Resolution No. 6242 , 1 1 RESOLUTION NO. 6242 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON ADOPTING FINDINGS OF EXEMPTION FROM PROVISIONS IN THE WATER CONSERVATION IN LANDSCAPING ACT (AB325) 4 5 6 WHEREAS, the Water Conservation and Landscaping Act 7 (AB325, Government Code SS65591-65600) was adopted by the State of 8 California effective January 1, 1991; and 9 WHEREAS, Government Code S65594 required the development 10 of a state-wide model water efficient landscape ordinance and II mandated that agencies throughout California either adopt a water l2 efficient landscape ordinance or adopt findings that, due to climatic, geologic, topographic or water availability conditions, 13 14 a water efficient landscape ordinance is unnecessary; and 15 16 WHEREAS, the City of Vernon is an industrial city 5.06 square miles in size located just southeast of downtown Los l7 Angeles and the topography, except for thirty-two living units, is 18 totally developed with industrial, commercial and public uses; and 19 WHEREAS, the City of Vernon has no mandatory landscape 20 21 requirements in its city code and the great majority of properties have been developed with zero landscaping; and 22 WHEREAS, it has been estimated that less than 0.25% of 23 the water distributed within Vernon is used for landscaping; and 24 WHEREAS, the City of Vernon Water Department serves the majority of the City and has the right to pump groundwater to meet 25 26 27 85% of its customers' needs at this time; and WHEREAS, Central Basin Municipal Water District has 28 " " 1 proposed to construct a reclaimed water distribution system 2 through Vernon; and 3 WHEREAS, in times of severe drought or water shortage, 4 existing procedures for limiting landscape water use are contained 5 in Article VI, Chapter 25 of the Vernon City Code, 1959. 6 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 7 CITY OF VERNON AS FOLLOWS: 8 SECTION 1: The City Council of the City of Vernon does 9 hereby find and determine that the recitals contained hereinabove 10 are true and correct. II SECTION 2: The City Council of the City of Vernon hereby 12 adopts the above recitals as the required findings pursuant to 13 Government Code S65595 and further finds that the adoption of a 14 water efficient landscape ordinance as mandated by the Water 15 Conservation and Landscaping Act is therefore unnecessary, and the l6 City of Vernon is hereby exempt from the provisions of said Act. 17 SECTION 3: The City Clerk of the City of Vernon shall 18 certify to the passage of this resolution and thereupon and 19 thereafter the same shall be in full force and effect. 20 APPROVED AND ADOPTED this 27th day of April, 1993. ~ONIS ~. 21 22 24 ATT.E E~S : //2. ~/ BRUCE V. AB 325 mandates that agencies throughout California must either adopt a water efficient landscape ordinance or adopt findings showing that an ordinance is not necessary. staff of the community services Water Department have made findings that an ordinance for the City of Vernon would not be necessary based on the following: 1. The City of Vernon is an industrial City that is totally built out: 2. The City of Vernon Water Company serves the majority of the City and has rights to pump groundwater to meet 85% of our customers' needs: 3. Central Basin Municipal Water District is proposing to construct a reclaimed water distribution system through Vernon which will further add to the water available to meet the city's needs: 4. It has been estimated that less than 0.25% of the water distributed by the City is used for land- scaping: and 6.
