, firm or corporation engaged in or 9 carrying on the business of an auctioneer for the sale at auction of 10 any real or personal property shall pay a fee of $100.00 each day 11 unless exempted by state law; 12 (b) Every person, firm, or corporation engaging in the 13 business of commercial still photography shall pay a fee of $50.00 14 each day; 15 (c) Every person, firm, or corporation providing taxicab 16 service in the city other than from a taxicab stand, as such terms 17 are defined in Chapter 23 of the Code, shall pay a fee of $150.00 18 each year; 19 (d) Every person, firm, or corporation providing vehicle 20 towing services in the city shall pay a fee of $150.00 each year. 21 SECTION 7: License Fees for Peddlers (V.C.C. Sec. 15.30). 22 (a) Every peddler shall pay a minimum fee of $185.00 per 23 year, or portion thereof; 24 (b) Every peddler who calls attention to his wares, or 25 advertises the same by use of music, entertainment, speech, fancy or 26 grotesque dress, or otherwise, upon any public street, alley or 27 other public place, doorway of any room or building, unenclosed or 28 vacant lot or parcel of land within the City of Vernon, shall pay -4- . . 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 , . $525.00 per year, or any portion thereof; (c) Every catering vehicle engaged in the preparation and sale of hot food and drink items from said vehicle shall pay a fee of $200.00 per year; (d) Every catering vehicle engaged in the preparation and sale of cold food and drink items only from said vehicle, shall pay a fee of $160.00 per year; (e) Catering vehicles not otherwise licensed, operating in the City of Vernon to serve an auction or other special event, shall pay a fee of $40.00 per day for each day or portion thereof for said operation. (f) When a license for a peddler's vehicle or for a catering vehicle is transferred from vehicle to vehicle, there shall be a transfer fee of $50.00. SECTION 8: Motion Picture Production (V.C.C. Sec. 15.31). Every person engaged in motion picture production in the City of Vernon shall pay the fees set forth in the filming permit guidelines as approved by the city council. SECTION 9: Selling Fruits and Vegetables (V.C.C. Sec. 15.32). Every person selling fruits and vegetables from a vehicle shall pay a fee of $160.00 per year, or portion thereof. SECTION 10: Dealers in Junk, Metal, Rags, Paper, Etc. (V.C.C. Sec. 15.33) (a) Every person carrying on the business commonly known as junk or scrap metal dealer shall pay a fee of $1,200.00 per year; (b) A secondhand rag or paper dealer shall pay a fee of $790.00 per year; -5- 1 ( c) A secondhand pipe dealer shall pay the sum of 2 $1,200.00 per year. 3 SECTION 11: Business License Fee For Warehousing (V.C.C. 4 Sec. 15.34) 5 (a) The minimum warehousing license fee shall be $160.00 6 per year and the maximum warehousing fee shall be $1,680.00 per 7 year. Warehousing shall include distributing and wholesale 8 businesses which are not conducted in conjunction with a 9 manufacturing business; 10 (b) For every person engaged in or carrying on the 11 business of warehousing in the City of Vernon, the fee per unit 12 shall be as follows: 13 ANNUAL FEE 14 First 200 sq. ft. $25.00 15 All footage over 200 sq. ft. $ 0.03 per sq. ft. in addition to the $25.00 16 17 (c) Each additional offsite warehousing facility which a 18 business may have in the City of Vernon shall have a business 19 license and the fee per unit shall be as follows: 20 ANNUAL FEE 21 22 First 200 sq. ft. $25.00 All footage over 200 sq. ft. $ 0.015 per sq. ft. in addition to the $25.00 23 24 ( d) If the warehousing facility is 4,700 square feet or 25 less, then the minimum rate applies; 26 (e) Every person engaged in or carrying on the business of 27 warehousing in conjunction with a manufacturing business and where 28 said business has 100 employees or more at the same location, the -6- 1 business license fee will be based on the number of employees, and 2 the warehousing activity at the same location is exempt from the 3 square footage fee. 4 SECTION 12: Shows, Circuses, Rodeos and Other Amusements 5 (V.C.C. Sec. 15.35). 6 Every person engaged in the business of conducting a show, 7 circus, rodeo, or other type of amusement shall pay the following 8 fees: 9 (a) $150.00 per day for such show, circus, rodeo, or other 10 type of amusement; and 11 (b) $100.00 per day for each sideshow for which an 12 admission fee is charged, and which is operated as a side attraction 13 to a show, circus, rodeo, or other type of amusement licensed under 14 subparagraph (a) above. 15 SECTION 13: Permit for Moving of Structures (V.C.C. Sec. 16 15.42) . 17 The sum of $250.00 shall be deposited with the City Clerk, 18 payable to the City of Vernon, and a permit fee of $15.00 shall be 19 paid for each structure moved into, in, or through the City of 20 Vernon. 21 SECTION 14: Used Car and Automobile Dealers Bond (V.C.C. 22 Sec. 15.44). 23 The applicant for a used car or automobile dealership shall 24 file with the City Clerk along with the application, a bond for 25 $5,000.00 executed on behalf of the City of Vernon by a duly 26 authorized surety corporation subject to approval by the City 27 Attorney. 28 III -7- . " 1 SECTION 15: Junk, Secondhand Meta 1, Rags, Paper, or 2 Secondhand Steel, Pipe and Fittings Dealers' Bond (V.C.C. Sec. 3 15.45). 4 The applicant for a junk, secondhand metal, rags, paper, or 5 secondhand steel, pipe and fittings dealership shall file with the 6 City Clerk along with the application, a bond for $5,000.00 executed 7 on behalf of the City of Vernon by a duly authorized surety 8 corporation subject to approval by the City Attorney. 9 SECTION 16: In addition to the foregoing, the licensee or 10 permittee shall pay all other necessary fees or deposits which may 11 be required by other ordinances or resolutions of the city of Vernon 12 or applicable State laws in effect. 13 SECTION 17: The fees provided for herein shall be 14 effective January 1, 1993.
