Resolution No. 6340 1 2 3 4 5' 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 6340 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A CONDITIONAL USE PERMIT TO SHANE FREIGHT SYSTEMS, INC. FOR THE OPERATION OF A TRUCK AND FREIGHT TERMINAL AT 2634 26TH STREET WHEREAS, Shane Freight Systems has applied for a conditional use permit to operate a truck and freight terminal at 2634 26th Street; and WHEREAS, the City Council of the City of Vernon held a hearing on said application for a conditional use permit on November 2, 1993; and WHEREAS, the proposed site is a non-conforming use in the General Industry (M) Zone which has been continuously used as a truck and freight terminal, and requires a conditional use permit under the Zoning Ordinance in order to continue the use; and WHEREAS, the proposed site is adequate in size, shape and topography for the proposed operation, has adequate drainage, and a masonry wall or landscaping has been installed where parking areas adjoin a public street pursuant to the Vernon City Code; and WHEREAS, the proposed site is surrounded by industrial uses compatible with the proposed use and no adverse effect from traffic, parking, noise, odors, dust, smoke, light or glare, or risk of fire, infection or explosion is anticipated from the proposed operation; and WHEREAS, the site has access to 26th Street and in general traffic will travel from the site on 26th Street to either Santa Fe Avenue or Soto Street, thence north to 1 1 freeway access. The streets to be utilized within the City 2 of Vernon are sufficient to handle the traffic generated 3 from the proposed operations; and 4 WHEREAS, the site is required to have adequate 5 offstreet parking and loading facilities in accordance with 6 the Vernon City Code; and 7 WHEREAS, the conditions imposed on the conditional 8 use permit will adequately protect the public health, safety 9 and general welfare and the operation is consistent with all 10 applicable rules and laws of the City of Vernon; and 11 WHEREAS, the proposed use as to location, 12 operation, and design is consistent with the General Plan 13 and the Zoning Ordinance of the City of Vernon; and 14 WHEREAS, the project was found to be categorically 15 exempt from the California Environmental Quality Act as an 16 existing facility pursuant to Section 15301 of the 17 California Environmental Quality Act Guidelines and a Notice 18 of Exemption shall be filed with the County Clerk per 19 Section 15062 of the California Environmental Quality Act 20 Guidelines. 21 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL 22 OF THE CITY OF VERNON AS FOLLOWS: 23 SECTION 1: The City Council of the City of Vernon 24 hereby finds and determines that the recitals contained 25 hereinabove are true and correct. 26 SECTION 2: In order to adequately protect the 27 public health, safety and general welfare the following 28 conditions are imposed: 2 1 a. The facility shall be operated in accordance 2 with, and made to conform with all current codes, rules, 3 regulations and subject to permit fees as adopted by the 4 City of Vernon. The facility shall be operated in a manner 5 that will prevent unsanitary conditions, odors or other 6 nuisances. Prior to occupancy a business license and 7 occupancy permit shall be obtained. All trucking 8 operations, including truck and trailer parking, shall be 9 limited to the lot located at 2634 26th street. 10 b. A hazardous materials inventory and 11 business/contingency plan shall be submitted and a hazardous 12 materials permit shall be obtained from the City of Vernon 13 Health Department. Hazardous materialslwastes shall be 14 handled and managed in compliance with all appropriate 15 federal, state and local laws. 16 c. All parking and loading facilities shall be 17 paved with a hard durable surface material and shall be 18 adequately drained, and kept free of dust, mud, trash or 19 weeds. 20 21 22 23 24 25 26 27 28 d. Servicing of vehicles including washing, steam cleaning and repairing shall be performed in facilities in compliance with appropriate codes. e. A National Pollutant Discharge Elimination System Permit shall be obtained from the California State Board of Water Resources. f. No equipment or freight shall be stored on the site, other than in trailers or on the docks. Adequate plans and materials must be available for handling leaks or 3 1 spills from vehicles during storage or transportation. 2 g. The underground storage tank leak detection 3 monitoring systems shall be checked and certified by a 4 qualified leak detection service company. Underground tank 5 and monitoring systems must meet the requirements of 6 Ordinance No. 944 or a certificate of closure for removal of 7 the underground storage tanks must be obtained from the City 8 of Vernon Health Department. If the underground storage 9 tanks remain in operation an Underground storage Tank Health 10 Permit must be obtained in the name of the occupant from the 11 City of Vernon Health Department. 12 h. All required federal, state, local and 13 regulatory agency permits shall be obtained prior to 14 operation. 15 i. The facility's buildings shall be structurally 16 maintained to exclude rodents and the property shall be 17 maintained rodent free. 18 SECTION 3: Subject to the conditions set forth 19 above, the conditional use permit is granted to Shane 20 Freight Systems, Inc. for the operation of a truck and 21 freight terminal at 2634 26th Street. 22 23 24 25 26 III 27 III 28 III 4 1 SECTION 4: The City Clerk of the City of Vernon 2 shall certify to the passage of this resolution and 3 thereupon and thereafter the same shall be in full force and 4 effect. 5 6 1993. 7 8 9 ATTEST: 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 APPROVED AND ADOPTED this 2nd day of November, ~/c<~~ TOMAS A. Place: Vernon City Hall City Council Chambers 4305 Santa Fe Avenue Vernon, CA 90058 Time: Tuesday, November 2, 1993 at 5:00 p.m. Applicant: Shane Freight systems The purpose of the hearing is to obtain testimony from affected and/or interested persons regarding this application. The public is also invited to submit written comments regarding the request prior to the Hearing. Request: Grant a conditional use permit to allow the applicant to operate a truck and freight terminal.
