Resolution No. 6412 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 ~ ~ 24 25 26 27 ~ RESOLUTION NO. 6412 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A VARIANCE TO FEIT ELECTRIC COMPANY, FROM SECTIONS 26.4.2-7 AND 26.4.2-8, OF THE COMPREHENSIVE ZONING ORDINANCE, FOR THE PROPERTY LOCATED AT 2042 VERNON AVENUE IN THE CITY OF VERNON WHEREAS, Feit Electric Company occupies a building which requires a variance from sections 26.4.2-7, Minimum Truck Parking and Loading Facility Requirements and 26.4.2-8, Development Standards, of the Comprehensive Zoning Ordinance, for the property located at 2042 Vernon Avenue; and WHEREAS, the physical condition of the property is unique in that the existing building measuring approximately 80,000 square feet was constructed with one conforming truck loading space and two non-conforming truck loading spaces measuring 10.0 feet in width and 60.0 feet in length; and WHEREAS, Feit Electric Company uses the building for manufacturing and distribution of light fixtures, and Zoning Ordinance Section 26.4.2-7 (b) requires four truck loading spaces for buildings with a gross floor area of between 50,001 and 100,000 square feet in size; and WHEREAS, Zoning Ordinance section 26.4.2-8 (c) specifies that each truck loading space shall be a minimum of 10 feet wide and 65 feet long, and Section 26.4.6-4 (c) provides that a non-conforming building must comply with these standards within 5 years of April 18, 1989 unless a variance is granted; and WHEREAS, the application of the development 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 standards for the truck loading space requirements will create an unreasonable hardship by requiring the two non-conforming spaces to be 10 feet wide and 65 feet long; and WHEREAS, Feit Electric Company ("Applicant")has indicated that it has no plans to expand or alter the building configuration and that the existing truck loading spaces are sufficient for the intended use; and WHEREAS, 2042 Vernon Avenue is located in the M zone and the operation is consistent with the objectives of the General Plan and Zoning Ordinance; and WHEREAS, the existing street right-of-way on Vernon Avenue is 60 feet and the Master Plan of Streets, dated June 16, 1992 requires the right-of-way to be widened 7 feet on each side to a total of 74 feet; and WHEREAS, the additional 7 feet of right-of-way is currently used as sidewalk; and WHEREAS, the City council of the City of Vernon held a hearing on said application for a variance on April 26, 1994. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the city of Vernon hereby finds and determines that the recitals contained herein- above are true and correct. SECTION 2: A variance from Section 26.4.2-7, Minimum Truck Parking and Loading Facility Requirements of the Comprehensive Zoning Ordinance, requiring four truck loading spaces for buildings with a gross floor area of between 50,001 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 and 100,000 square feet in size and from section 26.4.2-8, Development Standards of the Comprehensive Zoning Ordinance, requiring all truck loading spaces to be 10 feet wide by 65 feet long is hereby granted to Feit Electric Company at 2042 Vernon Avenue. SECTION 3: The variance shall be granted subject to the following conditions: (a.) the usage of the truck loading spaces shall be limited so that no truck parked at the loading docks shall extend into the street right-of-way as shown on the Master Plan of Streets, dated June 16, 1992; (b.) to comply with the Master Plan of Streets, dated June 16, 1992, Applicant shall dedicate the necessary street right-of-way to the City of Vernon, at no cost, which is the portion of property on Vernon Avenue currently used as sidewalk. SECTION 4: Noncompliance with these conditions shall constitute sufficient grounds for the City Council of the City of Vernon to void this variance and require the application of the authorized truck loading space requirement. SECTION 5: The City Clerk of the City of Vernon shall certify to the passage of this Resolution and thereupon and thereafter the same shall be in full force and effect. When the building was purchased my loading docks were 621 recessed into the building. A 401 trailer & tractor parked in our dock is 51 inside our building. No portion blocks public right of way - sidewalk or street I have instructed the general manager and warehouse supervisor as of this date no trucks longer than this are allowed in our loading docks. We have a loading door at the west end of our building and any trailer longer than 40' must use this side door. Further, I have instructed them that at no time public right of way can be blocked - even temporarily. NOTICE TO APPLICANT: In the variance procedure it shall be shown that the following five (5) conditions exist in reference to the property being considered. The applicant should answer the following statements. If you have difficulty finding reasonable answers to the statements contained' in this application it may be an indication that your request has insufficient factors to justify approval. (Attach additional sheet(s) if necessary) (1) That special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not generally applicable to other lands, structures, or buildings in the same vicinity and zone: PARAGRAPH 1 45th Street is only 1 block long and not heavily traveled. The properties directly across the street from our loading docks are owned by me so I inconvenience no one. It is very expensive to break into ourwarehouse floor to recess the docks an extra three feet and when I bought the building the docks were considered adequate. The business interruption for this work would be severe. I know of no other building in my area that has similar problems or special conditions. (2) That literal interpretation ~f the provisions of this ordinance would deprive the applicant of rignts commonly enjoyed by other properties in the same vicinity and zone in which the property is located, under the terms of this Chapter. PARAGRAPH 2 The literal interpretation of this ordinance would force me to spend a lot of money in renovating my docks and the business interruption would be unbearable. There are only 2 other businesses on this street and they generally access via Hawthorne Ave. I know of no other building in my area that would be forced to spend such sums of money and business interruption to comply. I am the only one. As long as I c~n comply with the intent of the ordinance - not blocking public right of way - the literal interpretation would be punitive. Malkenhorst City Administrator/City Clerk ~ ~ ~~.~~ ~. >> ps ENGINEER'S REPORT FElT ELECTRIC COMPANY VARIANCE APPLICATION Feit Electric Company has requested a variance from the comprehensive Zoning Ordinance Sections 26.4.2-7, Minimum Truck Parking and Loading Facility Requirements and 26.4.2-8, Development Standards for the property located at 2042 Vernon Avenue in the City of Vernon. The building that they occupy was constructed with one conforming truck loading space and two non-conforming truck loading spaces measuring 10.0 feet in width and 60.0 feet in length. Feit Electric Company has stated that only vehicles of smaller lengths will be used at the non-conforming truck loading spaces. The building is approximately 80,000 square feet in size and is used for manufacturing and distribution of light fixtures. Section 26.4.2-7 (b) requires four truck loading spaces for buildings with a gross floor area of between 50,001 and 100,000 square feet in size. Section 26.4.2-8 (c) of the Comprehensive Zoning Ordinance specifies that each loading space shall be a minimum of 10 feet wide and 65 feet long and Section 26.4.6-4 (c) provides that a non-conforming building must comply with these standards with any change in occupancy unless a variance is granted. Feit Electric Company has indicated that requiring the two non- conforming loading spaces to be 65 feet long by 10 feet wide and the addition of one space would be a hardship. They have indicated that they have no plans for expansion or alteration of the building configuration. Their operation is in conformance with the Zoning Ordinance and General Plan. Therefore, it is recommended that the variance be granted subject to the following conditions: (a) that usage of the truck loading space be limited so that no truck parked at the loading dock shall extend into the ~ ~ . street right-of-way as shown on the Master Plan of streets, dated June 16, 1992; and (b) to comply with the Master Plan of streets, dated June 16, 1992, Applicant shall dedicate the necessary street right-of-way to the City of Vernon, at no cost, which is the portion of property on Vernon Avenue currently used as sidewalk.
