A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
LASKEY WElL II, FROM SECTION 26.4.2-8,
DEVELOPMENT STANDARDS, OF THE
COMPREHENSIVE ZONING ORDINANCE, FOR THE
PROPERTY LOCATED AT 1901-2137 55TH
STREET AND 5320 ALAMEDA STREET IN THE
CITY OF VERNON
WHEREAS, Laskey Weil II owns a parcel of property which
requires a variance from section 26.4.2-8, Development Standards,
of the Comprehensive Zoning Ordinance, for the property located
at 1901-2137 55th Street and 5320 Alameda Street; and
WHEREAS, the physical condition of the property is
unique in that the existing buildings measuring approximately
407,500 square feet in total were constructed with twenty-seven
conforming truck loading spaces and eight non-conforming truck
loading spaces measuring 10.0 feet in width: six being 46.0 feet
in length; one being 51.0 feet in length; and one being 50.0 feet
in length; and
WHEREAS, the buildings are used for light
manufacturing, warehousing and .distribution and zoning Ordinance
section 26.4.2-7 (b) requires five truck loading spaces for
buildings with a gross floor area up to 200,000 square feet in
size and one truck loading space for each additional 100,000
square feet or fraction thereof, for a total of eight truck
loading spaces; and
WHEREAS, Zoning Ordinance section 26.4.2-8 (c)
specifies that each truck loading space shall be a minimum of
10 feet wide and 65 feet long, and section 26.4.6-4 (c)
provides that a non-conforming building must comply with these

standards within 5 years of April 18, 1989 unless a variance is
granted; and
WHEREAS, there is insufficient space on the property
to bring the non-conforming truck loading spaces into compliance
and the application of the development standards to such truck
loading spaces will create an unreasonable hardship by requiring
the eight non-conforming spaces to be 10 feet wide and 65 feet
long; and
WHEREAS, Laskey Weil It has indicated that they have no
plans to expand or alter the building configuration and that the
existing truck loading spaces are sufficient for the intended
use; and
WHEREAS, 1901-2137 55th Street and 5320 Alameda street
is located in the M zone and the operation is consistent with
the objectives of the General Plan and Zoning Ordinance; and
WHEREAS, 1901-2137 55th Street and 5320 Alameda Street
is located on the northeast corner of Alameda and 55th Streets
and the street right-of-way on 55th street is built to the width
shown on the Master Plan of Streets, dated June 16, 1992, but
the city does not own all of the 60.0 feet of the right-of-way;
and
WHEREAS, a portion of the property is currently used
as sidewalk; and
WHEREAS, the City Council of the city of Vernon held
a hearing on said application for a variance on June 21, 1994.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained herein-
above are true and correct.
SECTION 2: A variance from section 26.4.2-8,
Development Standards of the Comprehensive Zoning ordinance,
requiring all truck loading spaces to be 10 feet wide by 65
feet long is hereby granted to Laskey Weil II at 1901-2137 55th
street and 5320 Alameda street.
SECTION 3: The variance shall be granted subject to
the following conditions: (a) the usage of the non-conforming
truck loading spaces shall be limited so that no truck parked at
the loading docks shall extend into the street right-of-way as
shown on the Master Plan of Streets, dated June 16, 1992; and
(b) Laskey Weil II shall dedicate the necessary street right-
of-way to the City of Vernon, which is the portion of property
on 55th Street currently used as sidewalk; and (c) all existing
and future tenants shall be notified of this restriction and a
condition stating this shall be placed in their lease.
SECTION 4: Noncompliance with these conditions shall
constitute sufficient grounds for the City Council of the City
of Vernon to void this variance and require the application of
the authorized truck loading space requirement.
SECTION 5: The City Clerk of the City of Vernon shall
certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.

Honorable Members:
Laskey Weil II has submitted an application for a Variance from the
Comprehensive Zoning Ordinance, section 26.4.2-8, Development
Standards, for the buildings located at 1901-2137 55th Street and
5320 Alameda Street, and transmitted herewith is the following
evidence:
1. Application for Variance;
2. Affidavits of posting and mailing;
3. Notice of Public Hearing;
4. Engineer's Report.
The Buildings have twenty-seven conforming truck loading spaces and
eight non-conforming spaces. All eight spaces are 10 feet wide
with six being 46 feet long; the other two are 51 and 50 feet long.
The company is proposing to use only vehicles of a smaller length
at these docks. This has been reviewed by the Interim Director of
Community Services, and it is hereby recommended that the variance
be granted contingent upon the following Conditions:
a. The usage of the non-conforming truck loading
spaces shall be limited so that any truck parked
at the loading docks shall not extend into the
street right-of-way as shown on the Master Plan
of streets dated June 16, 1992.
b. Laskey Weill II shall dedicate the necessary
street right-of-way, which is the portion of
property on 55th Street currently used as side-
walk, to the City of Vernon.

LASKEY WElL II
VARIANCE APPLICATION
JUNE 14, 1994
Laskey Weil II has requested a variance from the
Comprehensive Zoning Ordinance section 26.4.2-8, Development
Standards, for the property located at 1901-2137 55th Street and
5320 Alameda Street in the city of Vernon. The buildings that
they own were constructed with twenty-seven conforming truck
loading spaces and eight non~conforming truck loading spaces
measuring 10.0 feet in width: six being 46.0 feet in length; one
being 51.0 feet in length; and one being 50.0 feet in length.
Laskey Weil II has stated that only vehicles of smaller lengths
will be used at the non-conforming truck loading spaces. The
buildings are used for light manufacturing, warehousing and
distribution and are approximately 407,500 square feet in total
size.
section 26.4.2-7 (b) requires five truck loading spaces for
buildings with a gross floor area up to 200,000 square feet in
size and one truck loading space for each additional 100,000
square feet or fraction thereof, for a total of eight truck
loading spaces. section 26.4.2-8 (c) of the Comprehensive Zoning
Ordinance specifies that each loading space shall be a minimum of
10 feet wide and 65 feet long and Section 26.4.6-4 (c) provides
that a non-conforming building must comply with these standards
within five years of April 18, 1989 unless a variance is granted.
