RESOLUTION 6385
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON, CALIFORNIA PROVIDING FOR THE APPOINTMENT
TO THE OFFICES OF THIS CITY THAT WERE TO BE
ELECTED ON TUESDAY, APRIL 12, 1994
WHEREAS, Ordinance No. 1019 of the City of Vernon and
Section 22843.5 of the Elections Code of the State of California,
authorize the appointment of the nominees for office in a City of
Vernon municipal election if the election is uncontested; and
WHEREAS, as of 5:00 p.m. on February 7, 1994, only one
person was nominated for each of the three elected offices to be
elected in this City, said nominees consisting of Leonis C. Malburg,
Thomas A. Ybarra, and William M. McCormick; and
WHEREAS, Section 22843.5 of the Elections Code allows one
of the following courses of action to be taken by the City Council:
1. Appoint to an office the person who has been nominated;
2. Appoint to an office any eligible voter if no one has
been nominated;
3. Hold the election if either no one or only one person
has been nominated; and
WHEREAS, a notice was published on February 8, 1994, in a
newspaper of general circulation pursuant to law; and
WHEREAS, section 22843.5 of the Elections Code provides
that said appointments shall be made "after the fifth day following
the date of posting or publication" and Ordinance No. 1019 provides
that said appointments shall be made "by the 50th day before the
municipal election;" and
WHEREAS, February 14 to 21, 1994, are the dates which
satisfy those requirements.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
2 CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon hereby
4 finds and determines that the recitals contained hereinabove are
5 true and correct.

SECTION 2: Pursuant to Ordinance No. 1019 of the City of
7 Vernon and section 22843.5 of the Elections Code of the State of
8 California, the following persons are hereby appointed to the
9 offices to which they were nominated:

l2 THOMAS A. YBARRA Member of the City Council Four Years
l3 WILLIAM M. MCCORMICK Member of the City Council Four Years

SECTION 3: The election scheduled to be held on Tuesday,
l5 April l2, 1994, is hereby cancelled.

SECTION 4: The persons appointed shall qualify and take
l7 office and serve exactly as if elected at a municipal election for
l8 the off ice.

SECTION 5:
The City Clerk of the City of Vernon shall
20 certify to the passage of this resolution and thereupon, and
21 thereafter the same shall be in full force and effect.
