A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
DON V. STULL, PATRICIA STULL AND AARON
STULL, FROM SECTION 26.4.2-8,
DEVELOPMENT STANDARDS OF THE
COMPREHENSIVE ZONING ORDINANCE, FOR
THE PROPERTY LOCATED AT 5100 DISTRICT
BOULEVARD IN THE CITY OF VERNON
WHEREAS, Don V. Stull, Patricia Stull and Aaron Stull
own a parcel of property which requires a variance from section
26.4.2-8, Development Standards, of the comprehensive Zoning
Ordinance, for the property located at 5100 District Boulevard;
and
WHEREAS, the physical condition of the property is
unique in that the existing building measuring approximately
60,000 square feet was constructed with three conforming truck
loading spaces and two non-conforming truck loading spaces on
Fruitland Avenue of which the easterly one measures 10.0 feet in
width and 35.0 feet in length and the westerly one is not used;
and
WHEREAS, the building is used for wholesale
warehousing and Zoning Ordinance section 26.4.2-7 (b) requires
four truck loading spaces for buildings with a gross floor area ,~
of between 50,001 and 100,000 square feet in size; and
WHEREAS, Zoning Ordinance Section 26.4.2-8 (c)
specifies that each truck loading space shall be a minimum of
10 feet wide and 65 feet long, and section 26.4.6-4 (c)
provides that a non-conforming building must comply with these
standards within 5 years of April 18, 1989 unless a variance is
granted; and

WHEREAS, there is insufficient space on the property
and the application of the development standards for the truck
loading space requirements will create an unreasonable hardship
by requiring the non-conforming spaces to be 10 feet wide and 65
feet long; and
WHEREAS, 5100 District Boulevard is located in the M
zone and the operation is consistent with the General Plan and
Zoning Ordinance; and
WHEREAS, the City council of the city of Vernon
held a hearing on said application for a variance on June 21,
1994.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the city of Vernon
hereby finds and determines that the recitals contained herein-
above are true and correct.
SECTION 2: A variance from section 26.4.2-8,
Development Standards of the Comprehensive Zoning Ordinance,
requiring all truck loading spaces to be 10 feet wide by 65
feet long is hereby granted to Don V. Stull, patricia Stull
and Aaron Stull at 5100 District Boulevard.
SECTION 3: The variance shall be granted subject to
the following conditions: (a) the usage of the easterly non-
conforming truck loading space on Fruitland Avenue shall be
limited so that no truck parked at the loading dock shall extend
into the existing street right-of-way; (b) the westerly non-
conforming truck loading dock on Fruitland Avenue shall be sealed

and the driveway shall be removed and replaced with city of
Vernon standard curb, gutter and sidewalk; and (c) all existing
and future tenants shall be notified of this restriction and a
condition stating this shall be placed in their lease.
SECTION 4: Noncompliance with these conditions shall
constitute sufficient grounds for the City Council of the City
of Vernon to void this variance and require the application of
the authorized truck loading space requirement.
SECTION 5:
The City Clerk of the City of Vernon shall
certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.

Honorable Members:
Don V. stull, Patricia stull and Aaron stull have submitted an
application for a Variance from the Comprehensive Zoning Ordinance,
section 26.4.2-8, Development Standards, for the building located
at 5100 District Boulevard, and transmitted herewith is the
following evidence:
1. Application for Variance;
2. Affidavits of posting and mailing;
3. Notice of Public Hearing;
4. Engineer's Report.
The building has three conforming truck loading spaces, and two
non-conforming spaces on Fruitland Avenue. The easterly non-
conforming space is 10 feet wide and 35 feet long and the westerly
space is not used. The company is proposing to use vehicles of a
smaller length at the easterly dock and not use the westerly dock.
This has been reviewed by the Interim Director of Community
Services, and it is hereby recommended that the Variance be granted
contingent upon the following Conditions:
a. The Usage of the easterly non-conforming truck
loading space on Fruitland Avenue shall be
limited so that any truck parked at the loading
dock shall not extend into the existing street
right-of-way.
b. The westerly non-conforming truck loading dock
on Fruitland Avenue shall be sealed and the
driveway shall be removed and replaced with
City of Vernon standard curb, gutter and side-
walk.

We want to continue the use of the short dock, located on Fruitland,
to accomodate short trucks. This dock shows on the plan and already
exists and is in use daily.
NOTICE TO APPLICANT: In the variance procedure it shall be shown that
the fOllowing five (5) conditions exist in reference to the property being
considered. The applicant should answer the following statemen~s. If you
have difficulty finding reasonable answers to the statements contained in
this application it may be an indication that your request has insuffici~nt
factors to justify approval. (Attach additional sheet(s) if necessary)
(1) That special conditions and circumstances exist which are peculiar to
the land, structure, or building i~volved and which are not generally
applicable to other lands, structures, or buildings in the same vicinity
and zone:
l. The truck dock already exists. It has been and is currently in use for
short trucks. We have never had a problem, as we do not use lt tor Long
trucks. Long trucks load & unload on District Blvd.
2. If this dock were expanded, it would adversely effect torkLltt trattlc
in that area.
3. It would also interfere with access to our yard area by the l<'lre Dept.
4. Fruitland is only 40 feet wide and making this d~ck deeper to accomodate
large trucks, would probably create trafflc problems.
(2) That literal interpretation of the provisions of this ordinance would
deprive the applicant of rights commonly enjoyed by other properties in the
same vicinity and zone in which the property is located, under the terms of
this Chapter. .
The property next door, (Book 6304, Page l2, Parcel 12) already has a
similar varience approved and it does not create a problem.

(3) That the special conditions and circumstances do not result from
actions of the applicant:
The truck dock in question has existed for more that twenty (20) years.
Although the street is only 40 feet wide, it has not caused any problems.
(4) That granting the variance requested will not confer on the applicant
any special privilege that is denied by this Chapter to other lands,
structures, or buildings in the same vicinity and zone in which the property
is located:
I believe this to be true, because there is already a varience next door.
Also. this varience will not create any new problems or any proplems for
our neiqhbors, or interfere with access of use of the street in any way.
(5) That the granting of such variance will be in harmony and not adversely
affect the Comprehensive General Plan:
The present use of this dock does not interfere with traffic on Fruitland.
By restricting the. use to 45' trucks will not interfere with traffic and
they will not create a problem qenerally.
NOTE:
Non-conforming use of neighboring lands, structures, or buildings shall not
be considered grounds for the issuance of a variance.

ENGINEER'S REPORT
DON V. STULL, PATRICIA STULL AND AARON STULL
VARIANCE APPLICATION
JUNE 14, 1994
Don v. stull, Patricia stull and Aaron stull have requested
a variance from the Comprehensive Zoning Ordinance section
26.4.2-8, Development Standards, for the property located at
5100 District in the City of Vernon. The building that they own
was constructed with three conforming truck loading spaces and
two non-conforming truck loading spaces on Fruitland Avenue: the
easterly one measures 10.0 feet in width and 35.0 feet in length
and the westerly one is not used. Don V. Stull, patricia Stull
and Aaron Stull have stated that only vehicles of smaller lengths
will be used at the easterly non-conforming truck loading space
and the westerly one will not be used. The building is used for
wholesale warehousing and is approximately 60,000 square feet in
size.
section 26.4.2-7 (b) requires four truck loading spaces for
buildings with a gross floor area of between 50,001 and 100,000
square feet in size. section 26.4.2-8 (c) of the Comprehensive
Zoning Ordinance specifies that each loading space shall be a
minimum of 10 feet wide and 65 feet long and section 26.4.6-4 (c)
provides that a non-conforming building must comply with these
standards within five years of April 18, 1989 unless a varianpe
is granted.

Don V. stull, Patricia stull and Aaron stull have indicated
that requiring the non-conforming truck loading spaces to be 65
feet long by 10 feet wide would be a hardship. They have
indicated that they have no plans for expansion or alteration of
the building configuration. Their operation is in conformance
with the Zoning Ordinance and General Plan. Therefore, it is
recommended that the variance be granted with the following
conditions: (a) the usage of the easterly non-conforming truck
loading space on Fruitland Avenue shall be limited so that no
truck parked at the loading docks shall extend into the existing
street right-of-way; and (b) the westerly non-conforming truck
loading dock on Fruitland Avenue shall be sealed and the driveway
shall be removed and replaced with City of Vernon standard curb,
gutter and sidewalk; and (c) all existing and future tenants
shall be notified of this restriction and a condition stating
this shall be placed in their lease.
