Resolution No. 6410 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 6410 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A VARIANCE TO HI POINT INDUSTRIES, INC., FROM SECTION 26.4.2-8 DEVELOPMENT STANDARDS, OF THE COMPREHENSIVE ZONING ORDINANCE, FOR THE PROPE~TY LOCATED AT 4767 49TH STREET IN THE CITY OF VERNON WHEREAS, Hi Point Industries, Inc. occupies a building which requires a variance from section 26.4.2-8, Development Standards, of the Comprehensive Zoning Ordinance, for the property located at 4767 49th street; and WHEREAS, the physical condition of the property is unique in that the existing building measuring approximately 14,000 square feet was constructed with one conforming truck loading space and two non-conforming truck loading spaces measuring 8.75 feet in width and 41.4 in length; and WHEREAS, Hi Point Industries, Inc. uses the building for food product manufacturing, and Zoning Ordinance Section 26.4.2-7 (b) requires two truck loading spaces for buildings with a gross floor area of between 8,001 and 25,000 square feet in size; and WHEREAS, Zoning Ordinance Section 26.4.2-8 (c) specifies that each truck loading space shall be a minimum of 10 feet wide and 65 feet long, and Section 26.4.6-4 (c) provides that a non-conforming building must comply with these standards within 5 years of April 18, 1989 unless a variance is granted; and WHEREAS, the application of the development standards for the truck loading space requirements will create a 1 ~ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 ~ 24 25 26 27 28 SECTION 4: Noncompliance with this condition shall 2 1 constitute sufficient grounds for the City Council of the City 2 3 4 5 6 7 8 9 10 11 12 13 '" of Vernon to void this variance and require the application of the authorized truck loading space requirement. We also own building adjacent to 4767 East 49th Street. It is 4755 East 49th Street. VARIANCE APPLICATION j71v f Hi Point Industries, Inc. has requested a variance for the property located at 4767 49th street in the city of Vernon. The building that they occupy was constructed with one conforming truck loading space and two non-conforming truck loading spaces measuring 8.75 feet in width and 41.4 feet in length. Hi Point Industries, Inc. has stated that only vehicles of smaller lengths will be used at the non-conforming truck loading spaces. The building is used for food product manufacturing and is approximately 14,000 square feet. Section 26.4.2-8 (c) of the comprehensive Zoning Ordinance specifies that each truck loading space shall be a minimum of 10 feet wide and 65 feet long and section 26.4.6-4 (c) provides that a non-conforming building must comply with these standards within 5 years of April 18, 1989 unless a variance is granted. Hi Point Industries, Inc. has indicated that requiring the non- conforming truck loading spaces to be 65 feet long by 10 feet wide would be a hardship. They have indicated that they have no plans for expansion or alteration of the building configuration. Their operation is in conformance with the Zoning Ordinance and General Plan. Therefore, it is recommended that the variance be granted with the condition that usage of the truck loading spaces be limited so that no truck parked at the loading docks shall extend into the street right-of-way as shown on the Master Plan of Streets, dated June 16, 1992. l
