Resolution No. 6400 .. RESOLUTION NO. 6400 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A VARIANCE TO SANDBERG FURNITURE MFG. CO. INC., FROM SECTION 26.4.2-8 DEVELOPMENT STANDARDS, OF THE COMPREHENSIVE ZONING ORDINANCE, FOR PROPERTY LOCATED AT 5705 ALCOA AVENUE IN THE CITY OF VERNON WHEREAS, Sandberg Furniture Mfg. Co., Inc. occupies a building which requires a variance from section 26.4.2-8, Development Standards, of the Comprehensive Zoning Ordinance, for the property located at 5705 Alcoa Avenue; and WHEREAS, the physical condition of the property is unique in that the existing building measuring approximately 52,000 square feet was constructed with one conforming truck loading space and three non-conforming truck loading spaces measuring 10.0 feet in width and 50.1 feet in length; and WHEREAS, Sandberg Furniture Mfg. Co., Inc. uses the building for furniture manufacturing, and Zoning Ordinance section 26.4.2-7 (b) requires four truck loading spaces for buildings with a gross floor area of between 50,001 and 100,000 square feet in size; and WHEREAS, Zoning Ordinance section 26.4.2-8 specifies that each loading space shall be a minimum of 10 feet wide and 65 feet long, and section 26.4.6-4 (c) provides that a non-conforming building must comply with these standards within 5 years of April 18, 1989 unless a variance is granted; and WHEREAS, the application of the development standards for the truck loading space requirements will create a unreasonable hardship by requiring the three non-conforming 1 " ~ spaces to be 10 feet wide and 65 feet long; and WHEREAS, sandberg Furniture Mfg. Co., Inc. ("Applicant") has applied for a variance and has indicated that it has no plans to expand or alter the building use; and WHEREAS, the truck loading spaces can be lengthened by modifying the exterior docks so that trucks parked at the loading docks will not extend into the street right-of-way; and WHEREAS, 5705 Alcoa Avenue is located in the M zone and the operation is consistent with the objectives of the General Plan and Zoning Ordinance; and WHEREAS, the existing street right-of-way on Alcoa Avenue is 50 feet and the Master Plan of Streets, dated June 16, 1992 requires the right-of-way to be widened 5 feet on each side to a total of 60 feet; and WHEREAS, the City Council of the City of Vernon held a hearing on said application for a variance on April 5, 1994. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained herein- above are true and correct. SECTION 2: A variance from section 26.4.2-8, Development Standards of the Comprehensive zoning Ordinance, requiring all truck loading spaces to be 10 feet wide by 65 feet long is hereby granted to Sandberg Furniture Mfg. Co. Inc., at 5705 Alcoa Avenue. SECTION 3: The variance shall be granted subject to 2 . 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 ~ 23 24 25 26 27 28 the following conditions: (a) the usage of the truck loading spaces shall be limited so that no truck parked at the loading docks shall extend into the street right-of-way as it existed on the date of this resolution; (b) the exterior portion of the loading docks shall be removed and prior to modification Applicant shall obtain all of the necessary permits from the City of Vernon; (c) when the street right-of-way is scheduled to be widened to comply with the Master Plan of streets, dated June 16, 1992, Applicant shall dedicate the necessary street right-of-way to the City of Vernon at no cost and the usage of the truck loading spaces shall be limited so that no truck parked at the loading docks shall extend into the new street right-of-way or the docks shall be recessed to comply with the Comprehensive Zoning Ordinance, section 26.4.2-8 (c). SECTION 4: Noncompliance with any of these conditions shall constitute sufficient grounds for the City Council of the City of Vernon to void this variance and require the application of the authorized truck loading space requirement. SECTION 5: The City Clerk of the City of Vernon shal certify to the passage of this Resolution and thereupon and thereafter the same shall be in full force and effect. VARIANCE APPLICATION ~ Sandberg Furniture Mfg. .co., Inc. has requested a variance from the Comprehensive Zoning Ordinance, section 26.4.2-8, Development Standards, for the property located at 5705 Alcoa Avenue in the City of Vernon. The building that they occupy was constructed with one conforming truck loading space and three non-conforming truck loading spaces measuring 10.0 feet in width and 50.1 feet in length. Sandberg Furniture Mfg. Co., Inc. has stated they intend to modify the exterior docks such that their trucks will not extend into the street right-of-way. The building is used for furniture manufacturing. section 26.4.2-8 (c) of the Comprehensive Zoning Ordinance specifies that each truck loading space shall be a minimum of 10 feet wide and 65 feet long and Section 26.4.6-4 (c) provides that a non-conforming building must comply with these standards within 5 years of April 18, 1989 unless a variance is granted. Sandberg Furniture Mfg. Co., Inc. has indicated that requiring the non-conforming truck loading spaces to be 65 feet long by 10 feet wide would be a hardship. They have indicated that they have no plans for expansion or alteration of the building use. Their operation is in conformance with the Zoning Ordinance and General Plan. Therefore, it is recommended that the variance be granted subject to with the following conditions: (a) the usage of the truck loading spaces be limited so that no truck parked at the loading docks shall extend into the street right- Of-way as it existed on the date of the resolution; (b) the exterior portion of the loading docks shall be removed and prior to modification Applicant shall obtain all of the necessary permits from the City of . Vernon; (c) when the street right-of-way is scheduled to be widened to comply with the Master Plan of streets, dated June 16, 1992, Applicant shall dedicate the necessary street right-of-way to the City of Vernon at no~cost and the usage of the truck loading spaces shall be limited so that no truck parked at the loading docks shall extend into the new street right-of-way or the docks shall be recessed to comply with the Comprehensive Zoning Ordinance, section 26.4.2-8 (c).
