A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON AMENDING SECTIONS 6 AND 22, SUBSECTIONS
(a), (c), (d) AND (n) ON PAGES 7, 28, 29, 30 AND
33, AND ADDING SUBSECTION (o) TO SECTION 22 ON
PAGE 33 OF RESOLUTION NO. 6277, WHICH FIXED THE
COMPENSATION FOR CERTAIN EMPLOYEES OF SAID CITY
AND AUTHORIZED CERTAIN EXPENSE ALLOWANCES

WHEREAS, Resolution No. 6277 was adopted by the City

Council of the City of Vernon on June 30, 1993, to be effective on
9
July 1, 1993; and

WHEREAS, the City Council of the City of Vernon adopted
11
Resolution 6258 on October 5, 1993, which approved a Second Side
12
Letter Agreement between the Municipal Employees Relations
13
Representative and the Vernon Police Officers' Benefit Association
14
providing for the continuation of the 4/10 plan and extending the
15
Memorandum of Understanding previously adopted by Resolution No.
16
17
5489 on March 15, 1988, as amended by a Side Letter Agreement
adopted by Resolution No. 6001 on January 21, 1992, until August
18
31, 2001; and
19
WHEREAS, the City Council of the City of Vernon desires
20
21
to amend sections 6 and 22, subsections (a), (c), (d) and (n), and
add subsection (o) to section 22 of Resolution No. 6277 in order
22
to comply with the Second Side Letter Agreement.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
24
CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon does
hereby find and determine that the recitals contained hereinabove
27
are true and correct.

SECTION 2: sections 6 and 22, subsections (a), (c), (d)
2
and (n), on pages 7, 28, 29, 30 and 33 of Resolution No. 6277 are
hereby amended, and subsection (o) is hereby added to section 22

on page 33 of Resolution No. 6277 as indicated on Exhibit "A",
5
which is attached hereto and made a part hereof.
SECTION 3: In all other respects, Resolution No. 6277

shall remain in full force and effect and the provisions in
8
Resolution No. 6277 not consistent with or in conflict with this
9
Resolution are hereby repealed.
10
SECTION 4: The city Clerk of the City of Vernon shall
11
certify to the passage of this resolution and thereupon and
12
thereafter the same shall be in full force and effect.

Section 6 on page 7, lines 7 through 22 of Resolution No.
6277 is hereby amended to read as follows:
SECTION 6:
PERS CONTRIBUTIONS.
That the salaries, benefits and other expense allowances
as set forth herein are hereby approved and said salaries,
benefits and other expense allowances shall be in full force and
effect from and after July 1, 1993, unless where otherwise
specified. The City shall continue to make payments to PERS to
satisfy all employee's obligation to make contributions to PERS
for retirement benefits, which includes Police Sergeants and
Police Officers in the Police Department. Payments made by City
on behalf of said employees shall be credited to said employees
account with PERS. With respect to Police Sergeants and Police
Officers, the City will pay nine percent (9%) of their salaries
for the employee's personal retirement contribution in addition to
the normal employer contribution commencing September 19, 1993.
2. Section 22, subsections (a), (c), (d) and (n) on pages
28, 29, 30 and 33 of Resolution No. 6277 are hereby
amended to read as follows:

POLICE DEPARTMENT:

(a)
For purposes of this resolution, all of the provisions in
the MOU dated March 1, 1988, adopted by the City Council of the
City of Vernon on March 15, 1988, pursuant to Resolution No. 5489,
as extended by a Side Letter Agreement effective October 6, 1991

approved by the City Council of the City of Vernon on January 21,
1992, pursuant to Resolution No. 6001, and Second Side Letter
Agreement approved by the City Council of the City of Vernon on
October 5, 1993 pursuant to Resolution No. 6258 are referenced
herein as though fully set forth at length.
(c) Court Appearances.
Employees in the classifications represented by the
Police Association in Group 2 shall be compensated for court
appearances in the line of duty outside regular scheduled duty
hours as follows:
(I) Half Court Day Appearance.
Sixty-Five Dollars ($65.00) for an appearance which
requires the employee's presence for half a court day or less;
(2) Full Court Day Appearance.
Hundred Fifteen Dollars ($115.00) for an appearance which
requires the employee's presence for full court day or less, but
more than a half court day;
(3) Half Court Day Defined.
An employee shall be deemed to have served a full court
day appearance if the employee is required to appear at the
morning session of the court and has to return on the same day
after the noon recess of the court.
( 4) Overtime.
Court appearances which extend beyond an employee's
normal shift assignment shall be compensated as paid overtime
unless said paid overtime exceeds Sixty-Five Dollars ($65.00) in

18 The City Council hereby continues the experimental 4/10
19 Plan for approved employees which was established on October 6,
20 1991, by Resolution No. 6001 adopted on January 21, 1992, as
21 amended by the Second Side Letter Agreement adopted by Resolution
22 No. 6258 on October 5, 1993, in accordance with the provisions
23 specified therein.
24 3. Section 22, subsection (o) on page 33 of Resolution No.
25 6277 is hereby added to read as follows:
26 (o) Court Appearance and Standby Pay Adjustments.

which event said employee shall receive the sole sum of Sixty-Five
Dollars ($65.00) as court appearance compensation.
(d)
Standby Status.
In addition, Police Sergeants and Police Officers shall
be compensated for standby status as follows:
(I)
Half Court Day.
Twenty Dollars ($20.00) for half a court day ending at

Full Court Day.
Forty Dollars ($40.00) for a full court day;
(3) Appearance Compensation.
However, if said employee is required to appear in court,
he/she shall receive court appearance compensation rather than
standby compensation.

Experimental 4/10 Plan.

by" pay shall be adjusted yearly beginning on September 1, 1994
through September 1, 2000, to reflect the increase, if any, in the
cost of living by adding to such basic fee an amount obtained by
multiplying the fee by the percentage by which the level of the
Consumer Price Index for the Los Angeles/Long Beach Metropolitan
Area, as reported for the last day of such annual period {such
annual period shall be July 1 through June 30 of the prior fiscal
year} by the Bureau of Labor statistics of the united states
Department of Labor, has increased over its level as of July 1,
1993, and each succeeding July 1 thereafter.
