Resolution No. 6250 .., 1 RESOLUTION NO. 6250 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON DECLARING ITS OBLIGATION TO PROVIDE NATURAL GAS UTILITY SERVICES TO ALL CUSTOMERS LOCATED WITHIN THE CITY OF VERNON 4 5 6 WHEREAS, the City Council of the city of Vernon adopted 7 Resolution No. 5946 on June 20, 1991, which established the City 8 of Vernon Gas Municipal utility Department and appointed the City Administrator/City Clerk to be the Chief Executive Officer of said 9 10 11 Department; WHEREAS, on April 16, 1991, a stipulated judgment between 12 Southern California Gas Company ("SoCalGas") and the City of 13 Vernon was approved by the Los Angeles superior Court ("LASC") in 14 LASC Case No. BC 018540, which provided that the City of Vernon 15 may supply competing gas service to customers located within the 16 City of Vernon; and 17 WHEREAS, the City of Vernon has intervened in CPUC Docket 18 No. A.91-03-039 (SoCalGas 1991 ACAP), a rate case filed by 19 SoCalGas for setting of transportation gas rates pending before 20 21 the California Public utilities Commission ("CPUC"), requesting that the CPUC establish a wholesale rate for the City of Vernon in 22 order to permit the City of Vernon to offer competing gas service 23 to customers located within the City of Vernon; and 24 WHEREAS, the City Council of the City of Vernon adopted 25 26 Resolution No. 6180 on November 10, 1992, which approved a Notice of Rescission of the franchise by and between the City of Vernon 27 and SoCalGas adopted by Ordinance No. 607 on May 6, 1947; and 28 1 2 3 4 5 6 7 8 9 10 11 l2 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, Administrative Law Judge Patrick in CPUC Docket No. A.91-03-039 issued a proposed decision on March 22, 1993, which provided the City of Vernon with a wholesale rate for gas transportation service; and WHEREAS, the proposed opinion in CPUC Docket No. A.91-03- 039 is presently pending before the CPUC for its approval or modification. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: That the City Council of the City of Vernon does hereby find and determine that the recitals contained hereinabove are true and correct. SECTION 2: The City Council of the City of Vernon hereby provides that the City of Vernon Gas Municipal utility Department will offer to provide gas transportation and gas service to all customers located within the City of Vernon and will hold a nondiscriminatory open season to permit customers to elect service from the City of Vernon. SECTION 3: The City of Vernon Gas Municipal utility Department will not require a customer located within the City of Vernon to take service from the City if said customer elects to continue to receive said service from SoCalGas pursuant to the franchise adopted in Ordinance No. 607. SECTION 4: The Chief Executive Officer of the Gas Municipal utility Department is hereby instructed to provide customers located within the City of Vernon an open season for at least 90 days to permit said customers to fully consider the merits of electing service from the city of Vernon. -2- 1 2 3 4 5 6 7 8 9 10 11 l2 13 14 15 l6 17 l8 19 20 21 22 23 24 25 26 27 28 'I' J, SECTION 5: The city of Vernon Gas Municipal utility Department will provide service on terms that are just and reasonable and not unduly discriminatory. SECTION 6: The City Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect.
