A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
U.S. GROWERS COLD STORAGE, INC. FROM
SECTION 26.4.2-8 DEVELOPMENT STANDARDS,
OF THE COMPREHENSIVE ZONING ORDINANCE,
FOR THE PROPERTY LOCATED AT 3111-3261
44TH STREET THE CITY OF VERNON
WHEREAS, U.S. Growers Cold Storage, Inc. occupies
buildings which require a variance from section 26.4.2-8,
Development Standards, of the Comprehensive Zoning Ordinance,
for the properties located at 3111-3261 44th Street; and
WHEREAS, the physical condition of the property is
unique in that the existing buildings as shown on Exhibit "A"
measuring approximately 210,000 square feet in total were
constructed with five conforming truck loading spaces and
thirty-six non-conforming truck loading spaces measuring 10.0
feet in width: two being 25.5 feet in length, four being 36.5
feet in length; four being 28.5 feet in length; five being 29.5
feet in length; one being 38.0 feet in length; eight being 62.0
feet in length; two being 45.4 feet in length; six being 22.3
feet in length; and'four being 60.0 feet in length; and
WHEREAS, U.S. Growers Cold Storage, Inc. uses the
buildings for cold storage, and Zoning Ordinance section 26.4.2-7
(b) requires that a minimum of seventeen truck loading spaces
be provided as shown on Exhibit "A"; and
WHEREAS, Zoning Ordinance section 26.4.2-8 (c)
specifies that each truck loading space shall be a minimum of
10 feet wide and 65 feet long, and section 26.4.6-4 (c)
provides that a non-conforming building must comply with these

standards within 5 years of April 18, 1989 unless a variance is
granted; and
WHEREAS, there is insufficient space on the properties
and the application of the development standards for the truck
loading space requirements will create an unreasonable hardship
by requiring the thirty-six non-conforming spaces to be 10 feet
wide and 65 feet long; and
WHEREAS, U.S. Growers Cold Storage, Inc. has indicated
that it will demolish all of the buildings by March 1, 1996 and
thereafter will build new facilities encompassing the entire
northerly block of 44th Street between Boyle and Alcoa Avenues;
and
WHEREAS, 3111-3261 44th Street is located in the M
zone and the operation is consistent with the objectives of the
General Plan and Zoning Ordinance; and
WHEREAS, the City Council of the city of Vernon held
a hearing on said application for a variance on June 7, 1994.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The city Council of the City of Vernon
hereby finds and determines that the recitals contained herein-
above are true and correct.
SECTION 2: A variance from Section 26.4.2-8,
Development Standards of the comprehensive Zoning Ordinance,
requiring all truck loading spaces to be 10 feet wide by 65
feet long is hereby granted to U.S. Growers Cold Storage, Inc.
at 3111-3261 44th Street.

SECTION 3: The variance shall be granted subject to
the following conditions: (a) u.s. Growers Cold Storage, Inc.
shall demolish all buildings with non-conforming truck loading
spaces located between 3111 and 3261 44th Street or be in
compliance with section 26.4.2-8, Development Standards of the
Comprehensive Zoning Ordinance by March 1, 1996; and (b) within
seven days of the adoption of this resolution, u.S. Growers Cold
Storage, Inc. shall deliver a $50,000 certificate of Deposit
to the City of Vernon, to be refunded to u.s. Growers Cold
storage, Inc., including the interest earned, upon compliance
with condition (a) or to be retained by the City of Vernon if
compliance with condition (a) has not been attained by
March 1, 1996.
SECTION 4: Noncompliance with these conditions shall
constitute sufficient grounds for the City Council of the City
of Vernon to void this variance and require the application of
the authorized truck loading space requirement.
SECTION 5:
The City Clerk of the City of Vernon shall
certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.

VARIANCE APPLICATION
JUNE 7, 1994
U.s. Growers Cold storage, Inc. has requested a variance
from the Comprehensive Zoning Ordinance section 26.4.2-8,
Development Standards, for the properties located at 3111-3261
44th Street in the City of Vernon. The buildings that they
occupy, as shown on Exhibit "A", were constructed with five
conforming truck loading spaces and thirty-six non-conforming
truck loading spaces measuring 10.0 feet in width: two being 25.5
feet in length; four being 36.5 feet in length; four being 28.5
feet in length; five being 29.5 feet in length; one being 38.0
feet in length; eight being 62.0 feet in length; two being 45.4

u.s. Growers Cold Storage, Inc. has indicated that it will
demolish the buildings on 44th Street and build new facilities
encompassing the entire northerly block of 44th Street between
Boyle and Alcoa Avenues. They are requesting a variance to use
the non-conforming truck loading spaces without restriction until
the buildings are demolished. They are currently preparing plans
to convert their facility on Vernon Avenue to accept their
product from the 44th Street facilities. This conversion will be
completed by the middle of 1995, at which time the demolition and
construction will begin on 44th street. The construction is
scheduled to be completed by January 1, 1997.
section 26.4.2-7 (b) requires that a minimum of seventeen
truck loading spaces be provided as shown on Exhibit "A".
section 26.4.2-8 (c) of the Comprehensive zoning Ordinance
specifies that each loading space shall be a minimum of 10 feet
wide and 65 feet long and section 26.4.6-4 (c) provides that a
non-conforming building must comply with these standards within
five years of April 18, 1989 unless a variance is granted.
u.s. Growers Cold Storage, Inc. has indicated that requiring
all of the non-conforming truck loading spaces to be 65 feet long
by 10 feet wide at this time would be a hardship because of the
extent of their proposed construction and the time line that is
involved. Their operation is in conformance with the Zoning
Ordinance and General Plan. Therefore, it is recommended that
the variance be granted sUbject to the following conditions: (a)
u.s. Growers Cold Storage, Inc. shall demolish all buildings with
non-conforming truck loading spaces located between 3111 and 3261
44th Street or be in compliance with Section 26.4.2-8,
Development Standards of the Comprehensive zoning Ordinance by
March 1, 1996; and (b) within seven days of the adoption of the
resolution, u.s. Growers Cold Storage, Inc. shall deliver a
$50,000 Certificate of Deposit to the City of Vernon, to be
refunded to u.s. Growers Cold Storage, Inc., including the

Dear Victor,
Per your request, U.S. Growers is prepared at this time to put
up a refundable $50,000 Certificate of Deposit (interest payable
to U.S. Growers) as an assurance to the City of Vernon that we
will comply with the City's trucking ordinance by March, 1996.
Once in compliance the Certificate will be returned to U.S. Growers.
By March of 1996 the first phase of our rebuild on 44th Street
should be complete and fully operational. This will then eliminate
the existing truck dock situation entirely. Bear in mind that U.s.
Growers will do everything in its power to adhere to this date but
will not be responsible for delays due to conditions that are not
in our control i.e., earthquakes, strikes, shortage of materials
or supplies, weather conditions, fire, acts of God, etc.
Thank you again for your understanding of this most important and
costly matter.

six non-conforming truck loading spaces. The company has indicated
that it will demolish the buildings on 44th Street and build new
facilities encompassing the entire northerly block of 44th Street
between Boyle and Alcoa Avenues. They are requesting a variance to
use the non-conforming truck loading spaces without restriction
until the buildings are demolished. This has been reviewed by the
Interim Director of Community Services, and it is hereby
recommended that the Variance be granted contingent upon the
following Condition:

This variance is to allow U.S. Growers Cold Storage enough time to complete
Phased Construction of our facilities on 44th St.. Construction should be complete
by late Fall of 1996. U. s. Growers will be in compliance with the truck dock
~rdinance by Spring of 1996. (Time Line. Exhibit "B")
NOTICE TO APPLICANT: In the variance pr6cedure it shall be shown that
the following five (5) conditions exist in reference to the property being
considered. The applicant should answe~ the following statements. If you
have difficulty finding reasonable answers to the statements contained in
this application it may be an indication that your request has insufficient
factors to justify' approval. (Attach additional sheet(s') if necessary)
(1) That special conditions an'd circumstances exist which are peculiar to
the land, structure, or building involved and which are not generally
applicable to other lands, structures, or buildings in the same vicinity
and ZOne:
U.S. Growers is asking for a variance to allow this Compnay enough time to rebuild
its 44th St. faciiities in order to comply with Truck Dock Ordinance.
(2) That literal interpretation of the provisions of this ordinance would
deprive the applicant of rights commonly enjoyed by other properties in the
same vicinity and zone in which the property is located, under the terms of
this Chapter.
U.s. Growers feels that any Company asking for time to remodel its facility in order
to comply would be granted a variance. To compl~ with this ordinance. U.s. Growers
is purchasing the parcel on the N.E. corner of Bo~le and 44th. St. so the new
facility may m~ke full use of the entire block.

(3) That the special conditions and circumstances do not result from
actions of the applicant:
When U.S. Growers purchased the buildings on 44th. St. conditions regarding
traffic
and docks were not a problem. We feel that expansion throughout
the Git of Vernon is the reason for this situation.
(4) That granting the variance requested will not confer on the applicant
any special privilege that is denied by this Chapter to other lands,
structures, or buildings in the same vicinity and zone in which the property
is located:
U.S. Growers fully intends to comply within the given time line attached.. US. Growers
does not consider permission to do a multimillion rebuild a special privilege. And
in addition we are presently spending in excess of 1.5 million at area 6 (2045 E Vernon).
