Resolution No. 6414 I RESOLUTION NO. 6414 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON DENYING A CONDITIONAL USE PERMIT TO ANR FREIGHT SYSTEM, INC. FOR THE OPERATION OF A TRUCK AND FREIGHT TERMINAL AT 3677 BANDINI BOULEVARD 4 5 WHEREAS, ANR Freight System, Inc. applied for a 6 conditional use permit to operate a truck and freight terminal at 7 3677 Bandini Boulevard; and 8 WHEREAS, the City Council by Resolution No. 6291 on July 9 20, 1993 granted a conditional use permit to SERVCON-Vernon, Inc. 10 11 for the operation of a materials recovery and transfer facility at this site; and 12 WHEREAS, the City Council of the City of Vernon held a 13 hearing on said application for a conditional use permit on April 14 26, 1994; and 15 WHEREAS, the proposed conditional use permit contained 16 17 the following condition: "The previously approved conditional use 18 permit granted to SERVCON-Vernon, Inc. for the 19 materials recovery and transfer facility at 20 21 this site, shall be withdrawn by a representative of SERVCON-Vernon, Inc." 22 23 24- 25 26 WHEREAS, SERVCON-Vernon, Inc. is unwilling to allow its conditional use permit to be withdrawn. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon 27 hereby finds and determines that the recitals contained 28 hereinabove are true and correct. 1 2 SECTION 2: The application for a conditional use permit by ANR Freight System, Inc. for the operation of a truck and freight terminal at 3677 Bandini Boulevard is hereby denied. 3 4 SECTION 3: The City Clerk of the City of Vernon shall 5 6 certify to the passage of this resolution, and thereupon and 7 thereafter the same shall be in full force and effect. Further it is recommended that a Notice of Exemption be filed with the County Clerk and the conditional use permit be granted with the following conditions: a. The facility shall be operated in accordance with, and made to conform with all current codes, rules, regulations and permit fees as adopted by the City of Vernon. The facility shall be operated in a manner that will prevent unsanitary conditions, odors or other nuisances. Prior to occupancy a business license and occupancy permit shall be obtained. All trucking operations, including truck and trailer parking, shall be limited to the lot located at 3677 Bandini Boulevard. b. A hazardous materials inventory and business/contingency plan shall be submitted and a hazardous materials permit shall be obtained from the City of Vernon Health Department within the first 30 days of occupying the site. Hazardous materials/wastes shall be handled and managed in compliance with all appropriate federal, state and local laws. c. All parking and loading facilities shall be paved with a hard durable surface material and shall be adequately drained, and kept free of dust, mud, trash and weeds. Any damaged areas of pavement covering the site shall be repaired prior to occupancy. d. Servicing of vehicles including washing, steam cleaning and repairing shall be performed in facilities in compliance with appropriate codes. e. No equipment or freight shall be stored on the site, other than in trailers or on the docks. Adequate plans and materials must be available for handling leaks or spills from vehicles during storage or transportation. f. All required federal, state, local and regulatory agency permits shall be obtained prior to operation. g. ANR must comply with all conditions as set forth in the Truck Terminal Cleanup Agreement, Docket No. HSA93/94-004A. h. Where parking or maneuvering of vehicles adjoin a public street, a 30 inch high barrier wallar 4 foot wide landscaped area shall be established. i. ANR Freight System, Inc. shall either construct a traffic signal and a center median to city of Vernon standards as shown on Exhibit "A" or provide an access point onto 26th street for the site and eliminate all site access to Bandini Boulevard. CONDITIONAL USE PERMIT TO OPERATE A TRUCK AND FREIGHT TERMINAL AT 3677 BANDINI BOULEVARD April 21, 1994 ANR Freight System, Inc. has applied for a conditional use permit to operate a truck and freight terminal at 3677 Bandini Boulevard in the City of Vernon. They are an interstate trucking company providing pick-up and delivery service to customers throughout California. There will be approximately 38 trucks based at this facility. In the recent past ANR Freight System, Inc. had as many as 266 employees reporting to this location. In early 1991 they stopped operating out of this site and vacated the premises. They are now proposing to reoccupy the site but on a much smaller scale. They expect to have only 33 employees based at this site. 1. GENERAL PLAN The proposed use conforms to the Zoning Ordinance and the General Plan. The site is presently being used as a truck and freight terminal. 2. SITE The proposed site is of adequate size and shape for the proposed use. 3. ADVERSE AFFECT The proposed site is surrounded by industrial uses compatible with the proposed use and no adverse noise, odor, dust, smoke, light or glare, or risk of fire, infection or explosion is anticipated from the proposed operation. 4. ACCESS The site currently has access to Bandini Boulevard which as constructed is one hundred feet (100') wide 1 l and has adequate capacity and pavement type for the proposed operation. However, due to the heavy traffic volume and high speeds of vehicles traveling on Bandini Boulevard, ANR will be required to either construct a traffic signal at their access point on Bandini Boulevard or eliminate all access to Bandini Boulevard and gain access to 26th street. At this location 26th street is 40 feet wide and has adequate capacity and pavement type for the proposed operation. 5. TROCK MOVEMENTS ANR Freight System, Inc. will operate approximately 38 dual axle trucks out of the facility. They expect to have up to 65 vehicle movements, including employees vehicles, out of the site daily with the same number entering the site. In general trucks will either travel on Bandini Boulevard or 26th Street in an easterly direction to freeway access. 6. STATE OR FEDERAL CONDITIONS There are no conditions imposed by State or Federal law. 7. CONDITIONS It is recommended that the following conditions be set on the permit to adequately protect the public interests: a. The facility shall be operated in accordance with, and made to conform with all current codes, rules, regulations and permit fees as adopted by the City of Vernon.
