FROM SECTION 26.4.2-8 DEVELOPMENT STANDARDS, OF THE COMPREHENSIVE ZONING ORDINANCE, FOR THE PROPERTY LOCATED AT 3111-3261 44TH STREET THE CITY OF VERNON WHEREAS, U.S. Growers Cold Storage, Inc. occupies buildings which require a variance from section 26.4.2-8, Development Standards, of the Comprehensive Zoning Ordinance, for the properties located at 3111-3261 44th Street; and WHEREAS, the physical condition of the property is unique in that the existing buildings as shown on Exhibit "A" measuring approximately 210,000 square feet in total were constructed with five conforming truck loading spaces and thirty-six non-conforming truck loading spaces measuring 10.0 feet in width: two being 25.5 feet in length, four being 36.5 feet in length; four being 28.5 feet in length; five being 29.5 feet in length; one being 38.0 feet in length; eight being 62.0 feet in length; two being 45.4 feet in length; six being 22.3 feet in length; and'four being 60.0 feet in length; and WHEREAS, U.S. Growers Cold Storage, Inc. uses the buildings for cold storage, and Zoning Ordinance section 26.4.2-7 (b) requires that a minimum of seventeen truck loading spaces be provided as shown on Exhibit "A"; and WHEREAS, Zoning Ordinance section 26.4.2-8 (c) specifies that each truck loading space shall be a minimum of 10 feet wide and 65 feet long, and section 26.4.6-4 (c) provides that a non-conforming building must comply with these 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 ~ ~ 24 ~ 26 27 28 standards within 5 years of April 18, 1989 unless a variance is granted; and WHEREAS, there is insufficient space on the properties and the application of the development standards for the truck loading space requirements will create an unreasonable hardship by requiring the thirty-six non-conforming spaces to be 10 feet wide and 65 feet long; and WHEREAS, U.S. Growers Cold Storage, Inc. has indicated that it will demolish all of the buildings by March 1, 1996 and thereafter will build new facilities encompassing the entire northerly block of 44th Street between Boyle and Alcoa Avenues; and WHEREAS, 3111-3261 44th Street is located in the M zone and the operation is consistent with the objectives of the General Plan and Zoning Ordinance; and WHEREAS, the City Council of the city of Vernon held a hearing on said application for a variance on June 7, 1994. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The city Council of the City of Vernon hereby finds and determines that the recitals contained herein- above are true and correct. SECTION 2: A variance from Section 26.4.2-8, Development Standards of the comprehensive Zoning Ordinance, requiring all truck loading spaces to be 10 feet wide by 65 feet long is hereby granted to U.S. Growers Cold Storage, Inc. at 3111-3261 44th Street. 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 ~ 23 24 25 26 27 28 SECTION 3: The variance shall be granted subject to the following conditions: (a) u.s. Growers Cold Storage, Inc. shall demolish all buildings with non-conforming truck loading spaces located between 3111 and 3261 44th Street or be in compliance with section 26.4.2-8, Development Standards of the Comprehensive Zoning Ordinance by March 1, 1996; and (b) within seven days of the adoption of this resolution, u.S. Growers Cold Storage, Inc. shall deliver a $50,000 certificate of Deposit to the City of Vernon, to be refunded to u.s. Growers Cold storage, Inc., including the interest earned, upon compliance with condition (a) or to be retained by the City of Vernon if compliance with condition (a) has not been attained by March 1, 1996. SECTION 4: Noncompliance with these conditions shall constitute sufficient grounds for the City Council of the City of Vernon to void this variance and require the application of the authorized truck loading space requirement. SECTION 5: The City Clerk of the City of Vernon shall certify to the passage of this Resolution and thereupon and thereafter the same shall be in full force and effect. VARIANCE APPLICATION JUNE 7, 1994 U.s. Growers Cold storage, Inc. has requested a variance from the Comprehensive Zoning Ordinance section 26.4.2-8, Development Standards, for the properties located at 3111-3261 44th Street in the City of Vernon. Growers Cold Storage, Inc. has indicated that it will demolish the buildings on 44th Street and build new facilities encompassing the entire northerly block of 44th Street between Boyle and Alcoa Avenues. They are requesting a variance to use the non-conforming truck loading spaces without restriction until the buildings are demolished. They are currently preparing plans to convert their facility on Vernon Avenue to accept their product from the 44th Street facilities. This conversion will be completed by the middle of 1995, at which time the demolition and construction will begin on 44th street. The construction is scheduled to be completed by January 1, 1997. section 26.4.2-7 (b) requires that a minimum of seventeen truck loading spaces be provided as shown on Exhibit "A". section 26.4.2-8 (c) of the Comprehensive zoning Ordinance specifies that each loading space shall be a minimum of 10 feet wide and 65 feet long and section 26.4.6-4 (c) provides that a non-conforming building must comply with these standards within five years of April 18, 1989 unless a variance is granted. u.s. Growers Cold Storage, Inc. has indicated that requiring all of the non-conforming truck loading spaces to be 65 feet long by 10 feet wide at this time would be a hardship because of the extent of their proposed construction and the time line that is involved. Their operation is in conformance with the Zoning Ordinance and General Plan. Therefore, it is recommended that the variance be granted sUbject to the following conditions: (a) u.s. Growers Cold Storage, Inc. shall demolish all buildings with non-conforming truck loading spaces located between 3111 and 3261 44th Street or be in compliance with Section 26.4.2-8, Development Standards of the Comprehensive zoning Ordinance by March 1, 1996; and (b) within seven days of the adoption of the resolution, u.s.
