A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
GOLD'N WEST SURPLUS, FROM SECTION
26.4.2-8 DEVELOPMENT STANDARDS, OF THE
COMPREHENSIVE ZONING ORDINANCE, FOR
THE PROPERTY LOCATED AT 4515-4535 48TH
STREET IN THE CITY OF VERNON
WHEREAS, GoldiN West Surplus occupies a building
pursuant to a temporary occupancy permit which requires a
variance from Section 26.4.2-8, Development Standards, of the
Comprehensive Zoning ordinance, for the property located at
4515-4535 48th Street; and
WHEREAS, the physical condition of the property is
unique in that the existing building measuring approximately
19,450 square feet has two conforming truck loading spaces and
two non-conforming truck loading spaces measuring 15.0 feet in
width and 29.1 feet in length; and
WHEREAS, GoldiN West Surplus uses the building for
warehousing and distribution of electronic equipment, and Zoning
Ordinance section 26.4.2-7 (b) requires two truck loading spaces
for buildings with a gross floor area of between 8,001 and 25,000
square feet in size; and
WHEREAS, Zoning Ordinance section 26.4.2-8 (c)
specifies that each truck loading space shall be a minimum of
10 feet wide and 65 feet long, and section 26.4.6-4 (c)
provides that a non-conforming building must comply with these
standards within 5 years of April 18, 1989 unless a variance is
granted; and
WHEREAS, the application of the development

standards for the truck loading space requirements will create an
unreasonable hardship by requiring the two non-conforming
spaces to be 10 feet wide and 65 feet long; and
WHEREAS, Gold'N West Surplus has indicated that it has
no plans to expand or alter the building configuration and that
the existing truck loading spaces are sufficient for the intende
use; and
WHEREAS, 4515-4535 48th Street is located in the M zon
and the operation is consistent with the objectives of the
General Plan and Zoning Ordinance; and
WHEREAS, the City Council of the City of Vernon held
a hearing on said application for a variance on April 26, 1994.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained herein-
above are true and correct.
SECTION 2: A variance from section 26.4.2-8,
Development Standards of the Comprehensive Zoning Ordinance,
requiring all truck loading spaces to be 10 feet wide by 65
feet long is hereby granted to Gold'N West Surplus at 4515-4535
48th Street.
SECTION 3: The variance shall be granted subject to
the following condition: the usage of the truck loading spaces
shall be limited so that no truck parked at the loading docks
shall extend into the street right-of-way as shown on the Master
Plan of Streets, dated June 16, 1992.

SECTION 4: Noncompliance with this condition shall
2 constitute sufficient grounds for the City Council of the City
3 of Vernon to void this variance and require the application of
4 the authorized truck loading space requireme.nt.
5 SECTION 5: The City Clerk of the city of Vernon shall
6 certify to the passage of this Resolution and thereupon and
7 thereafter the same shall be in full force and effect.

The type of bvsiness occupying the building is an electronics warehousing and distribution company.
All incoming and outgoing deliveries that will be using the loading door~ are transported by standard
commercial small trucks which do not exceed 22 feet in length. We will in no manner use trucks
that will exceed the length of the truck indentures. Therefore. we are requesting a variance for
loading under the above conditions.
NOTICE TO APPLICANT: In <thl! variance procedure it shall be shown that
the following five (5) conditions exist in reference to the property being
considered. The applicant should answer the following statements. If you
have difficulty finding reasonable answers to the statements contained in
this application it may be an indication that your request has insufficient
factors to justify approval. (Attach additional sheet(s) if necessary)
(l) That special conditions and circumstances exist which are peculiar to
the land, structure, or building involved and which are not generally
applicable to 6ther lands, structures, or buildings in the same vicinity
and zone:
The building is built on all useable land. The depth of the building is 100 feet. If a 55 foot
indenture is required for loading. the fuctional use of the building would be greatly diminished.
Also. the current loading area is in the center of the building. a 65 foot indenture would split the
building.
(2) That literal interpretation of the provisions of this ordinance would
deprive the applicant of rights commo~ly enjnyed by other properties in the
same Vicinity and zone in which the property is located, under the terms of
this Chapter. .

Literal interpretation of the ordinance would not make a difference in the loading conducted by
the type of business occupying the building. It would greatly affect the .functional use of the
building.

(3) That the special conditions and circumstances do not result from
actions of the ap~li~ant:
The lOEidinq operations COf1(1ucted by the type of business in the building will in no way
interfere with or block any public access ways. The loading uSes to this property is no
different from the loading uses of adjacent properties.
(4) That granting the variance requested will not confer on the applicant
any s p e cia I - p r i v i leg e t hat i s den i e d by t his C hap t e r too the r I and s t
structurest or buildings in the same vicinity and zone in which the property
is located: '
Several buildings in the Elrea of-the subject property are built in a similar manner. In the
same way that other businesses in the area practice lawful loading. we will abide by all
conditions granted under the variance.
(5) That the granting of such variance will be in harmony and not adversely
affect the Comprehensive Gene~al Plan:
The general plan was developed to prevent congestion in the street. All vehicles used by the
business in the building are small in type. In no way will there be any congestion caused by this
type of business on the street.. therefore on the sidewalk as well.
NOTE:
Non-conforming use of neighboring lands, structurest or buildings shall not
be considered grounds for the issuance ofa variance.

ENGINEER'S REPORT
GOLD'N WEST SURPLUS
VARIANCE APPLICATION

Gold'N West Surplus has requested a variance for the property located
at 4515-4535 48th Street in the city of Vernon. The building that they
occupy has two conforming truck loading spaces and two non-conforming
truck loading spaces measuring 15.0 feet in width and 29.1 feet in length.
Gold'N West Surplus has stated that only vehicles of smaller lengths will
be used at the non-conforming truck loading spaces. The building is used
for warehousing and distribution of electronic equipment and is
approximately 19,450 square feet.
Section 26.4.2-8 (c) of the Comprehensive zoning Ordinance specifies
that each truck loading space shall be a minimum of 10 feet wide and 65
feet long and Section 26.4.6-4 (c) provides that a non-conforming building
must comply with these standards within 5 years of April 18, 1989 unless a
variance is granted.
Gold'N West Surplus has indicated that requiring the non-conforming
truck loading spaces to be 65 feet long by 10 feet wide would be a
hardship. They have indicated that they have no plans for expansion or
alteration of the building configuration. Their operation is in
conformance with the Zoning Ordinance and General Plan. Therefore, it is
recommended that the variance be granted with the condition that usage of
the truck loading spaces be limited so that no truck parked at the loading
docks shall extend into the street right-of-way as shown on the Master
Plan of Streets, dated June 16, 1992.
RESOLUTION NO. 6413
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
GOLD'N WEST SURPLUS, FROM SECTION
26.4.2-8 DEVELOPMENT STANDARDS, OF THE
COMPREHENSIVE ZONING ORDINANCE, FOR
THE PROPERTY LOCATED AT 4515-4535 48TH
STREET IN THE CITY OF VERNON
WHEREAS, Gold'N West Surplus occupies a building
pursuant to a temporary occupancy permit which requires a
variance from Section 26.4.2-8, Development Standards, of the
Comprehensive Zoning Ordinance, for the property located at
4515-4535 48th Street; and
WHEREAS, the physical condition of the property is
unique in that the existing building measuring approximately
19,450 square feet has two conforming truck loading spaces and
two non-conforming truck loading spaces measuring 15.0 feet in
width and 29.1 feet in length; and
WHEREAS, Gold'N West Surplus uses the building for
warehousing and distribution of electronic equipment, and Zoning
Ordinance Section 26.4.2-7 (b) requires two truck loading spaces for
buildings with a gross floor area of between 8,001 and 25,000
square feet in size; and
WHEREAS, Zoning Ordinance Section 26.4.2-8 (c)
specifies that each truck loading space shall be a minimum of
10 feet wide and 65 feet long, and Section 26.4.6-4 (c)
provides that a non-conforming building must comply with these
standards within 5 years of April 18, 1989 unless a variance is
granted; and
