A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON DENYING A CONDITIONAL USE PERMIT TO ANR
FREIGHT SYSTEM, INC. FOR THE OPERATION OF A
TRUCK AND FREIGHT TERMINAL AT 3677 BANDINI
BOULEVARD

WHEREAS, ANR Freight System, Inc. applied for a

conditional use permit to operate a truck and freight terminal at
7
3677 Bandini Boulevard; and
8
WHEREAS, the City Council by Resolution No. 6291 on July
9
20, 1993 granted a conditional use permit to SERVCON-Vernon, Inc.

for the operation of a materials recovery and transfer facility at
this site; and
12
WHEREAS, the City Council of the City of Vernon held a
13
hearing on said application for a conditional use permit on April
14
26, 1994; and
15
WHEREAS, the proposed conditional use permit contained
16

the following condition:
"The previously approved conditional use
18
permit granted to SERVCON-Vernon, Inc. for the
19
materials recovery and transfer facility at
20

this site, shall be withdrawn by a
representative of SERVCON-Vernon, Inc."

WHEREAS, SERVCON-Vernon, Inc. is unwilling to allow its
conditional use permit to be withdrawn.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon

hereby finds and determines that the recitals contained

hereinabove are true and correct.

SECTION 2: The application for a conditional use permit
by ANR Freight System, Inc. for the operation of a truck and
freight terminal at 3677 Bandini Boulevard is hereby denied.

SECTION 3: The City Clerk of the City of Vernon shall

certify to the passage of this resolution, and thereupon and
7
thereafter the same shall be in full force and effect.

Gentlemen:
ANR Freight System, Inc. has received a copy of the conditions
and amendments which have been proposed to be placed on the
above-referenced use permit by the Community Services Department.
The purpose of this letter is to inform you that ANR Freight
system, Inc. management is not willing to make improvements to
the public right of way as a condition of occupancy of this
property, which it has used as a trucking terminal for forty
years, and which it merely intends to occupy on a temporary
basis.
In addition, ANR Freight system, Inc. is not in a position to
demand, nor is it inclined to request, that Serve-Con withdraw
the previously approved conditional use permit granted to that
company.

Department of Toxic Substances Control, California Environmental
Protection Agency.

ANR Freight System, Inc. was found to be categorically

In my opinion the proposed operation will pose no adverse
effects to the City of Vernon and will not have a significant
effect on the environment, and no mitigating measures are
required.

It is recommended that the City Council find that the
proposed use is categorically exempt from the California
Environmental Quality Act process.
Further it is recommended that a Notice of Exemption be
filed with the County Clerk and the conditional use permit be
granted with the following conditions:
a. The facility shall be operated in accordance with, and
made to conform with all current codes, rules, regulations and
permit fees as adopted by the City of Vernon. The facility shall
be operated in a manner that will prevent unsanitary conditions,
odors or other nuisances. Prior to occupancy a business license
and occupancy permit shall be obtained. All trucking operations,
including truck and trailer parking, shall be limited to the lot
located at 3677 Bandini Boulevard.
b. A hazardous materials inventory and business/contingency
plan shall be submitted and a hazardous materials permit shall be
obtained from the City of Vernon Health Department within the
first 30 days of occupying the site. Hazardous materials/wastes
shall be handled and managed in compliance with all appropriate
federal, state and local laws.
c. All parking and loading facilities shall be paved with a
hard durable surface material and shall be adequately drained,
and kept free of dust, mud, trash and weeds. Any damaged areas
of pavement covering the site shall be repaired prior to
occupancy.
d. Servicing of vehicles including washing, steam cleaning
and repairing shall be performed in facilities in compliance with
appropriate codes.
e. No equipment or freight shall be stored on the site,
other than in trailers or on the docks. Adequate plans and
materials must be available for handling leaks or spills from
vehicles during storage or transportation.
f. All required federal, state, local and regulatory agency
permits shall be obtained prior to operation.
g. ANR must comply with all conditions as set forth in the
Truck Terminal Cleanup Agreement, Docket No. HSA93/94-004A.
h. Where parking or maneuvering of vehicles adjoin a public
street, a 30 inch high barrier wallar 4 foot wide landscaped
area shall be established.
i. ANR Freight System, Inc. shall either construct a
traffic signal and a center median to city of Vernon standards as
shown on Exhibit "A" or provide an access point onto 26th street
for the site and eliminate all site access to Bandini Boulevard.
If the construction of the traffic signal and the median is to be

done then the work shall be completed prior to occupancy or a
bond in the amount of $100,000. shall be posted with the city
guaranteeing completion of construction.
j. Dedicate to the City of Vernon the property as shown on
Exhibit "A" for the construction of a future frontage roadway.
k. All fluorescent light ballasts shall be tested for the
presence of polychlorinated biphenyls (PCBs). Ballasts
containing PCBs shall be removed and managed as hazardous waste.

ON ANR FREIGHT SYSTEM, INC.
CONDITIONAL USE PERMIT TO OPERATE A
TRUCK AND FREIGHT TERMINAL AT 3677 BANDINI BOULEVARD
April 21, 1994
ANR Freight System, Inc. has applied for a conditional use
permit to operate a truck and freight terminal at 3677 Bandini
Boulevard in the City of Vernon. They are an interstate trucking
company providing pick-up and delivery service to customers
throughout California. There will be approximately 38 trucks
based at this facility. In the recent past ANR Freight System,
Inc. had as many as 266 employees reporting to this location. In
early 1991 they stopped operating out of this site and vacated
the premises. They are now proposing to reoccupy the site but on
a much smaller scale. They expect to have only 33 employees
based at this site.
1. GENERAL PLAN The proposed use conforms to the Zoning
Ordinance and the General Plan. The site is presently being used
as a truck and freight terminal.
2. SITE The proposed site is of adequate size and shape
for the proposed use.
3. ADVERSE AFFECT The proposed site is surrounded by
industrial uses compatible with the proposed use and no adverse
noise, odor, dust, smoke, light or glare, or risk of fire,
infection or explosion is anticipated from the proposed
operation.
4. ACCESS The site currently has access to Bandini
Boulevard which as constructed is one hundred feet (100') wide

and has adequate capacity and pavement type for the proposed
operation. However, due to the heavy traffic volume and high
speeds of vehicles traveling on Bandini Boulevard, ANR will be
required to either construct a traffic signal at their access
point on Bandini Boulevard or eliminate all access to Bandini
Boulevard and gain access to 26th street. At this location 26th
street is 40 feet wide and has adequate capacity and pavement
type for the proposed operation.
5. TROCK MOVEMENTS ANR Freight System, Inc. will operate
approximately 38 dual axle trucks out of the facility. They
expect to have up to 65 vehicle movements, including employees
vehicles, out of the site daily with the same number entering the
site. In general trucks will either travel on Bandini Boulevard
or 26th Street in an easterly direction to freeway access.
6. STATE OR FEDERAL CONDITIONS There are no conditions
imposed by State or Federal law.
7. CONDITIONS It is recommended that the following
conditions be set on the permit to adequately protect the public
interests:
a. The facility shall be operated in accordance with, and
made to conform with all current codes, rules, regulations and
permit fees as adopted by the City of Vernon. The facility shall

Freightlines, Inc. is the owner of property located at 3677 Bandini Boulevard, Vernon,

Parcel 2 of Parcel Map No. 16014, in the City of Vernon, County of Los
Angeles, State of California, as per map recorded in Book No. 168, Pages 80
and 81 of Parcel Maps, in the office of the County Recorder of Los Angeles
County, California
REQUEST: The applicant requests a CONDITIONAL USE PERMIT to use the above
described property for the following purpose:
The elected officials and employees of the City of Vernon should be well aware
of the protracted efforts of ANR Freight System, Inc. to sell the subject property
to Serv-Con, Inc. That sale will not be completed, but the property will remain
for sale. ANR Freight System, Inc. does not expect to continue to occupy the
premises after another purchaser is found.
ANR Freight System, Inc. will use the property with its existing improvements in
the same manner as it has been continually used since the mid 1950's: as a
trucking terminal facility for the distribution of general freight in intrastate and
interstate commerce. The facility will serve as the nexus for linehaul operations,
intermodal services, and local freight pickup and delivery services. Yard space
will be used for parking power units and trailers. Office space will house
supervisory, marketing, and support staff. The shop area will be used to perform
maintenance on ANR Freight System, Inc. vehicles.
BURDEN OF PROOF: The applicant shall indicate the following facts.
(1) That the site for the proposed use is adequate in size and shape;
This site has been used as trucking terminal and for no other purpose since the
mid 1950's, and has at all times been of adequate size and shape for use as
such. While as many as 226 employees reported to this location in the recent
past, ANR Freight System, Inc. expects that 33 employees will report to this
site. In addition, the volume of traffic through the terminal will be substantially
reduced compared to the prior volume.
