A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
J.F. YOONG, FROM SECTION 26.4.2-8
DEVELOPMENT STANDARDS, OF THE
COMPREHENSIVE ZONING ORDINANCE, FOR
THE PROPERTY LOCATED AT 4747 49TH
STREET IN THE CITY OF VERNON
WHEREAS, J.F. Yoong owns a building which
requires a variance from section 26.4.2-8, Development
Standards, of the Comprehensive Zoning ordinance, for the
property located at 4747 49th Street; and
WHEREAS, the physical condition of the property is
unique in that the existing building measuring approximately
7,700 square feet was constructed with one non-conforming
truck loading space measuring 10.0 feet in width and 21.0 feet
in length and J.F. Yoong has a 20 foot-wide easement on the
adjacent property that is used as an additional conforming
truck loading space; and
WHEREAS, J.F. Yoong uses the building for
warehousing, and zoning Ordinance Section 26.4.2-7 (b) requires
one truck loading space for buildings with a gross floor area
less than 8,000 square feet in size; and
WHEREAS, Zoning Ordinance Section 26.4.2-8 (c)
specifies that each truck loading space shall be a minimum of
10 feet wide and 65 feet long, and Section 26.4.6-4 (c)
provides that a non-conforming building must comply with these
standards within 5 years of April 18, 1989 unless a variance is
granted; and
WHEREAS, there is insufficient space on the property

and the application of the development standards for the truck
loading space requirements will create an unreasonable hardship
by requiring the non-conforming space to be 10 feet wide and 65
feet long; and
WHEREAS, J.F. Yoong has indicated that he has no
plans to expand or alter the building configuration and
that the existing truck loading space is sufficient for the
intended use; and
WHEREAS, 4747 49th street is located in the M zone
and the operation is consistent with the objectives of the
General Plan and Zoning Ordinance; and
WHEREAS, the City Council of the City of Vernon held
a hearing on said application for a variance on May 3, 1994.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained herein-
above are true and correct.
SECTION 2: A variance from section 26.4.2-8,
Development Standards of the Comprehensive zoning Ordinance,
requiring all truck loading spaces to be 10 feet wide by 65
feet long is hereby granted to J.F. Yoong at 4747 49th Street
SECTION 3: The variance shall be granted subject to
the following conditions: (a) the usage of the non-conforming
truck loading space shall be limited so that no truck parked at
the loading dock shall extend into the street right-of-way as
shown on the Master Plan of streets, dated June 16, 1992; and

(b) all existing and future tenants shall be notified of this
restriction and a condition stating this shall be placed in their

Noncompliance with these conditions shall
constitute sufficient grounds for the city Council of the City
of Vernon to void this variance and require the application of
the authorized truck loading space requirement.
SECTION 5:
The City Clerk of the City of Vernon shall
certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.

variance for J.F. Young, it is recommended that the following
changes be made to the conditions:
Condition (a) be changed to read as follows:

VARIANCE APPLICATION
MAY 3, 1994
J.F. Yoong has requested a variance for the property located at 4747
49th street in the city of Vernon. The building that he owns was
constructed with one non-conforming truck loading space measuring 10.0
feet in width and 21.0 feet in length. J.F. Yoong has stated that only'
vehicles of smaller lengths will be used at the non-conforming truck
loading space. J.F. Yoong has a 20 foot wide easement on the adjacent
property that is used as a conforming loading space for trucks of greater
length. The building is used for warehousing and is approximately 7,700
square feet.
section 26.4.2-8 (c) of the comprehensive Zoning Ordinance specifies
that each truck loading space shall be a minimum of 10 feet wide and,65
feet long and Section 26.4.6-4 (c) provides that a non-conforming building
must comply with these standards within 5 years of April 18, 1989 unless a
variance is granted.
J.F. Yoong has indicated that requiring the non-conforming truck
loading space to be 65 feet long by 10 feet wide would be a hardship. He
has indicated that he has no plans for expansion or alteration of the
building configuration. The operation is in conformance with the Zoning
Ordinance and General Plan. Therefore, it is recommended that the
variance be granted sUbject to the following conditions: (a) that usage
of the truck loading space shall be limited so that no truck parked at the
loading dock shall extend into the street right-of-way as shown on the
Master Plan of Streets, dated June 16, 1992; and (b) all existing and
future tenants shall be notified of the restriction and a condition

Honorable Members:
J. F. Yoong has submitted an application for a Variance from the
Comprehensive Zoning Ordinance, section 26.4.2-8, Development

transmitted herewith is the following evidence:

following Conditions:

dated June 16, 1992;
b. All existing and future tenants or owners shall

Herewith for your information is a Notice of Public Hearing to
consider an application for a Variance for the property located at
4747 49th street in Vernon. The applicant, J.F. Yoong, is
requesting a variance to allow the use of one non-conforming truck
dock.

ENGINEER'S REPORT
J.F. YOONG
VARIANCE APPLICATION
APRIL 28, 1994
J.F. Yoong has requested a variance for the property located at 4747
49th street in the City of Vernon. The building that he owns was
constructed with one non-conforming truck loading space measuring 10.0
feet in width and 21.0 feet in length. J.F. Yoong has stated that only
vehicles of smaller lengths will be used at the non-conforming truck
loading space. J.F. Yoong has a 20 foot wide easement on the adjacent
property that can be used as a loading space for trucks of greater length.
The building is used for warehousing and is approximately 7,700 square
feet.
section 26.4.2-8 (c) of the Comprehensive Zoning Ordinance specifies
that each truck loading space shall be a minimum of 10 feet wide and 65
feet long and Section 26.4.6-4 (c) provides that a non-conforming building
must comply with these standards within 5 years of April 18, 1989 unless a
variance is granted.
J.F. Yoong has indicated that requiring the non-conforming truck
loading space to be 65 feet long by 10 feet wide,would be a hardship. He
has indicated that he has no plans for expansion or alteration of the
building configuration. The operation is in conformance with the Zoning
Ordinance and General Plan. Therefore, it is recommended that the
variance be granted subject to the following conditions: (a) that usage
of the truck loading space shall be limited so that no truck parked at the
loading dock shall extend into the street right-of-way as shown on the
Master Plan of Streets, dated June 16, 1992; and (b) all existing and
future tenants or owners shall be notified of the restriction and a
condition stating this shall be placed in their lease or deed.
