RESOLUTION NO. 6271
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND AUTHORIZING THE EXECUTION
OF AN AGREEMENT TO PAVE 52ND STREET BY AND
BETWEEN THE CITY OF VERNON AND THE CITY OF
HUNTINGTON PARK
WHEREAS, the City of Vernon proposes to repave 52nd Street
Santa Fe Avenue to Pacific Boulevard (hereinafter "project");
WHEREAS, the City of Vernon has prepared plans and
specifications and is willing to inspect and administer the Project
with the total cost to Huntington Park being estimated at Nineteen

Thousand Dollars ($19,000.00) for the portion of the paving within
the City of Huntington Park; and

WHEREAS, Huntington Park has reviewed the plans and
14
specifications submitted concurrently herewith and will issue a no-
15
fee permit to the City of Vernon for the project.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are

true and correct.

SECTION 2: The City Council of the City of Vernon
approves the Agreement, a copy of which has been presented to the
23
City Council concurrently with this resolution, and the City Council
24
hereby orders said Agreement to be received and filed by the City
25
Clerk.

SECTION 3: The City Council of the City of Vernon hereby
authorizes the Mayor and the City Clerk to execute said Agreement
for, and on behalf of, the City of Vernon.

SECTION 4: The City Clerk of the City of Vernon shall
2 certify to the passage of this resolution, and thereupon and
3 thereafter the same shall be in full force and effect.
4 APPROVED AND ADOPTED this 15th day of June, 1993.

THIS AGREEMENT, is made and entered into and executed
in duplicate originals, either copy of which may be
considered and used as the original hereof for all purposes,
as of the 21st day of June , 1993.

(hereinafter referred
to as "Vernon")
AND
THE CITY OF HUNTINGTON
PARK, a Municipal
Corporation of the state
of California, whose City
Hall address is 6550
Miles Avenue, Huntington
Park, California, 90255
(hereinafter referred to
as "Huntington park")
RECITALS
WHEREAS, Vernon proposes to repave 52nd Street from
Santa Fe Avenue to Pacific Boulevard, the northerly half of
which is in the City of Vernon and the southerly half of
which is in the City of Huntington Park, and hereinafter
referred to as the "Project": anq
WHEREAS, Vernon has prepared plans and specifications
and is willing to inspect and administer the Project with
the total cost to Huntington Park being estimated at
Nineteen Thousand Dollars ($19,000.00) for the construction
portion of the Project within the city of Huntington Park;

28 WHEREAS, Huntington Park is willing to fund the

construction portion of the Project within the city of
Huntington Park; and
WHEREAS, Huntington Park has reviewed and approved the
plans, specifications, and construction cost estimates.
NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS:
SECTION 1: The foregoing recitals are true and correct
and constitute valid consideration for this agreement.
SECTION 2: Vernon agrees:
a. To furnish and pay the following costs of the
Project:
(1) preparation of such plans, specifications and
construction cost estimates.
(2) Inspection
(3) contract administration
(4) Construction survey
(5) The balance of'the construction costs for the
project.
b. To advertise the project for construction bids, to
award the contract to the lowest responsible bidder, to do
all things necessary and properly to complete the project,
and to act on behalf of Huntington Park in all negotiations
pertaining thereto.
c. To have the Project constructed substantially in
compliance with the plans and specifications as approved by
the city of Huntington Park.
d. To notify Huntington Park of any unforeseen
circumstances that may occur during the course of
construction and obtain the Huntington Park city Engineer's

1 concurrence on any significant departure from ordinary
2 contract administration requirements.

To hold Huntington Park harmless to the maximum
extent permitted by law, with respect to any and all claims
for personal injury, property damage, or any other claim
whatsoever which may arise as a result of the construction
7 of the Project.

SECTION 3: Huntington Park agrees:
a. To issue a no fee permit for the project.
b. Upon completion of the Project, to pay for
construction of the portion of the project within Huntington
Park.
c. After completion of the Project, to maintain that
portion of 52nd street within the city of Huntington Park.
IN WITNESS WHEREOF, the parties hereto have caused this
Agreement to be executed or caused to be executed by their
respective officers, duly authorized, as of this date, month
and year first written above.
