A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING THE APPLICATION OF OWENS-
BROCKWAY TO RECEIVE ELECTRIC SERVICE UNDER THE
CITY'S ELECTRIC RATE SCHEDULE NO. "LEAP" FOR THE
ELECTRICAL BOOSTING SYSTEM DESCRIBED IN THE
APPLICATION

WHEREAS, the City Council of the City of Vernon adopted
8
Resolution No. 6228 on March 23, 1993, which amended Resolution
9
No. 5760, to adopt a Low Emission Assistance Program ("LEAP"); and
10

WHEREAS, Owens-Brockway with a facility located at 2901
Fruitland Avenue in Vernon, has been required by Rule 1117 of the
12
South Coast Air Quality Management District to reduce nitrogen
oxide emissions and installed an electrical boosting system in
13
14

February 1993 in order to comply with said rule; and
WHEREAS, Owens-Brockway has submitted a LEAP application
to the city dated December 2, 1993, requesting service under Rate
Schedule No. LEAP; and
WHEREAS, the Light and Power Department has reviewed the
19
application and has determined that the proposed system meets all
20
LEAP program requirements.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon does
24
hereby find and determine that the recitals contained hereinabove
25
are true and correct.

SECTION 2: The City Council of the city of Vernon hereby
27 approves the LEAP application of Owens-Brockway to receive
28 electric service under Rate Schedule No. LEAP. A copy of the

application dated December 2, 1993, has been filed with the Light
2
and Power Department.

SECTION 3: The commencement of service under Rate
4
Schedule No. LEAP is contingent upon Owens-Brockway passing a
5
6
final installation inspection which will determine whether the
electrical boosting system is substantially in conformance with
7
the project plan as set forth in the application form.
SECTION 4: The service under Rate Schedule No. LEAP will
8
9
continue from the date of this resolution until thirty-six (36)
10
11
months from the actual date of the installation, and said rate
schedule shall not be applied retroactively.
12
SECTION 5: The City Clerk of the City of Vernon shall
13
certify to the passage of this resolution, and thereupon and
14
thereafter the same shall be in full force and effect.

APPROVED AND ADOPTED this 7th day of December, 1993.
