Resolution No. 6285 ) 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 6285 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A VARIANCE TO PAULITH U.S.A., FROM SECTION 26.4.2-8 DEVELOPMENT STANDARDS, OF THE COMPREHENSIVE ZONING ORDINANCE, FOR PROPERTY LOCATED AT 4201 DISTRICT BLVD. IN THE CITY OF VERNON WHEREAS, Paulith U.S.A. has applied for a certificate of occupancy for a building which requires a variance from Section 26.4.2-8, Development Standards, of the Comprehensive Zoning Ordinance, for the property located at 4201 District Blvd.; and WHEREAS, the physical condition of the property is unique in that the existing building measuring approximately 6,500 square feet was constructed with one nonconforming truck dock measuring 10.0 feet in width, and 53.2 feet in length; and WHEREAS, Paulith U.S.A. operates the building as a warehouse facility, and Zoning Ordinance Section 24.4.2-7 requires one truck loading space for buildings with a gross floor area of less than 8,000 square feet; and WHEREAS, Zoning Ordinance Section 26.4.2-8 specifies that each loading space shall be a minimum of 10 feet wide and 65 feet long, and Section 26.4.6-4 (c) provides that a nonconforming building must comply with these standards with any changes in occupancy unless a variance is granted; and WHEREAS, the application of the development standards for the loading space requirements will create an unreasonable hardship by requiring the one nonconforming space to be 10 feet wide and 65 feet long; and 1 ~ . 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 ~ ~ 24 25 26 27 28 WHEREAS, Paulith U.S.A. has indicated that it has no plans to expand or alter the building configuration and that the existing truck loading space is sufficient for the intended use; and WHEREAS, 4201 District Blvd. is located in the M zone and the operation is consistent with the objectives of the General Plan and Zoning Ordinance; and WHEREAS, the City Council of the City of Vernon held a hearing on said application for a variance on July 6, 1993. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS; SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained herein- above are true and correct. SECTION 2: A variance from section 26.4.2-8, Development Standards of the Comprehensive Zoning Ordinance, requiring all truck loading spaces to be 10 feet wide by 65 feet long is hereby granted to Paulith U.S.A. at 4201 District Blvd. SECrION 3: The variance shall be granted subject to the following condition: the usage of the 53.2 foot-long loading space shall be limited to vehicles with a maximum length of 53.0 feet. SECTION 4: Noncompliance with this condition shall constitute sufficient grounds for the City Council of the City of Vernon to void this variance and require the application of the authorized truck loading space requirement. 2 .- - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 5: The City Clerk of the City of Vernon shall certify to the passage of this Resolution and thereupon and thereafter the same shall be in full force and effect.
