A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
THERMADOR - A MASCO COMPANY, FROM SECTION
26.4.2-8 DEVELOPMENT STANDARDS, OF THE
COMPREHENSIVE ZONING ORDINANCE, FOR
THE PROPERTY LOCATED AT 5119 DISTRICT
BOULEVARD THE CITY OF VERNON
WHEREAS, Thermador-A Masco Company occupies
buildings which require a variance from Sect'ion 26.4.2-8,
Development Standards, of the Comprehensive Zoning Ordinance,
for the property located at 5119 District Boulevard; and
WHEREAS, the physical condition of the property is
unique in that the existing buildings measuring approximately
369,000 square feet were constructed with three conforming truck
loading spaces and twenty-one non-conforming truck loading
spaces measuring 10.0 feet in width with eighteen being 51.0
feet in length and three being 50.5 feet in length; and
WHEREAS, Thermador-A Masco Company uses the building
for manufacturing, and Zoning Ordinance section 26.4.2-7 (b)
requires five truck loading spaces for buildings with a gross
floor area up to 200,000 square feet in size and one truck
loading space for each additional 100,000 square feet or
fraction thereof, for a total of seven truck loading spaces; and
WHEREAS, Zoning Ordinance Section 26.4.2-8 (c)
specifies that each truck loading space shall be a minimum of
10 feet wide and 65 feet long, and Section 26.4.6-4 (c)
provides that a non-conforming building must comply with these
standards within 5 years of April 18, 1989 unless a variance is
granted; and

WHEREAS, the application of the development
standards for the truck loading space requirements will create an
unreasonable hardship by requiring the twenty-one non-conforming
spaces to be 10 feet wide and 65 feet long; and
WHEREAS, Thermador - A Masco Company has indicated that i
will construct six conforming truck loading spaces within the
next year; and
WHEREAS, 5119 District Boulevard is located in the M
zone and the operation is consistent with the objectives of the
General Plan and Zoning Ordinance; and
WHEREAS, the City council of the City of Vernon held
a hearing on said application for a variance on May 3, 1994.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained herein-
above are true and correct.
SECTION 2: A variance from Section 26.4.2-8,
Development Standards of the Comprehensive Zoning Ordinance,
requiring all truck loading spaces to be 10 feet wide by 65
feet long is hereby granted to Thermador-A Masco Company at
5119 District Boulevard.
SECTION 3: The variance shall be granted subject to
the following conditions: (a) in the receiving area, as shown
on Exhibit "A", the usage of the truck loading spaces shall be
limited so that no truck parked at the loading docks shall
extend into the street right-of-way as shown on the Master Plan

of streets dated June 16, 1992 and driveways at all unused docks
shall be removed as directed by the City of Vernon; (b) six
new truck loading spaces shall be constructed within one year
and prior to any modification Thermador - A Masco Company shall
obtain all of the necessary permits from the City of Vernon;
(c) the two truck loading docks not presently being used as such,
as shown on Exhibit "A", shall be permanently sealed and the
driveways shall be removed as directed by the City of Vernon;
and (d) in the shipping area, as shown on Exhibit "A",
tractors shall be removed from trailers parked at the loading
docks so that no tractor extends into the street right-of-way
as shown on the Master Plan of streets dated June 16, 1992
and within one year the docks shall be permanently sealed and
the driveways shall be removed as directed by the City of Vernon.
SECTION 4: Noncompliance with these conditions shall
constitute sufficient grounds for the city Council of the City
of Vernon to void this variance and require the application of
the authorized truck loading space requirement.
SECTION 5:
The City Clerk of the City of Vernon shall
certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.

Gentlemen:
Upon further review of the conditions to be placed upon the
variance for Thermador - A Masco Company, it is recommended that
the conditions be changed to as follows:
(a) in the receiving area, as shown on Exhibit "A", the usage
of the truck loading spaces shall be limited so that no truck
parked at the loading docks shall extend into the street right-of-
way as shown on the Master Plan of Streets dated June 16, 1992, and
driveways at all unused docks shall be removed as directed by the
City of Vernon; .
(b) as shown on Exhibit "A", six new truck loading spaces
shall be constructed within one year and prior to any modification

THERMADOR-A MASCO COMPANY
VARIANCE APPLICATION
MAY 3, 1994
.Thermador-A Masco Company has requested a variance for the property
located at 5119 District Boulevard in the City of Vernon. The buildings
that they occupy were constructed with three conforming truck loading
spaces and twenty-one non-conforming truck loading spaces measuring 10.0.
feet in width with eighteen being 51.0 feet in length and three being 50.5
feet in length. The buildings are used for manufacturing and are
approximately 369,000 square feet.
Thermador-A Masco Company has stated that only vehicles of smaller
lengths will be used at the sixteen non-conforming truck loadings spaces
in their receiving area. Many of these truck loading spaces are not
usable because of outside storage and two additional spaces are not usable
because of inside operations. At the three non-conforming truck loading
spaces in their shipping area, Thermador-A Masco Company proposes to
disconnect all tractors from the trailers so that they will not extend
into the street right-of-way. This will be a temporary solution until
they permanently seal these truck loading spaces within the next year.
section 26.4.2-8 (c) of the Comprehensive Zoning Ordinance specifies
that each truck loading space shall be a minimum of 10 feet wide and 65
feet long and Section 26.4.6-4 (c) provides that a non-conforming building
must comply with these standards within 5 years of April 18, 1989 unless a
variance is granted.
Thermador A-Masco Company has indicated that requiring all of the
non-conforming truck loading spaces to be 65 feet long by 10 feet wide at
this time would be a hardship. Their operation is in conformance with the

street right-of-way. This has been reviewed by the Interim
Director of Community Services, and it is hereby recommended that
the Variance be granted contingent upon the following Conditions:

limited so that any truck parked at the loading
docks shall not extend into the street right-of-
way as shown on the Master Plan of Streets
dated June 16, 1992;
b. Six new truck loading spaces shall be constructed
within one year and prior to any modification,

ENGINEER'S REPORT
THERMADOR-A MASCO COMPANY
VARIANCE APPLICATION
APRIL 28, 1994
Thermador-A Masco Company has requested a variance for the property
located at 5119 District Boulevard in the City of ,Vernon. The buildings
that they occupy were constructed with three conforming truck loading
spaces and twenty-one non-conforming truck loading spaces measuring 10.0.
feet in width with eighteen being 51.0 feet in length and three being 50.5
feet in length. The buildings are used for manufacturing and are
approximately 369,000 square feet.
Thermador-A Masco Company has stated that only vehicles of smaller
lengths will be used at the sixteen non-conforming truck loadings spaces
in their receiving area. Many of these truck loading spaces are not
usable because of outside storage and two additional spaces are not usable
because of inside operations. At the three non-conforming truck loading
spaces in their shipping area, Thermador-A Masco Company proposes to
disconnect all tractors from the trailers so that they will not extend
into the street right-of-way. This will be a temporary solution until
they construct six conforming truck loading spaces within the next year.
Section 26.4.2-8 (c) of the Comprehensive Zoning Ordinance specifies
that each truck loading space shall be a minimum of 10 feet wide and 65
feet long and Section 26.4.6-4 (c) provides that a non-conforming building
must comply with these standards within 5 years of April 18, 1989 unless a
variance is granted.
Thermador A-Masco Company has indicated that requiring all of the
non-conforming truck loading spaces to be 65 feet long by 10 feet wide at
this time would be a hardship. Their operation is in conformance with the
Zoning Ordinance and General Plan. Therefore, it is recommended that the
variance be granted subject to the following conditions: (a) usage of
the truck loading spaces shall be limited so that no truck parked at the
loading docks shall extend into the street right-of-way as shown on the
Master Plan of streets, dated June 16, 1992; (b) six new truck loading
space$ shall be constructed within one year and prior to any modification
Applicant shall obtain all of the necessary permits from the City of
Vernon; (c) only until the new loading spaces are completed, tractors
.
shall be removed from trailers parked at the loading docks in the shipping
area so that condition (a) above is met; (d) loading docks shall be
sealed at any of the truck loading spaces that are not presently being
used as such and the driveways shall be removed as directed by the City of
Vernon; and (e) in the future, at any truck loading space that is not used
for loading purposes, the dock shall be sealed and the driveway shall be
removed as directed by the City of Vernon.
