A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
CHOICE MEAT COMPANY, FROM SECTION
26.4.2-8, DEVELOPMENT STANDARDS OF THE
COMPREHENSIVE ZONING ORDINANCE, FOR
THE PROPERTY LOCATED AT 4820 EVERETT
AVENUE IN THE CITY OF VERNON
WHEREAS, Choice Meat Company occupies a parcel of
property which requires a variance from Section 26.4.2-8,
Development Standards, of the Comprehensive Zoning Ordinance,
for the property located at 4820 Everett Avenue; and
WHEREAS, the physical condition of the property is
unique in that the existing building measuring approximately
16,000 square feet was constructed with five non-conforming
truck loading spaces measuring 10.0 feet in width and 41.3 feet
in length; and
WHEREAS, the building is used for meat processing and
Zoning Ordinance Section 26.4.2-7 (b) requires two truck loading
spaces for buildings with a gross floor area of between 8,001
and 25,000 square feet in size; and
WHEREAS, Zoning Ordinance Section 26.4.2-8 (c)
specifies that each truck loading space shall be a minimum of
10 feet wide and 65 feet long, and Section 26.4.6-4 (c)
provides that a non-conforming building must comply with these
standards within 5 years of April 18, 1989 unless a variance is
granted; and
WHEREAS, there is insufficient space on the property
and the application of the development standards for the truck
loading space requirements will create an unreasonable hardship

by requiring the five non-conforming spaces to be 10 feet
wide and 65 feet long; and
WHEREAS, 4820 Everett Avenue is located in the M zone
and the operation is consistent with the objectives of the
General Plan and Zoning Ordinance; and
WHEREAS, the City Council of the City of Vernon
held a hearing on said application for a variance on July 12,
1994.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION ~: The City Council of the City of Vernon
hereby finds and determines that the recitals contained herein-
above are true and correct.
SECTION 2: A variance from section 26.4.2-8,
Development Standards of the Comprehensive Zoning Ordinance,
requiring all truck loading spaces to be 10 feet wide by 65
feet long is hereby granted to Choice Meat Company at 4820
Everett Avenue.
SECTION 3: The variance shall be granted subject to
the following condition: the usage of the non-conforming truck
loading spaces shall be limited so that no truck parked at the
loading docks shall extend into the street right-of-way as shown
on the Master Plan of Streets, dated June 16, 1992.
SECTION 4: Noncompliance with this condition shall
constitute sufficient grounds for the City Council of the City
of Vernon to void this variance and require the application of
the authorized truck loading space requirement.

JULY 6, 1994
Choice Meat Company has requested a variance from the
Comprehensive Zoning Ordinance section 26.4.2-8, Development
standards, for the property located at 4820 Everett Avenue in
the City of Vernon. The building that they occupy was
constructed with five non-conforming truck loading spaces
measuring 10.0 feet in width and 41.3 feet in length. Choice
Meat Company has stated that only vehicles of smaller lengths
will be used at the five non-conforming truck loading spaces.
The building is a refrigerated warehouse that is used for meat
processing and is approximately 16,000 square feet in size.
section 26.4.2-7 (b) requires two truck loading spaces for

The building has five non-conforming truck loading spaces 10 feet
wide and 41.3 feet long. The unique physical condition of the
property causes a hardship that does not exist on surrounding
properties, and the company is proposing to remove the tractor
from any truck which parks for longer than fifteen minutes and
extends into the street right-of-way. This has been reviewed by
the Interim Director of Community Services and the City Attorney,
and it is hereby recommended that the Variance be granted
contingent upon the following Condition:
1. For any truck parked in a loading space for longer
than fifteen minutes which extends into the
street right-of-way, the tractor portion of
the truck shall be removed.

Choice Meat Company has requested a variance for the property located
at 4820 Everett Avenue in the City of Vernon. The building that they
occupy was constructed with five non-conforming truck loading spaces
measuring 10.0 feet in width and 41.3 feet in length. The building is a
refrigerated warehouse and is used for meat processing. section 26.4.2-8
(c) of the comprehensive Zoning Ordinance specifies that each loading
space shall be a minimum of 10 feet wide and 65 feet long and Section
26.4.6-4 (c) provides that a non-conforming building must comply with
these standards within 5 years of April 18, 1989.
Compliance with Section 26.4.2-8 (c) of the Comprehensive Zoning
Ordinance, in practicality, would necessitate the demolition of the
building. The unique physical condition of the property cauSeS a hardship
that does not exist on surrounding properties and section 26.5.1-6 (a) of
the Comprehensive Zoning Ordinance states that, in this case, the
authorization of a variance can be justified. The walls that need to be
removed in order to recess the docks are bearing walls and could not be
removed without destroying the structural integrity of the building.
Also, the cost of relocating the refrigeration qnd shipping/receiving
areas behind the loading spaces would be uneconomical. If measures were
taken to enforce compliance, the tenant would have to vacate the building
and in excess of 100 jobs would be lost.
Choice Meats has requested to be allowed to park trucks in the
loading spaces that will extend into the street right-of-way. They
occasionally have trucks picking up small quantities of product that park
in the loading spaces for approximately fifteen minutes. They have stated

that for trucks parked longer than 15 minutes they are willing to remove
the tractor portion so that the roadway is not blocked. The loading
spaces extend into 49th street, which is not a heavily traveled street.
Choice Meat Company has indicated that they have no plans for
expansion or alteration of the building configuration. Their operation is
in conformance with the Zoning Ordinance and General Plan. Therefore, it
is recommended that the variance be granted with the condition that for
any truck parked in a loading space for longer than fifteen minutes which
extends into the street right-of-way, the tractor portion shall be
