Resolution No. 6418 1 RESOLUTION NO. 6418 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON REVOKING AND DECLARING VOID A CONDITIONAL USE PERMIT GRANTED TO JCI ENVIRONMENTAL SERVICES, INC. FOR THE OPERATION OF A TRUCK TERMINAL AT 4133 BANDINI BOULEVARD IN THE CITY OF VERNON 4 5 WHEREAS, the City Council of the city of Vernon by 6 Resolution No. 6031 on February 18, 1992, granted a conditional use 7 permit to JCI Environmental Services, Inc. ("JCI"), for the 8 operation of a truck terminal at 4133 Bandini Boulevard in the City 9 of Vernon; and 10 WHEREAS, Resolution No. 6031 imposed seventeen conditions lIon said use permit labeled a. through r. which JCI was required to 12 fulfill in order to operate said truck terminal; and 13 WHEREAS, the Director of community services has advised the l4 City Council that JCI has failed to comply with three of such 15 conditions, condition b. pertaining to underground tanks, condition 16 f. pertaining to maintenance of vehicles, and condition r. 17 pertaining to an electrical easement; and 18 WHEREAS, Section 26.52-10, "Voiding or Extending Permit" of 19 the Code of the City of Vernon, California, 1959, authorizes the 20 Director of Community Services to recommend that the City Council 21 "void any conditional use permit for noncompliance with the 22 conditions set forth"; and 23 WHEREAS, the Director of community Services by letter to 24 the City Council dated March 29, 1994, has recommended that the JCI 25 conditional use permit be revoked; and 26 WHEREAS, said Code section 26.5.2-10 authorizes the City 27 Council after a public hearing to void any conditional use permit 28 for noncompliance by the permittee; and WHEREAS, timely notice of the public hearing was given to JCI by letter dated March 10, 1994, and Notice of Public Hearing was published in the Metropolitan News on March 15, 1994; and WHEREAS, a public hearing was held by the City Council on April 5, 1994, at which a representative of JCI, Mr. Edward Romero, appeared and was heard, and evidence was presented by the Director of Community Services and the Director of the Health Department. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The City Council of the City of Vernon hereby finds and determines as follows: A. Condition b. of Resolution No. 6031 requires: b. The two (2) existing underground tanks are required to be maintained in compliance with Vernon Ordinance No. 944. Tanks must continue to be monitored and operating permits must be properly transferred. The underground tanks shall not be used for the storage of hazardous wastes. Plans for a new fuel station must be submitted for review and approval. JCI has failed to maintain said tanks in accordance with condition by failing to transfer the permits to JCI, by failing to have said tanks certified as operational by a qualified service person, and by failing to take remedial action for a periodic alarm which occurs on the monitoring system for one tank. B. An operation plan for exterior washing of company vehicles shall be submitted for review and approval. No cleaning of the interior of any tankers or storage containers shall be performed at this location. Only JCI Environmental Services' equipment or vehicles shall be repaired or washed at this site. JCI has maintained vehicles at said truck terminal in a manner inconsistent with said condition by repairing and washing said vehicles in a manner which is not in conformity to City of Vernon codes. C. Condition r. of Resolution No. 6031 requires: r. JCI Environmental Services, Inc. shall grant to the City of Vernon an easement for the existing underground electric cables which feed their pad mounted transformers. JCI has violated said condition by failing to grant such an easement to the City of Vernon. D. The community Services and Health Departments met with JCI on numerous occasions in order to resolve these issues, but was unable to obtain compliance.
