A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
WORLD BAZAARS, INC., FROM SECTION
26.4.2-8 DEVELOPMENT STANDARDS, OF THE
COMPREHENSIVE ZONING ORDINANCE, FOR
THE PROPERTY LOCATED AT 3113 26TH
STREET IN THE CITY OF VERNON
WHEREAS, World Bazaars, Inc. occupies a building which
requires a variance from Section 26.4.2-8, Development
Standards, of the Comprehensive Zoning Ordinance, for the
property located at 3113 26th Street; and
WHEREAS, the physical condition of the property is
unique in that the existing building measuring approximately
60,000 square feet was constructed with eight non-conforming
truck loading spaces measuring 10.0 feet in width: four being
54.3 feet in length and four being 26.0 feet in length; and
WHEREAS, World Bazaars, Inc. uses the building for
warehousing, and Zoning Ordinance section 26.4.2-7 (b) requires
four truck loading spaces for buildings with a gross floor area
of between 50,001 and 100,000 square feet in size; and
WHEREAS, Zoning Ordinance Section 26.4.2-8 (c)
specifies that each truck loading space shall be a minimum of
10 feet wide and 65 feet long, and section 26.4.6-4 (c)
provides that a non-conforming building must comply with these
standards within 5 years of April 18, 1989 unless a variance is
granted; and
WHEREAS, there is insufficient space on the property
and the application of the development standards for the truck
loading space requirements will create an unreasonable hardship

by requiring the eight non-conforming spaces to be 10 feet wide
and 65 feet long; and
WHEREAS, World Bazaars, Inc. has indicated that it
has no plans to expand or alter the building configuration and
that the existing truck loading spaces are sufficient for the
intended use; and
WHEREAS, 3113 26th Street is located in the M-2 zone
and the operation is consistent with the objectives of the
General Plan and Zoning ordinance; and
WHEREAS, the city council of the City of Vernon held
a hearing on said application for a variance on May 3, 1994.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained herein-
above are true and correct.
SECTION 2: A variance from section 26.4.2-8,
Development Standards of the comprehensive Zoning Ordinance,
requiring all truck loading spaces to be 10 feet wide by 65
feet long is hereby granted to World Bazaars, Inc. at 3113
26th Street.
SECTION 3: The variance shall be granted subject to
the following condition: the usage of the truck loading spaces
shall be limited so that no truck parked at the loading docks
shall extend into the street right-of-way as shown on the Master
Plan of Streets, dated June 16, 1992.
SECTION 4: Noncompliance with this condition shall

constitute sufficient grounds for the City Council of the City
of Vernon to void this variance and r~quire the application of
the authorized truck loading space requirement.
SECTION 5:
Th~ City Clerk of the City of Vernon shall
certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.

Honorable Members:
World Bazaars, Inc. has submitted an application for a Variance
from the Comprehensive Zoning Ordinance, section 26.4.2-8,
Development Standards, for the building located at 3113 26th
Street, and transmitted herewith is the following evidence:
1. Application for Variance;
2. Affidavits of posting and mailing;
3. Notice of Public Hearing;
4. Engineer's Report.
The building has eight non-conforming truck loading spaces. Four
spaces measure 54.1 feet long and 10 feet wide, and four measure 26
feet long and 10 feet wide. The company is proposing to use only
vehicles of a smaller length at these docks. This has been
reviewed by the Interim Director of Community Services, and it is
hereby recommended that the Variance be granted contingent upon the
following Condition:
1. The usage of the truck loading spaces shall be
limited so that any truck parked at the loading
docks shall not extend into the street right-of-
way as shown on the Master Plan of Streets
dated June 16, 1992.

To use 55' loading dock area for parking of passenger vehicles and small
van type trucks (such as UPS and Federal Express) that do not extend much, if
at all, beyond the building space itself and definitely not into the street.
NOTICE TO APPLICANT: In the variance procedure it shall be shown that
the following five (5) conditions exist in reference to the property being
considered. The applicant should answer the following statements. If you
have difficulty finding reasonable answers to the statements contained in
this application it may be an indication that your req~~st has in~ufficient
factors to justify approval. (Attach additional sheet(s) if necessary)
(l) That special conditions and circumstances exist which are peculiar to
the land, structure, or building involved and which are not generally
applicable to other lands, structures, or buildings in the same Vicinity
and zone:
An existing building was purchased May, 1985, with what are now non-conforming
truck docks.
(2) That literal interpretation of the prOV1Slons of this ordinance would
deprive the applicant of rights commonly enj~yed by other properties in the
same vicinity and zone in which the property is located, under the terms of
this Chapter.
The loss of the dock would deprive the company of e~emely valuable parking
for passenger vehicles as well as convenient off street loading.

An existing building was purchased in 1985 in its present structural form.
(4) That granting the variance requested will not confer on the applicant
any special privilege that is denied by this Chapter to other lands,

All structures within the area have loading facilities; thus no special privileg~s
would be granted in granting this variance.
(5) That the granting of stich variance will be in harmony and not adversely
affect the Comprehensive General Plan:

3113 26th street in Vernon. The applicant, World Bazaars, Inc., is

ENGINEER'S REPORT
WORLD BAZAARS, INC.
VARIANCE APPLICATION
APRIL 28, 1994
World Bazaars Inc. has requested a variance for the property located
at 3113 26th street in the City of Vernon. The building that they occupy
was constructed with eight non-conforming truck loading spaces measuring
10.0 feet in width: four being 54.3 feet in length and four being 26.0
feet in length. World Bazaars, Inc. has stated that only vehicles of
smaller lengths will be used at the non-conforming truck loading spaces.
The building is used for warehousing and is approximately 60,000 square
feet.
Section 26.4.2-8 (c) of the Comprehensive Zoning Ordinance specifies
that each truck loading space shall be a minimum of 10 feet wide and 65
feet long and section 26.4.6-4 (c) provides that a non-conforming building
must comply with these standards within 5 years of April 18, 1989 unless a
variance is granted.
World Bazaars, Inc. has indicated that requiring the non-conforming
truck loading spaces to be 65 feet long by 10 feet wide would be a
hardship. They have indicated that they have no plans for expansion or
alteration of the building configuration. Their operation is in
conformance with the Zoning Ordinance and General Plan. Therefore, it is
recommended that the variance be granted with the condition that usage of
the truck loading spaces be limited so that no truck parked at the loading
docks shall extend into the street right-of-way as shown on the Master
Plan of Streets, dated June 16, 1992.
