A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND AUTHORIZING THE EXECUTION
OF A CONSULTING AGREEMENT FOR CIVIL ENGINEERING
SERVICES BY AND BETWEEN THE CITY OF VERNON AND
DONALD R. HOWARD CONSULTING ENGINEERS, INC.

WHEREAS, the City of Vernon desires to retain the
7
services of a consulting engineer to provide civil engineering
8
services to the City of Vernon on water related problems; and
9
WHEREAS, Donald R. Howard of Donald R. Howard Consulting

Engineers, Inc. is a licensed civil Engineer who is qualified to
II
provide civil engineering services on water related problems; and

WHEREAS, the City of Vernon and Donald R. Howard
Consulting Engineers, Inc. desire to enter into an agreement to
l4 provide for said water related services.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE

CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon does

hereby find and determine that the recitals contained hereinabove

are true and correct.

SECTION 2: The City Council of the City of Vernon hereby
approves the Consulting Agreement for civil Engineering Services,
22
a copy of which has been presented to the City Council
23
concurrently with this resolution, and the City Council hereby
24
orders said Agreement to be received and filed by the City Clerk.
25
SECTION 3: The City Council of the City of Vernon hereby
26
authorizes the Mayor and City Clerk to execute said Agreement for,
27
and on behalf of, the City of Vernon.

SECTION 4: The City Clerk of the City of Vernon shall

certify to the passage of this resolution and thereupon and
3
thereafter the same shall be in full force and effect.

APPROVED AND ADOPTED this 21st day of June, 1994.

RECITALS

WHEREAS, the CITY is in need of a consulting engineer to

provide civil engineering services to the CITY on water related

problems; and

WHEREAS, CONSULTANT is a licensed civil Engineer and is
23
qualified to provide civil engineering services on water related
24
problems; and

WHEREAS, the CITY desires to contract with CONSULTANT to
26
provide civil engineering services.

1 NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL PROMISES,
2 COVENANTS AND CONDITIONS HEREINAFTER SET FORTH, THE PARTIES HERETO
3 AGREE AS FOLLOWS:
4 SECTION 1: The CITY hereby retains the CONSULTANT to
5 provide civil engineering services for water related problems
6 under the dir~ct authority of the City Administrator under the
7 terms and conditions specified herein and the CONSULTANT hereby
8 agrees so to serve and to report directly to the City
9 Administrator and receive instructions accordingly.
lO SECTION 2: CONSULTANT hereby agrees to provide civil
II engineering services under the terms and conditions specified
l2 herein.
l3 SECTION 3: This Agreement shall be effective as of June
l4 21, 1994, and shall be subject to thirty (30) days written notice
l5 by either party of their intention to terminate said Agreement.
l6 SECTION 4: The CITY shall pay the CONSULTANT, for the
l7 performance of the services herein required, the fees provided for
l8 in Exhibit" 1" attached hereto and made a part hereof. In
19 addition, the CITY shall reimburse CONSULTANT for any monies
20 advanced or expended by said CONSULTANT on behalf of the CITY for
2l necessary and reasonable expenses incurred in the performance of
22 its services for the CITY, exclusive of office facilities,
23 secretarial services, local telephone charges and local automobile
24 transportation. The CONSULTANT shall submit to the City
25 Administrator, a detailed itemization of all hours worked and all
26 costs incurred for each said project on a monthly basis. The City
27 Administrator must approve said work sheet report and invoice
28 before paYment is made.
