A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
KOP-COAT, INC., FROM SECTION 26.4.2-8
DEVELOPMENT STANDARDS, OF THE
COMPREHENSIVE ZONING ORDINANCE, FOR
THE PROPERTY LOCATED AT 5431 DISTRICT
BOULEVARD lN THE CITY OF VERNON
WHEREAS, Kop-Coat, Inc. occupies buildings which
require a variance from Section 26.4.2-8, Development
standards, of the Comprehensive Zoning Ordinance, for the
property located at 5431 District Boulevard; and
WHEREAS, the physical condition of the property is
unique in that the existing buildings measuring approximately
127,000 square feet were constructed with six non-conforming
truck loading spaces: two measuring 10.0 feet in width and 49.3
feet in length and four being 9.0 feet in width and 54.0 feet in
length; and
WHEREAS, Kop-Coat, Inc. uses the building for coating
manufacturing, and Zoning Ordinance section 26.4.2-7 (b) requires
five truck loading spaces for buildings with a gross floor area
of between 100,000 and 200,000 square feet in size; and
WHEREAS, Zoning Ordinance section 26.4.2-8 (c)
specifies that each truck loading space shall be a minimum of
10 feet wide and 65 feet long, and section 26.4.6-4 (c)
provides that a non-conforming building must comply with these
standards within 5 years of April 18, 1989 unless a variance is
granted; and
WHEREAS, there is insufficient space on the property
and the application of the development standards for the truck

loading space requirements will create an unreasonable hardship
by requiring the six non-conforming spaces to be 10 feet wide and
65 feet long; and
WHEREAS, Kop-Coat, Inc. has indicated that it
has no plans to expand or alter the building configuration and
that the existing truck loading spaces are sufficient for the
intended use; and
WHEREAS, 5431 District Boulevard is located in the M
zone and the operation is consistent with the objectives of the
General Plan and Zoning Ordinance; and
WHEREAS, the city Council of the City of Vernon held
a hearing on said application for a variance on May 3, 1994.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City council of the City of Vernon
hereby finds and determines that the recitals contained herein-
above are true and correct.
SECTION 2: A variance from section 26.4.2-8,
Development Standards of the Comprehensive Zoning Ordinance,
requiring all truck loading spaces to be 10 feet wide by 65
feet long is hereby granted to Kop-Coat, Inc. at 5431 District
Boulevard.
SECTION 3: The variance shall be granted subject to
the following condition: the usage of the truck loading spaces
shall be limited so that no truck parked at the loading docks
shall extend into the street right-of-way as shown on the Master
Plan of Streets, dated June 16, 1992.

SECTION 4: Noncompliance with this condition shall
constitute sufficient grounds for the City Council of the City
of Vernon to void this variance and require the application of
the authorized truck loading space requirement.
SECTION 5:
The City Clerk of the City of Vernon shall
certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.

may attend.

Honorable Members:
Kop-Coat, Inc. has submitted an application for a Variance from the
Comprehensive Zoning Ordinance, Section 26.4.2-8, Development
Standards, for the property located at 5431 District Boulevard, and
transmitted herewith is the following evidence:
1. Application for Variance;
2. Affidavits of posting and mailing;
3. Notice of Public Hearing;
4. Engineer's Report.
The buildings have six non-conforming truck loading spaces. Two
spaces measure 49.3 feet long and 10 feet wide, and four spaces
measure 54 feet long and 9 feet wide. The company is proposing to
use only vehicles of a smaller length at these docks. This has
been reviewed by the Interim Director of Community Services, and it
is hereby recommended that the Variance be granted contingent upon
the following Condition:
1. The usage of the truck loading spaces shall be
limited so that any truck parked at the loading
docks shall not extend into the street right-of-
way as shown on the Master Plan of Streets
dated June 16, 1992.

to remain in service so that Kop Coat can remain in business.
NOTICE TO APPLICANT: In the variance procedure it shall be shown that
the following five (5) conditions exist in reference to the property being
considered. The applicant should answer the following statements. If you
have difficulty finding reasonable answers to the statements contained in
this application it may be an indication that your request has insufficient
factors to justify approval. (Attach additional sheet(s) if necessary)
(l) That special conditions and circumstances exist which are peculiar to
the land, structure, or building involved and which are not generally
applicable to other lands, structures, or buildings in the same vicinity
and zone:

To lenqthen our loading and unloading docks approximately 15 feet Kop-Coat would
have to remove building 3A and part of the wall and ceiling of building 3 in order
to alter the passage way on the southernmost dock. Remove part of the wall and
ceiling of building 9C and alter the passageway on the northernmost dock. See plot
plan. Our storage space in these buildings would be cut seriously. AS,it is the
buildings are filled to capacity. '
(2) That literal interpretation of the provisions of this ordinance would
deprive the ap~licant of rights commonly enjoyed by other properties in the
same vicinity and zone in which the property is lo~ated, under the terms of
this Chapter.
Other companies in the area have access to loading and unloading docks. Without docks
this location would close. Attempting to alter the plant proper to effectively meet
the requirements of this ordanance would cause this plant to reconsider its viability
as ,a profit producing location for Kop-Coat.

(3) That the special conditions and circumstances do not result from
actions of the applicant:
Existing loadinq and unloading docks have been in service in this plant since the
late 1940's.
( 4 ) That g ran tin g the va ria n c e requested will not confer on the a p p 1 i cant
any special privilege that is denied by this Chapter to other lands,
structures, or buildings in the same vicinitj and zone in which the property
is located:
We do not know of any other properties that would have to remove buildings and alter
passaqewavs to comply with the ordinance.

(5) That the granting of such ~ariance will be in harmony and not adversely
affect the Comprepensive General Plan:
The street is not blocked by any of the trucks that frequent Kop-Coats docks once
they have backed in. ..Therefore normal traffic flow is not impeded.
NOTE:
Non-conforming use of neighboring lands~ structures, or buildings shall not
be considered grounds for the issuance of a variance.

The purpose of the hearing is to obtain testimony from
affected and/or interested persons regarding this application. The

ENGINEER'S REPORT
KOP-COAT, INC.
VARIANCE APPLICATION
APRIL 28, 1994
Kop-Coat, Inc. has requested a variance for the property located at
5431 District Boulevard in the City of Vernon. The buildings that they
occupy were constructed with six non-conforming truck loading spaces: two
measuring 10.0 feet in width and 49.3 feet in length and four measuring
10.0 feet in width and 54.0 feet in length. Kop-Coat, Inc. has stated
that only vehicles of smaller lengths will be used at the non-conforming
truck loading spaces. The buildings are used for coating manufacturing
and are approximately 127,000 square feet.
Section 26.4.2-8 (c) of the Comprehensive Zoning Ordinance specifies
that each truck loading space shall be a minimum of 10 feet wide and 65
feet long and Section 26.4.6-4 (c) provides that a non-conforming building
must comply with these standards within 5 years of April 18, 1989 unless a
variance is granted.
Kop-Coat, Inc. has indicated that requiring the non-conforming truck
loading spaces to be 65 feet long by 10 feet wide would be a hardship.
They have indicated that they have no plans for expansion or alteration of
the building configuration. Their operation is in conformance with the
Zoning Ordinance and General Plan. Therefore, it is recommended that the
variance be granted with the condition that usage of the truck loading
spaces be limited so that no truck parked at the loading docks shall
extend into the street right-of-way as shown on the Master Plan of
Streets, dated June 16, 1992.
