I RESOLUTION NO. 6432
2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING THE EXTENSION OF THE ANIMAL
3 CONTROL SERVICES CONTRACT WITH SOUTHEAST AREA
ANIMAL CONTROL AUTHORITY (SEAACA) FOR AN
4 ADDITIONAL YEAR, JULY 1, 1994 TO JUNE 30, 1995,
AND AUTHORIZING THE EXECUTION OF AN AMENDMENT TO
5 SAID AGREEMENT
6 WHEREAS, the City Council of the City of Vernon has
7 adopted an ordinance providing for animal control regulation; and
8 WHEREAS, the City of Vernon executed an agreement with
9 the Southeast Area Animal Control Authority (SEAACA), a public
10 agency, for animal control services in 1980, which has been
II revised and amended periodically and which will expire on June 30,
12 1994; and
13 WHEREAS, Bruce V. Malkenhorst, City Administrator/City
14 Clerk, has recommended that the City Council of the City of Vernon
15 approve an Amendment to Agreement with SEAACA extending animal
16 control services for the year 1993/1994, but without increasing
17 the fees paid by the city of Vernon to SEAACA; and
18 WHEREAS, SEAACA approved said Amendment to Agreement at
19 its April 21, 1994 meeting.
20 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
21 CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon hereby
23 finds and determines that the recitals contained hereinabove are
24 true and correct.

SECTION 2: The City Council of the city of Vernon hereby
26 approves the Amendment to Agreement with SEAACA extending the
27 1993/1994 agreement for an additional year, July 1, 1994 to June
28 30, 1995, but without increasing the fees paid by the City of

I Vernon to SEAACA, a copy of which Amendment has been presented to
2 the City council concurrently with this resolution, and the City
3 Council hereby orders said Amendment to be received and filed by
4 the City Clerk.

SECTION 3: The City Council of the City of Vernon hereby
6 authorizes the Mayor and the City Clerk to execute said Amendment
7 for, and on behalf of, the City of Vernon.

SECTION 4: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and
9

thereafter the same shall be in full force and effect.

AMENDMENT TO AGREEMENT
THIS AMENDMENT TO AGREEMENT is executed this
day
of
, 1994 by and between the SOUTHEAST AREA ANIMAL CONTROL
AUTHORITY (herein .AUTHORITY.) and the CITY OF VERNON (herein
.CITY.).
A. AUTHORITY is a public agency organized by the cities of
Downey, Norwalk, pico Rivera, Bell Gardens, Montebello, Paramount,
South El Monte and Santa Fe Springs pursuant to the provisions of
Section 6500 et seq. of the California Government Code for the
purpose of providing animal control services within the boundaries
of those cities and such other municipal corporations as are
approved by the Authority.
B. AUTHORITY has performed animal control services in
accordance with Agreements for the CITY during the fiscal years
1980-81 through 1993-94, and the CITY and AUTHORITY desire to
extend the Agreement dated June 30, 1985, inclusive of all
subsequent amendments,
in order to enable the AUTHORITY to
continue to provide animal control services to the CITY during the
fiscal year 1994-95.
NOW THEREFORE, in consideration of performance by the parties
of the covenants ~nd conditions herein contained the parties agree
as follows:
1. The first sentence of Section 111.9 is amended to read:
.9. That the term of this Agreement shall be for the
period of July 1, 1994 throuth June 30, 1995 inclusive, unless the
Agreement is terminated as herein provided and said Agreement
shall be extended p~ an annual basis thereafter, unless ninety(90)
days prior to the end of each fiscal year, June 30, notice is
given by either party of their intent to terminate this Agree-
ment..

AITothe;,r provisions of said Agreement, with amendments,
remain unchanged.
IN WITNESS WHEREOF, the CITY OF VERNON by order of its City
Council, caused this Amendment to Agreement to be signed by its
Mayor and attested by its Clerk, and the SOUTHEAST AREA ANIMAL
CONTROL AUTHORITY, by order of its Commission, has caused this
Agreement to be subscribed by the Chairman of said Commission and
attested by the Clerk of said Commission.
