RESOLUTION NO. 6318
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
LOS ANGELES COATING, FROM SECTION 26.4.2-8
DEVELOPMENT STANDARDS, OF THE
COMPREHENSIVE ZONING ORDINANCE, FOR
PROPERTY LOCATED AT 4727 49th STREET
IN THE CITY OF VERNON
WHEREAS, Los Angeles Coating has applied for a
certificate of occupancy for a building which requires a
variance from Section 26.4.2-8, Development Standards, of the
Comprehensive Zoning ordinance, for the property located at 4727
49th Street; and
WHEREAS, the physical condition of the property is
unique in that the existing building measuring approximately
11,800 square feet was constructed with two nonconforming docks
measuring 9.0 feet in width, and 42.0 feet in length; and
WHEREAS, Los Angeles coating uses the building for
silkscreening printing, and Zoning Ordinance section
26.4.2-7 requires two truck loading spaces for buildings with a
gross floor area of between 8,001 and 25,000 square feet in
19 size; and
20 WHEREAS, Zoning Ordinance section 26.4.2-8 specifies
21 that each loading space shall be a minimum of 10 feet wide and
22 65 feet long, and section 26.4.6-4 (c) provides that a
23 nonconforming building must comply with these standards with
24 any changes in occupancy unless a variance is granted; and
25 WHEREAS, the application of the development
26 standards for the loading space requirements will create an
27 unreasonable hardship by requiring the two nonconforming spaces

12 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
13 THE CITY OF VERNON AS FOLLOWS;
SECTION 1: The City Council of the City of Vernon
14
hereby finds and determines that the recitals contained herein-
15
above are true and correct.

SECTION 2: A variance from Section 26.4.2-8,
17
Development Standards of the Comprehensive Zoning Ordinance,
18
requiring all truck loading spaces to be 10 feet wide by 65
19
feet long is hereby granted to Los Angeles Coating at 4727
20
49th Street.

SECTION 3: The variance shall be granted subject to
22
23 the following condition: the usage of the two 42.0 foot-long
loading space shall be limited to vehicles with a maximum
24
25 length of 41.0 feet.
26 SECTION 4: Noncompliance with this condition shall
constitute sufficient grounds for the City Council of the City
27
of Vernon to void this variance and require the application of
28
to be 10 feet wide and 65 feet long; and
WHEREAS, Los Angeles Coating has indicated that it has
no plans to expand or alter the building configuration and
that the existing truck loading spaces are sufficient for the
intended use; and
WHEREAS, 4727 49th Street is located in the M zone
and the operation is consistent with the objectives of the
General Plan and Zoning Ordinance; and
WHEREAS, the City Council of the City of Vernon held
a hearing on said application for a variance on September 21,
1993.

SECTION 5:
The city Clerk of the city of Vernon shall
3 certify to the passage of this Resolution and thereupon and
4 thereafter the same shall be in full force and effect.
